SUBJECT: APPROVAL OF LINDEN WALK SCULPTURAL DESIGN
RECOMMENDATION:

The City Council, upon recommendation by the Public Arts Commission, is requested to
approve the design for Balance, an art sculpture to be located at the Linden Walk
subdivision.
BACKGROUND:
1. On January 7, 2014, the City Council (Council) approved a development agreement
with Olson Company for Linden Walk, a subdivision of 74 homes at 9250 Lower
Azusa Rd. In exchange for the City's entitlement approvals, the agreement outlines a
series of conditions the developer must meet, including provisions for public art.
2. On August 6, 2014, the Public Arts Commission (Commission) reviewed three design
concepts for a sculpture at the subdivision's sole driveway at Lower Azusa Road.
The Commission tentatively selected Balance for final approval, contingent upon
Olson Company presenting an associated landscaping plan for visual compatibility.
3. On October 1, 2014, the Commission received a presentation on said landscaping
plan. Subsequently, the advisory body voted 6-0 to recommend for Council approval,
Balance, a design and sculptural installation at the Linden Walk driveway entrance.
DISCUSSION:
The City's development agreement with Olson Company requires installation of a public
art sculpture at the southwestern boundary of the Linden Walk subdivision (Attachment
"A"). Specifically, the developer shall provide an artwork of approximately $50,000 in
value,

which includes costs for fabrication, installation and conservation reviews (Attachment
"B"). The Commission is to recommend final artwork design prior to formal Council review
and approval.
This past summer, artist Greg Hawthorne was commissioned by Olson Company to
develop three sculptural designs. Those concepts—summarized below and provided as
Attachment "C"—incorporate corten and stainless steel materials, are abstract in
nature, and take cues from the subdivision's feng shui and architectural sensibilities.
Genoa: Also known as "The Sail", this concept features a large jib element.
Its simple and clean design is intended to catch one's eye when the
sun hits the stainless steel, giving a feeling of wind and movement.
Dimensions: 10'H x 97W
Gateway: The concept's prominent circle depicts an inclusive Linden Walk
neighborhood, while the long steel shape represents a gateway into
the new developments that surround Temple City.
Dimensions: 10'H x 15'6"W.
Balance: The design alludes to flow and balance. Its circular element
symbolizes Linden Walk as the new center of Temple City, providing
positive energy and an intricate balance of homes.
Dimensions: 12'H x 10'4"W.
The Commission reviewed each concept; Balance was ultimately selected for final Council
recommendation, based on the following factors:
Form: The design's many elements provide variety, dimension and illusion.
Its scale and abstract nature align well with the subdivision's feng
shui principles of orientation, space and landscape (Attachment "D").
Function: The use of satin stainless steel allows for reflectivity, providing warm
color tones and visual motion. It also offers an interactive user
experience as light reflectivity changes throughout the day.
Meaninq: The design takes cue from the subdivision's location between a
railroad and drainage channel (Attachment "E"). The circle
symbolizes a coming into Linden Walk; the grounding line insinuates
entrance.
Materials: A hybrid of corten and stainless steel provide color and textural
contrasts. Both materials allow for durability, a higher life cycle, and
no special maintenance or care.
Moving forward, should the Council approve the Commission's recommendation, Olson

Company would commission Hawthorne to fabricate the sculpture. Under terms of the
development agreement, the sculpture must be installed prior to the City's issuance of a
Certificate of Occupancy for the subdivison's 60th dwelling unit—or Spring 2015, based
on the development's current phasing schedule.
CONCLUSION:
The Council is requested to approve the final design for Balance, an art sculpture to be
located at the Linden Walk driveway entrance.
FISCAL IMPACT:
The recommended action presents no fiscal impact to the FY 2014-15 City Budget.
Under terms of the agreement, Olson Company will provide funding for the sculpture's
fabrication and installation; the Linden Walk Homeowners Association is responsible for
future maintenance activities and costs.
Note: As the City is not funding or maintaining the sculpture, it will not be included
with, or under purview of the City's emerging Art in Public Places collection.

8.2 Improvement Security. Developer shall provide to the City, by no later than the
issuance of specific permits for the construction of the Public Improvements, an instrument or
instruments securing the commencement, completion, and workmanship of the Public
Improvements and securing the payment of laborers and materialmen performing or to perform
work on the Public Improvements (collectively "imnrovement Security"). The
Improvement Security shall be one or more of the securities listed under California Government
Code § 66499, as is designated by the City. The principal amount of any Improvement Security
shall be determined by the City in application of California Government Code §§ 66499.3 and,
66499.4. All such Improvement Security provided to the City shall be released in accordance
with the provisions of California Government Code § 66499.7.
8.3 Dedication of Rights -of -Way for Public Improvements. Developer shall
dedicate such rights-of-way, easements, agreements, licenses, and other grants of rights over the
Property ("Dedications") to the City as are reasonably required to accomplish the survey,
design, construction, inspection, testing, operation, maintenance, and repair of the Public
Improvements and as the City is authorized to require under the Existing Development Regulations.
The Dedications, if any, to be required by the City for the Project is specified in Exhibit "C"
which is attached hereto and incorporated herein by reference. Developer agrees that the malting of
such Dedications are part of the consideration provided by Developer for this Agreement, that
Developer shall not seek, nor have a right to, any compensation from the City for such
Dedications, and that Developer shall not pursue any legal action for compensation, including
inverse condemnation or eminent domain, with regard to such Deaications.

Property ("Dedications") to the City as are reasonably required to accomplish the survey,
design, construction, inspection, testing, operation, maintenance, and repair of the Public

8A Public Art. Developer shall install public art, including but not limited to
sculptures, along the southwestern border of the Property. The public art installed by the Developer
shall be approved by the City. The total cost for the public art installed by the Developer shall be
approximately, but is not required to be in excess of; fifty thousand dollars ($50,000). The
project's public art shall be installed prior to the issuance of a Certificate of Occupancy for the
project's 60th dwelling unit' Developer agrees to work with the City's Public Arts Commission to
select the artwork that will be installed and the locations of the installations. The artwork and
locations selected by the Public Arts Commission will be submitted to the City Council for final
approval, consistent with Temple City Municipal Code Section 2632. The calculation of the total
cost of the public art piece shall include all costs of design, approval, acquisition and installation of
the public art piece, including, without limitation, all artist and consultant fees necessary to approve
the art, the lighting and mounting of the art on site, and the fabrication/installation of the art piece
itself.
