P/ease allow three business days to process the request. Minutes of Meeting Jefferson City Council Committee on Administration Wednesday August 2, 2017 City Hall - 320 E. McCarty Street Large Conference Room ATTENDEES: Committee members present: Erin Wiseman, Laura Ward, Mark Schreiber, David Kemna and Ron Fitzwater. Staff present: Gail Strope, Steve Crowell, Ryan Moehlman, Sonny Sanders, Eric Barron, Eric Seaman, David Grellner, Matt Schofield and Margie Mueller Others Present: Rick Mihalevich, Dirks Protzman and News Tribune: Nicole Roberts Meeting came to order at 7:30 a.m., the minutes were approved with a motion by Councilman Mark Schreiber and seconded by Councilwoman Laura Ward. The motion passed 5-0. Food Truck Discussion: Presented by David Grellner. David Grellner gave a brief history of food truck ordinances in Jefferson City. Food Trucks can serve in Parking Lots and Festival districts. They are licensed like any other kitchen establishment. The Fire Department inspects the trucks during festivals when there are numerus food trucks but not for individual carts (although they are subject to inspection.) There are currently eight mobile food truck vendors licensed in Jefferson City. Columbia has food truck zones. Temporary Lodging,Airbnb: Presented by Eric Barron. This is a zoning code issue. Currently short term rentals are not allowed in residential districts. Special exception permits could be allowed. Applicant would have to go to Planning and Zoning and then Council to obtain a permit. Eric reviewed possible ordinance options and items to consider. Planning and Protective Services sent letters to six citizens they found listing their properties. Currently subject to up to $1,000 fine for violating ordinances. Fire, Building and Inspection provisions added. Laura would like a motion to make the changes suggested and move to Planning and Zoning for their review. A motion was made by Councilman Mark Schreiber and seconded by Councilwoman Laura Ward. Retitle Positions within the Wastewater Division: Presented by Eric Seaman. With current vacancy would like to retitle positions. A motion was made to by Councilwoman Laura Ward and seconded by Daven Kemna. The motion passed 5-0 and will move to Council. Firefighter Testing: Presented by Matt Schofield. The current ordinance was established in 1994. The Fire Department would like to updated a small section of the entry level Firefighter position, no changes to promotional steps. Current ordinance says top 20 scores pass the written test. Would like to change to a passing score recommended by the testing company for that test. Allows us to know if they passed upon scoring and allows us to speed up the hiring process by allowing them to immediately go to the practice test rather than waiting days to schedule after all tests are complete. Dirks Protzman, President of Local 42 IAFF spoke in support of the recommended changes. A motion was made by Councilman Mark Schreiber and seconded by Councilwoman Laura Ward. The motion passed 5-0. Appointment Review: Presented by Gail Strope. The committee made six new appointments. A motion was made by Councilwoman Laura Ward and seconded by Councilman Ron Fitzwater. The motion passed 5- 0. The motion passed 5-0 ending the meeting at 8:26 a.m. Next meeting is scheduled for September 6, 2017 at 7:30 a.m. in the Boone/Bancroft room at City Hall. CONTRACT FOR ECONOMIC DEVELOPMENT SERVICES This Agreement, entered into this First day of November,2017,regardless of when actually executed by the parties, by and between the City of Jefferson, Missouri,a municipal corporation, acting by and through its Mayor, hereinafter referred to as "City" and the Jefferson City Area Chamber o f Commerce, a corporation formed and existing under The General Not for Profit Corporation Act of Missouri, hereinafter referred to as the "Chamber." WITNESSETH: WHEREAS, City desires to continue to promote the prosperity, economic betterment, general interest and welfare of the City of Jefferson according to its powers granted by law;and WHEREAS,the Jefferson City Area Chamber of Commerce was formed for the purpose of performing functions and services which include those required to give expression to the City's said desire; and WHEREAS, it is in the best interest of the City to utilize the services of the Chamber for the performance of said functions and services, for which reason the City desires to engage the Chamber and the Chamber desires to be engaged, for the performance of said functions and services, NOW, THEREFORE,the parties here to do mutually agree that: 1. Scope of Services. The Chamber shall perform functions and services including, but not limited to: a. General economic development services; and b. Business attraction and development programs; and c. Business retention and expansion; and d. Community development in the old town area; and e. Industrial land and asset management. 2. Accounting and Reporting_ The Chamber shall submit quarterly reports to the City and make itself available to meet with representatives of the City. 3. Metrics. The following metrics shall be utilized to assist in measuring the success of the service provided by the Chamber, and the Chamber's evaluation of its success shall be included in the annual report. a. For general economic development services: 1) Total dollars spent on Economic Development in including personnel costs and other costs associated with economic development. 2) Total hours spent be contract staff on ED projects and programs. 3) Sources and Uses of dollars used to fulfill contract. b. For Business attraction and development programs: 1) Number of business attraction projects worked and their status compared to previous years. 1 c. For business retention and expansion: 1) Number of Business Retention and Expansion projects worked including numbers of jobs and investment. 2) Number of State Training Grants awarded to existing or new businesses. 3) Total Dollars of State and Local incentives offered to existing or new businesses. d. For industrial land and asset management: 1) Dollars invested in Industrial Sites by contractor. The Chamber shall report annually on the above metrics. 4. Term.The services of the Chamber are to commence upon the execution of this contract, and expiring October 31, 2018. The Contract may be renewed for four (4) additional one (1)year terms. If the contract is not renewed by the parties prior to expiration it shall continue on a month to month basis until terminated or renewed. 5. Payment. The City agrees to pay the Chamber for services to be rendered hereunder the sum of One Hundred Eighty Thousand Dollars ($185,000.00),to be paid in four equal payments on or about January 1,April 1,July 1, and October 1. 6. Audit. The Chamber agrees to furnish the City, at the end of each contract period, a complete financial audit report prepared by a Certified Public Accountant. 7. Independent Contractor Status. The execution of the contract by the Mayor and the City of Jefferson and the approval thereof by the City Council of Jefferson City is not intended to and does not in any manner make the Chamber an agent, agency, or servant of the City of Jefferson,Missouri,it being expressly understood that the Chamber is in all respects an independent contractor, and the only y liability of City created by the terms of this contract is the obligation to pay Chamber for services rendered. 8. Books and Records. Chamber shall keep its books and records open for inspection at reasonable times by the City or by any persons or entities designated by the City to perform audits. 9. City Liaisons. The Chamber will provide in its by-laws for the appointment by the City of a City Liaison to Site Development Review Board and a City Liaison to the Transportation Committee. The City will appoint a council member to fill each liaison position. 10. Termination. This contract may be terminated by either party with just cause,provided that the terminating party shall give written notice to the other party at least sixty(60) days prior to termination of this contract. In the event of termination, all moneys due and owing shall be determined on a monthly prorate basis over the life of the contract until the effective date of termination. 11. Appropriations Clause. Parties agree that this contract is subject to annual appropriations by the City Council. In the event that the Council fails to appropriate the funds required by this contract in its annual budget, the agreement will be terminable by the City upon thirty days written notice. 2 12. Contacts. All contacts from the Chamber with the City shall be directed to the City Administrator's office unless otherwise directed and specified by the City Administrator. 13. Notices.All notices required to be in writing may be given by first class mail addressed if to the City then to City Administrator, City of Jefferson, 320 East McCarty,Jefferson City,Missouri, 65101, and if to the Chamber then to President,Jefferson City Area Chamber of Commerce at P.O. Box 776,213 Adams Street, Jefferson City,Missour65102. The date of delivery of any notice shall be the second full day after the day of its mailing. 14. Jurisdiction. This Agreement shall be governed, in all respects by the laws of the State of• Missouri. 15. Entire Agreement. The parties acknowledge that this Agreement constitutes the entire agreement between the parties and supersedes all prior agreements and understandings, both oral and written,between the parties. AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING THE CULTURAL ARTS COMMISSION MEMBERS SECTION TO CORRECT A TYPOGRAPHICAL ERROR. BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. Chapter 7 (Boards and Commissions) Section 603 (Members [Cultural Arts Commission]) is amended as follows: Sec.7-603.Members. A. Appointment. The cultural arts commission shall be appointed by the Mayor with the consent of the majority of the Council. B. Composition.The commission shall consist of eleven(11)voting members.Every effort should be made to include members with education or experience from various areas of the Arts, business community, education facilities, religious community, and historical backgrounds. Of the eleven(11)members=of the Parks and Recreation Commission shall appoint one staff or commission member to serve as a voting member. C. Conflict of Interest. No member of the commission whether or not a voting member shall participate in the discussion or vote on any issue regarding a contract or agreement for funding or recommendation thereof, if such member is(a) an owner or employee of the entity which is the recipient of a funding source or contract; or (b) is on the governing board or a volunteer of an entity which is the recipient of a funding source or contract; or (c) has a member of his or her immediate family who is described in a)or b) above; or(d)is the direct recipient of a funding source or contract. D. Residency. At least eight (8) members shall be residents of the City of Jefferson; a maximum of three(3)members may reside outside the City. (Ord.No. 15156, §1,9-3-2013) E. Terms. Members shall be appointed for three(3)year staggered terms. F. Vacancies and successors. Any vacancies shall be filled by appointment and approval in like manner for the unexpired portion of the term. All members shall continue to serve until their successors have been appointed and qualified. G. Non-voting Ex-officio members. The Mayor, with the advice and consent of a majority of the council, may appoint City officials, County officials, and State officials as non-voting ex- officio members. H. Staff. The Director of Parks, Recreation and Forestry shall provide staff support to the commission, and shall receive the cooperation of city officials and city staff, to the extent reasonably possible,in providing assistance for the furtherance of its duties. I. Quorum.A quorum shall be six(6)voting members. Section 2. This Ordinance shall be in full force and effect from and after the date of its passage and approval. Passed: Approved: Presiding Officer Carrie Tergin, Mayor ATTEST: APPROVED AS TO FORM: City Clerk City Counselor Draft : Parks Commission member appointment as voting member BILL SUMMARY BILL NO: 17- SPONSOR: SUBJECT: Amending the Cultural Arts Commission Members Section to correct a typographical error. DATE INTRODUCED: Summary: This ordinance amends Cultural Arts Commission composition to clarify that of the eleven (11) members, the Parks and Recreation Commission shall appoint one staff or commission member to serve as a voting member. Background Information: City of Jefferson Parks, Recreation and Forestry assigns commission members to each committee as well as Cultural Arts Commission. The department inherited Cultural Arts Commission in 2016 and Environmental Quality Commission in 2017. In Article II Sec. 7-12 of City Code, "...the Parks and Recreation commission shall appoint one staff or commission member to serve as a voting member (on Environmental Quality Commission)." In an effort of consistency, staff desires that Article XVI Sec. 7-603.F reads that "one of the eleven (11) voting members of Cultural Arts Commission be a staff or commission member." Current code is grammatically incorrect and allows for misinterpretation. Fiscal Information: None.
