These minutes are formally submitted to the Town of Minturn Planning Commission for approval as the official
written record of the proceedings at the identified Council Meeting. Additionally, all Council meetings are tape-
recorded and are available to the public for listening at the Town Center Offices from 8:30am — 2:00 pm, Monday
through Friday, by contacting the Town Clerk at 970/827-5645 302 Pine St. Minturn, CO 81645.

1. Call to Order
Lynn T. called the meeting to order at 6:30pm

Note: Lauren D. did not vote as the alternate.

Motion by Greg G., second by Greg S., to approve the Minutes of October 10, 2018 as presented.
Motion approved 5-0.

6. Design Review & Land Use Application Public Hearings
• 611 Main Street — Havlik Residence DRB Application for Exterior Siding Change
Scot H. introduced the application and noted the applicant, Mr. Cavan Havlik, was present.
Scot H. noted this is a project that has been under construction for some time and has been
reviewed and approved by the Planning Commission, however, the original application did not
include outside siding. Kathy B., Minturn Code Enforcement Officer, noted the siding was being
addressed by the applicant and informed Scot H. who requested Mr. Havlik to come back to the
Design Review Board (DRB). Scot H. noted the materials compliment the house and the
neighbors. Scot H. stated if someone desires to paint their home they can, the issue here is the
original DRB application stated the siding would not be changed.
Greg G. addressed the applicant stating this is the 2nd time he has made a change without
approval. He stated Mr. Havlik is well aware of the design review process and yet he has been
red -tagged again for a similar violation. Mr. Havlik stated he did not know this was prohibited
and was confused. Greg G. stated he did not have a problem with the siding, rather the lack of
adherence to the rules. It was noted Mr. Havlik has been fined 2x the DRB fee as a result.
Burk H. stated it is an improvement and it does look nice. He stated the picture represents one
corner it does not show well the full appearance giving a limited perspective.
Greg S. agreed with the comments that this should have been reviewed prior in the DRB not after
caught changing the materials. The concern expressed by all that he should be asking permission
to change items approved, not to ask forgiveness after the fact.

Discussion ensued as to the impact of the changes and how it could be better blended from the
various materials. The Commission recommended encasing the upper window in the back.
Motion by Jeff A., second by Greg S., to accept the siding changes made as presented. Motion
passed 5-0.
• 82 Toledo Avenue — Hansen Residence Conceptual Plan Review for New Single -
Family Residence with Attached Accessory Apartment
Scot H. noted this is a conceptual review and direction only and introduced Mr. Matt Hansen as
the applicant. It was noted the property fronts the west side of Toledo Ave (NW corner of Toledo
and Pine) which is a dead-end area of the Toledo Ave and used for seasonal snow storage by the
town.
Summary of Request:
The Applicants, Matt and Beth Hansen, request Conceptual Plan review of a new, three-
bedroom, single-family residence with an attached, one -bedroom Accessory Apartment located
at 82 Toledo Avenue. The conceptual plans show a two-story, contemporary structure with roof
and building forms that appear to be contextually appropriate and compatible with neighboring
properties and improvements. According to staff's analysis of development standards and
dimensional limitations in Section III below, proposed improvements are generally compliant
with setback standards as well as maximum building coverage and parking requirements.
However, staff has identified potential issues related to:
• Building Height
• Roof Pitch
• Maximum Impervious Coverage
• Final Plan -level of Detail
• Protection of Town Right -of -Way
Staff believes that the Applicant has generally provided a complete set of plans and a fairly high
level of detail necessary to complete a thorough review. However, due to the above referenced
issues or outstanding details that must be resolved prior to any Final Plan approval, staff has
deemed this a Conceptual Plan review. Alternatively, the Planning Commission has the option to
recommend Final Plan approval with specific conditions and giving the Applicant and staff clear
direction on any recommended revisions to the plans.
Discussion ensued that two pieces of property are being combined to make this project work: 93
Nielson and 82 Toledo Ave. Concern was discussed if the design standards were required or
recommended and the site was confirmed to be in the 100 Block Commercial Zone (it is) and if a
residence is a use by right in the zone. A decision would need to be made at Staff level regarding
the use by right.
Greg S. noted the midline height is 29ft, one foot over the allowed maximum at various
elevations; discussion ensued how that could be mitigated. Greg S. stated the more restrictive
read, required by the code, from existing. grade

Mr. Hansen stated they have reworked the height, grade, and elevations so that might be enough
to mitigate the midpoint and the tower height concerns.
Other design concepts were discussed to reduce the large expanses of various exterior walls to
break up the expanse with features. Snow storage was discussed which indicated he would plow
snow and then snow blow or shovel it further back into the east side of the property. He is
considering reducing the total structure (side to side) to allow for better placement on the lot, to
allow for better access to snow storage, and to better fit on the lot. Scot H. stated the parking
would need to be delineated to ensure the parking meets code and does not negatively affect the
impervious surface coverage.
Mr. Hansen noted half of the neighbor's driveway (80 Toledo) is half on his property and he
would provide an easement; however, when reviewing setbacks this needs to be considered.
Discussion ensued as to the exterior materials, how the stucco will be used and broken up, extent
thereof, etc. This will be reviewed more as the plans evolve and are approved.
Jeff A. asked about the retaining wall that will extend north from Toledo to Nelson Ave;
proposal is for a boulder retaining wall. Mr. Hanson detailed how he proposes this.
Public Comment:
Mr. Fraser Horn, 499 Meadow Rd., discussed the road as well. He stated the area is not
maintained well with snow removal. With this house, traditional snow storage would be affected.
Discussion ensued as to what the next steps are to accommodate the road. Scot H. expressed that
this is a concern and it will be addressed in the near future in discussions amongst staff.

8. Planning Director Report
• General updates on upcoming/ongoing projects
Scot H. gave an overview. Bolts Lake will be coming back as Preliminary PUD Review in the
next few weeks. He updated on 1251 Main St. He has received calls on 1041 and 1021 Main. He
updated on the work being done at the Enclave property (600 Main). They have permits for
remediation of mold and roof repairs and are working on DRB proposal. We are looking at
housing and a potential work session prior to drafting a housing plan to adopt affordable housing
guidelines. Discussion ensued on restrictions and requirements as to how affordable housing
might work in Minturn and how the plan might compare and complement the county and
adjacent town's and their associated plans.

Discussion ensued as to the parking needs along Taylor St. and how trail head parking will need
to be addressed. This discussion included how the UPRR land could be developed to meet
specific goals that would enhance that area of town by setting zoning guides desired in any
proposed PUD.
Scot H. is also working on Chapter 16.
