He noted that in order to mitigate the transmission of the virus, the Board is complying with the Executive Order that suspends the requirement of the Open Meeting Law to have all meetings in a publicly accessible physical location. He noted that the Executive Order allows public bodies to meet entirely remotely as long as the public body makes provisions through adequate, alternative means to ensure that interested members of the public are provided reasonable access to the deliberations of the meeting. He noted that for this meeting the Commission is convening by video conference via Zoom App as posted on the Town’s web meeting calendar and the Commission’s agenda identifying how the public may join. He noted that the meeting may also be broadcast by HCAM TV. He noted that the meeting is being recorded and attendees are participating by video conference. • A Roll Call was held for members: Ms. Recos – present, Mr. Ciriello – not present, Mr. Barker-Hook – not present, Mr. Harrow – present, Ms. LeBlanc – present, Ms. Reed – not present, Mr. Barnes – present • A Roll Call was held for staff: Ms. Rogers – present, Mr. Varrell – present, Ms. Ciaramicoli – present • FBC Foxhollow LLC, 5 Foxhollow Rd (HCC-30) – Request for Minor Modification – continuation. Ms. Ciaramicoli stated the applicants have requested to install medallions. The Commission requested the plan be changed noting the “conservation markers” are permanent immovable barriers (PIB). The Commission approved the modification with revised plan. • FBC Foxhollow LLC, 3 Foxhollow Rd (188-1681) – Request for Minor Modification – continuation. Ms. Ciaramicoli stated the applicants have requested to install medallions. The Commission requested the plan be changed noting the “conservation markers” are permanent immovable barriers (PIB). The Commission approve the modification with revised plan. Ms. Reed and Mr. Barker-Hook joined the meeting at this time. Hopkinton Conservation Commission 14 September 2021 Page 2 of 4 • Wall Street Development Corp, 0 Leonard St (HCC 33) – Violation Discussion. Lou Petrozzi, Wall Street Development. Ms. Ciaramicoli stated she issued an Enforcement Order to Wall Street Development on September 13, 2021. The Enforcement requires Wall Street Development to complete construction of on-site stormwater infrastructure no later than November 1, 2021, to establish a dewatering plan in compliance with the Order of Conditions, USEPA General Construction Permit, and best management practices, along with repair and/or replacement of inoperable erosion controls. In response, Mr. Petrozzi indicated construction of on-site stormwater facilities has been delayed due to rain. He expressed frustration in attempting to find an appropriate location on site to dewater in compliance with the Order of Conditions. Therefore, Wall Street Development is seeking approval from the Commission to direct dewatering discharge beyond the approved limits-of-work. The Commission inquired as to if the erosion and sedimentation controls have been repaired. Mr. Petrozzi indicated he will fix the erosion control barrier (ECB) once the on-site water level is down. The Commission expressed concerns that the ECB’s are still not fixed and additional rain is forecasted. They expressed concerns that the drainage work is not completed and the site is void of vegetation, resulting in an increase in surface runoff. The Commission discussed the drainage work, indicating it needs to be completed by November 1, 2021 or the site needs to be restored as per the Enforcement Order. It was noted the Commission has been receiving complaints regarding the amount of water coming off the site. Mr. Barnes noted the site needs to be brought into compliance. Mr. Barker-Hook made a motion to ratify the Enforcement Order. The motion was seconded by Mr. Harrow and a unanimous roll call vote was held. 7:37 PM Petracca, 215 Winter Street DEP File No. 188-1761 Notice of Intent - continuation Peter Bemis, Engineering Design Consultants Mr. Bemis gave an overview of the site plans dated July 15, 2021, revised through September 9, 2021. The following points were discussed: - Design and location for the permanent immovable barriers (PIB) - Revised delineation behind the proposed house - Fire Department has confirmed the proposed driveway meets standards - Proposed retaining wall along the driveway has been removed - Applicant proposing to re-set the driveway culverts - Lack of a DEP file number - Applicant will be submitting a letter regarding driveway alternatives A discussion was held regarding 188-98, the original filing for the property. It was noted there is an Enforcement Order on the property. Mr. Bemis stated he will look into it and look at closing out the Order of Conditions. The Commission expressed concerns regarding the slope behind the proposed house. A discussion was held regarding adding a PIB at the top of the slope and leaving the slope vegetated or moving the retaining wall to the top of the slope. Mr. Bemis stated he will review the suggestions. The hearing was continued to September 28, 2021. Hopkinton Conservation Commission 14 September 2021 Page 3 of 4 7:50 PM Wall Street Development, Lot 1A Leonard St HCC-35 Amended Notice of Intent – continuation Wall Street Development, Lot 2A Leonard St HCC-36 Amended Notice of Intent – continuation Wall Street Development, Lot 3A Leonard St HCC-37 Amended Notice of Intent – continuation Lou Petrozzi, Wall Street Development Mr. Barnes gave the Commission an overview of the project finances review dated September 14, 2021 that Ms. Ciaramicoli prepared. Mr. Petrozzi agreed to pay Wall Street Development’s outstanding balance to the Conservation Commission for services rendered to date. Mr. Barnes gave the Commission an overview regarding inspections going forward and requested $3800.00 for upcoming Lucas Environmental inspections and review of the project. Mr. Petrozzi noted he wants to ensure the project goes smoothly and according to plan and noted the inspections aren’t going to plan due to miscommunication. Mr. Barnes stated the Commission has worked with applicant to minimize the fees. Mr. Petrozzi stated he would like productive inspections and agreed to pay the $3800.00 proposed review fee. Mr. Petrrozzi gave an overview of the proposed amendment including the following points: - Changed the grade to provide gravity sewer connections - Added roof drywells for the houses - Add and/or move electric poles to provide power Ms. Ciaramicoli stated that Lucas Environmental hasn’t done a review of the application as the consultant fees hadn’t been paid to date. The hearings were continued to September 28, 2021. 8:06 PM Ravenwood LLC, 0 Hayden Rowe Street DEP File No. 188-1758 Notice of Intent - continuation Scott Goddard, Goddard Consulting; Joseph Marquedant, JD Marquedant & Associates Ms. Ciaramicoli stated that Lucas Environmental has not reviewed the revised plans to date. Mr. Marquedant gave an overview of the site plans dated March 15, 2021, revised through September 7, 2021 and made the following points: - Revised location of wetland replication area - Detention area: shifted a portion of the basin to reduce riverfront area disturbance - Construction phase plan: Applicant’s position is that the project doesn’t need phasing, but has added some sequencing onto the plan - Limit alterations to what can be done in 1 season Mr. Goddard stated they have filed three individual Notices of Intent for an upcoming meeting. Ms. Ciaramicoli stated she has requested confirmation from the applicant regarding the 21 day extension to hold a meeting for those lots. Mr. Goddard gave a verbal authorization to schedule the three lots on the October 19, 2021 meeting. The hearing was continued to September 28, 2021. Hopkinton Conservation Commission 14 September 2021 Page 4 of 4 8:18 PM Commission Business – continuation • REC Hopkinton, LLC, Chamberlain/Whalen Subdivision (188-1648) – Violation Discussion. Mark Arnold, Goddard Consulting; Kathi Sherry, REC Hopkinton LLC. Ms. Ciaramicoli gave the Commission an overview of her recent site walk and expressed concerns regarding some of the existing conditions and made the following points: - Observed dewatering of a sediment forebay outside the approved limit of work and within 0- 50 buffer zone. No evidence of siltation but it was not in an approved location - Many of the stormwater BMP’s had turbid water in them - Outlets becoming overwhelmed and overtopped, resulting in muddy water past the limit of work - Slope blowout as well that overtopped silt fence - Lot of cleared area at the site is not stabilized - Substantial amount of erosion control barriers working and feels the stream crossing area was good Mr. Arnold stated the site has been cleaned up, all the basins have been seeded and the applicant has been installing check dams along the roadway. He stated he feels both the contractor and the applicant have been listening to recommendations by Goddard Consulting. • Egbuna, 3 Sadie Lane – Tree Removal request. No one attended the meeting on behalf of the applicant. The item was tabled to the next meeting. • Discuss in person verse remote meetings. The Commission determined to continue to meet remote through the end of November 2021. • Mr. Harrow brought up the subject of invasive species around town and if the members had any suggestions regarding trying to eradicate them. Mr. Barnes stated some of the issue regarding it is funding for removal, private property access and Commission jurisdiction. The item was tabled to a future meeting to discuss ideas further. • A discussion was held regarding changes in Stormwater Regulations related to the 100-year storm, status of DEP’s stormwater standards revisions, and climate resiliency. A discussion was held regarding the possibility of the Town adopting the NOAA plus plans in the future. It was noted the Commission regulations will also need to be updated once changes come down from other entities. Adjourn: 8:43 PM
