MILLER : 0 00 Ex-Officio Recorder �L , ORDINANCE Ner°956" "A"c's AN ORDINANCE OF THE CITY OF MCCALL, VALLEY COUNTY, IDAHO, REZONING CERTAIN REAL PROPERTY LOCATED AT 209, 211 AND 213 WASHINGTON STREET IN THE CITY FROM CC -COMMUNITY COMMERCIAL TO R16-HIGH DENSITY RESIDENTIAL; AMENDING THE CITY ZONING MAP ACCORDINGLY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of McCall, Valley County, Idaho is a municipal corporation duly organized and operating under the laws of the State of Idaho and is authorized under the provisions of 67-6511, Idaho Code, to establish within its jurisdiction one or more zone or zoning districts where appropriate; and WHEREAS, McCall City Code 3.13.05 provides for the methods by which amendments to the zoning map may be initiated; and WHEREAS, the City of McCall received an application for a zoning map amendment on December 27, 2017; and WHEREAS, the application for zoning map amendment was accompanied by a Planned Unit Development Application for a general development plan of the subject property (PUD-16- 01); and WHEREAS, the McCall Area Planning and Zoning Commission held a regularly scheduled and properly noticed public hearing to consider the zoning map amendment on February 7, 2017; and WHEREAS, at its February 7, 2017, meeting, the McCall Area Planning and Zoning Commission recommended the zoning map amendment for approval by the McCall City Council; and WHEREAS, the McCall City Council, pursuant to public notice as required by law, held a public hearing on March 9, 2017 to consider the proposed zoning map amendment request for the real property described in Section 2 below and made findings as required by law and determined that the requested zoning map amendment was consistent with the McCall Comprehensive Plan. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF MCCALL, IDAHO, AS FOLLOWS: Section 1: The Mayor and Council of the City of McCall, Idaho (the "City"), hereby find and declare that the rezone of that certain real property described in Section 2 does not require amendment to the McCall Comprehensive Plan. Page 1 of 3 Ordinance 956 Zoning Map Amendment March 9, 2017 Section 2: The real property described as follows is hereby rezoned from Community Commercial -CC to High Density Residential- R16: A parcel of land, a part of blocks 2 and 6, vacated Lakeport Addition, located in the SW1/4 of Section 9, T.1N., R.3.E., B.M., City of McCall, Valley County, Idaho, more particularly described as; BEGINNING at the westerly corner of Alpine Village Condominium Phase 1, as shown on the plat of said Condominium, filed in Book 12 at Page 17 of Plats, as Instrument number 329169, Records of Valley County, Idaho; thence along the boundary of said Condominium, S.45°01'24"E., 154.98 feet; thence, S.0°01'29"E., 58.01 feet; thence, N.89°58'31"E., 93.58 feet; thence, N.44°58'31"E., 64.00 feet; thence, departing the boundary of said Alpine Village Condominium Phase I, S.45°01'29"E., 55.67 feet; thence, S.0°00'00"W., 58.00 feet; thence, S.52°55'36"E., 37.56 feet; thence S.0°00'00"W., 101.15 feet to a point on the north Right -of - Way line for Washington Street; thence, along said Right -of -Way, N.89°56'03"W., 449.00 feet; thence, departing said Right - of -Way, N.0°34' 14"E., 222.25 feet to a point on the southwesterly Right -of -Way Line for Railroad Avenue; thence, along said Right - of -Way, Northeasterly along a non -tangent curve to the left having a radius of 2934.93 feet, an arc length of 176.62 feet, through a central angle of 3°26'53", and a chord bearing and distance of N.46°54'56"E., 176.59 feet to the POINT OF BEGINNING. Section 3: The zoning classification for the property described in Section 2 above is hereby established as High Density Residential-R16 as provided in the Zoning Ordinance of the City. The official zoning map of the City is hereby amended to include the real property described in Section 2 above in the High Density Residential-R16 zoning district. Section 4: This Ordinance, or a summary thereof in compliance with Section 50-901A, Idaho Code, shall be published once and shall take effect and be in force from and after its passage, approval, and publication.
