HomeMy Public PortalAbout2017-09-051 REGULAR COUNCIL MEETING, SEPTEMBER 5, 2017 CALL TO ORDER The Regular Council Meeting of September 5, 2017, was convened at 6:00 P.M. by Mayor Carrie Tergin. ROLL CALL The f ollowing Council Members were present for the roll call: Present: Fitzwater, Graham, Henry, Hussey, Kemna, Mihalevich, Prather, Schreiber, and Ward Absent: Wiseman A quorum was declared present. ADOPTION OF THE AGENDA A motion was made by Councilman Henry, seconded by Councilman Prather, to adopt the agenda with an amendment to move item 7-b (Update on Hurricane Harvey Relief Efforts) up to item 4-b (Miscellaneous Agenda Items) to allow for the addition of recognition of a local six-year-old boy’s personal efforts to raise funds for hurricane relief. The motion to adopt as amended was approved unanimously. Mayor Tergin recognized some Boy Scouts in the audience and asked them to come forward and introduce themselves and state what school and Troop they represented. The four Scouts were all from Troop 8 at Trinity Lutheran School. She welcomed them and wished them well in their Scouting efforts. MISCELLANEOUS AGENDA ITEMS Mayor Tergin read a proclamation for “Constitution Week” and presented it to Ms. Vivian Kaysen with the Daughters of the American Revolution (“DAR”) who accepted the proclamation and made comments regarding the event’s history. Red Cross Hurricane Relief: Councilman Graham made a brief presentation regarding efforts of the American Red Cross in their efforts to provide relief to victims of those impacted by hurricane Harvey. He stated those wishing to donate to the Red Cross efforts may either do so at the local office or on the Red Cross donation website. 2 REGULAR COUNCIL MEETING, SEPTEMBER 5, 2017 Salvation Army Hurricane Relief: Lieutenant Christopher White of the Jefferson City Salvation Army made a presentation regarding hurricane Harvey relief efforts by the Salvation Army. He indicated donations could be made at Salvation Army’s website. Mayor Tergin introduced Hudson, a six-year-old boy who was noticed over the weekend selling lemonade to raise funds for the J.J. Watts Hurricane Relief fund. Hudson’s mother explained that he had raised about $1,000.00 and he planned to have the stand open again on the weekend of September 9. The Mayor and Council Members then gave Hudson their own donations to add to his fund. He was then presented with a City coin and congratulated by the Mayor and Council for his efforts. PUBLIC HEARINGS a. Endorsing the Historic Southside Old Munichburg District and Neighborhood Plan as a Component of the Jefferson City Comprehensive Plan Mayor Tergin explained that the public hearing would proceed as scheduled, but that the Council would not be voting on the associated Resolution tonight to allow the City’s Law Department to research some issues pertaining to the process for amending the Comprehensive Plan. Senior Planner Eric Barron made a staff presentation and offered to answer any questions asked by the Mayor and Council. Mayor Tergin then opened the floor for public testimony on the issue. The following persons came forward to speak: In Favor:  Ms. Janet Weckenborg, Capital Region Medical Center  Ms. Angela Hirsch, Central Missouri Community Action As no one else came forward to speak on the issue, Mayor Tergin declared the evidentiary portion of the public hearing concluded and stated the Council would now take up the associated resolution. A motion was made by Councilman Graham to postpone indefinitely action by the Council on the issue to allow legal research into the process for amending the Comprehensive Plan. The motion was seconded by Councilman Mihalevich, and approved unanimously by the following roll -call vote: 3 REGULAR COUNCIL MEETING, SEPTEMBER 5, 2017 Aye: Fitzwater, Graham, Henry, Hussey, Kemna, Mihalevich, Prather, Schreiber, and Ward Nay: None b. Final PUD Plan for 1732 & 1736 Vieth Drive A staff presentation was made by Senior Planner Eric Barron. A presentation was made by Mr. Paul Sampson on behalf of the applicant. He provided a handout showing changes made to address concerns of both the City and the residents in the area after presentation of the preliminary plan. He answered questions asked by the Council about specific issues. Mayor Tergin then opened the floor for public testimony on the issue. The following persons came forward to speak:  Ms. Cindy Juckette, applicant, and owner of the proposed development As no one else came forward to speak on the issue, Mayor Tergin declared the evidentiary portion of the public hearing concluded and stated the Council would now take up the associated pending bill. 2017-59 sponsored by Councilman Graham, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, APPROVING A FINAL PUD PLAN FOR PROPERTY ADDRESSED AS 1732 AND 1736 VIETH DRIVE. Bill 2017-59 was read third time by title, placed on final passage, and passed by the following roll-call vote as Ordinance 15717: Aye: Fitzwater, Hussey, Kemna, Mihalevich, Prather, Schreiber, and Ward Nay: Graham and Henry APPOINTMENTS BY THE MAYOR There were no appointments recommended at this time. 4 REGULAR COUNCIL MEETING, SEPTEMBER 5, 2017 PRESENTATIONS FROM STAFF, CONSULTANTS, AND INVITED GUESTS Fire Department Division Chief Jason Turner made a brief presentation, including a video, regarding “Red Cross Preparedness Month.” ANNOUNCEMENTS BY MAYOR, COUNCIL, AND STAFF Mayor Announcements:  Mayor Tergin asked Police Lieutenant Pat McCutcheon to provide information to citizens who had asked what could be done to assist with animals impacted by hurricane Harvey. Lt. McCutcheon stated the City’s Animal Control Division was waiting for an official request for any help before being able to provide assistance, but that in the meantime, citizens could donate to the Humane Society at the state level in those states impacted;  The Historic City of Jefferson had recently donated $20,000.00 to the Old Town Revitalization Company for the City’s down payment assistance program. She thanked them for this important effort to revitalize Jefferson City;  Mayor Tergin and several Council Members recently attended the Stadium Boulevard Roundabout ribbon cutting ceremony;  The grand opening of the Helias Ray Hentges Stadium was recently celebrated, and Mayor Tergin congratulated Helias on that great addition to their school and to the City;  On Sunday, September 10, the 110-story Memorial Stair Climb would be held at the Jefferson Building in remembrance of the firefighters who lost their lives during the September 11 attack on the World Trade Center. Registration would begin at 7:30 A.M.;  On Sunday, September 10, from 4:00 to 6:00 P.M., Operation Bugle Boy would hosting a chicken dinner fundraiser at the American Legion; City Council Announcements:  Councilman Kemna announced he had participated in the following activities on Saturday, September 2: (1) opening ceremony for the State Horseshoe Championship from which some proceeds would go towards a horseshoe pit at the Special Olympics Training for Life facility; (2) the “Catch Me If You Can” and “Prison Break Run” events for both adults and children; and (3) a Police ride- along until 2:00 a.m. which was very informative. 5 REGULAR COUNCIL MEETING, SEPTEMBER 5, 2017  Councilman Graham announced that on Saturday, September 9, Lincoln University in Jefferson City would host Lincoln University, PA, for LU’s first home game and invited everyone to attend to support the Lincoln Blue Tigers. GO INTO CLOSED SESSION Mayor Tergin stated that, Pursuant to Sec. 610.021 of the Revised Statutes of Missouri, the Chair would entertain a motion to go into Closed Session to discuss the following: a. Legal Actions [Sec. 610.021.(1)] A motion was made by Councilman Mihalevich to go into Closed Session at this time for the above stated purposes, seconded by Councilwoman Ward, and approved unanimously by the following roll-call vote at 7:43 P.M.: Aye: Fitzwater, Graham, Henry, Hussey, Kemna, Mihalevich, Prather, Schreiber, and Ward Nay: None
