HomeMy Public PortalAbout1958-01-25 Meetingh., 6 JANUARY 25, 1958 The Council of Bal Harbour Village met at 8:00 o'clock Saturday January 25, 1958 at the Village Hall. There were present: Messrs. Broeman, Brown and Hart. Absent: Messrs Beatty and Graham Also present were W. H. Webb, Village Manager, and Mary Wetterer, Village Clerk. The minutes of the previous meeting of December 28, 1957 were accepted as submitted on motion of Mr. Broeman, seconded by Mr. Hart. Mayor Brown said that inasmuch as Mr. Broeman had to catch an early plane, the meeting time had been changed in order to transact some of the business before the Council. The Mayor said he had a letter from Mr. David B. Graham asking that the Council accept his resignation due to his business transfer— ring him to the North. It was moved by Mr. Broeman, seconded by Mr. Hart, that Councilman Graham's resignation be accepted with re— gret and that a suitable Resolution be drawn by the Village Attorney and presented to Mr. Graham for his service on the Council. It was then moved by Mr. Hart, seconded by Mr. Broeman, and unani— mously voted that Mr. Fred Faulkner, Jr, be appointed to fill the un— expired term of Mr. Graham to April 1959. Mr. Faulkner was then duly sworn as Councilman for Bal Harbour Village by the Village Clerk. Mr. Webb said he had a letter from the Dade County League of Municipalities asking for funds to publicize the Metro Amendment. Thereupon the Council agreed to send a letter to all the residents for the solicitation of funds for this purpose. It was then moved by Mr. Broeman, seconded by Mr. Faulkner that the meeting be recessed until 11:00 A.M., Thursday, January 30, 1958. The recessed meeting of January 25, 1958 of the Council of Bal Harbour Village was recalled to order at 11:00 o'clock Thursday, Janu— ary 30, 1958 at the Village Hall. There were present: Messrs. Brown, Broeman, Faulkner and Hart. Absent: Mr. Beatty. Also present were W. H. Webb, Village Manager, Mary Wetterer, Village Clerk, and Thomas H. Anderson, Village Attorney. IANUARY 254_195Q 237 Mr. Webb read a letter from the County Commission regarding Bakers Haulover and Mr. Anderson informed the Council that he and Mr. Webb would appear before the Commission in an endeavor to have them reactivate the old Bakers Haulover District which would take care of the sea wall problem. Mr. Mort Feldman, representing the owners of the Carlton Terrace Apartments, was introduced. He requested some help regarding beach erosion. Question of whether adjoining property owners on the ocean front can be compelled to take steps to control erosion. Mr. Anderson suggested creating the Erosion Prevention District, in accordance with our new Charter Amendment. Mr. Webb was instructed to write to prop— erty owners involved telling them of conditions and a proposal to correct the situation, saying it is going to involve the village in some expense, and ask the people if they will cooperate voluntarily. The letter is to be followed up by phone calls to those involved. The Mayor appointed Mr. Faulkner to attend conferences with Mr. Webb, when one is set up with the various property owners involved. An ordinance amending Ordinance No. 11 of Bal Harbour Village, restricting building heights on the ocean front, was read by the Clerk and on motion of Mr. Hart, seconded by Mr. Faulkner, Ordinance No. 60, entitled "An Ordinance Amending Ordinance No. 11 of Bat Harbour Village, Florida" was unanimously passed. Mr. Webb read a letter inviting the Mayor and Councilmen and Village Manager to the Founders Day program at Miami Beach High School on February llth. Mr. Broeman was appointed to attend, if possible. Subject of the Voting Districts and Tax Districts was again discussed and when referred to Mr. Anderson for his comments, he said that if Mr. Webb would draw appropriate maps breaking the Village into certain districts, he would be able to prepare proper ordinances to put them into effect. Whereupon, Mayor Brown appointed Mr. Hart and Mr. Faulkner to work with Mr. Webb in preparing said maps. Officer Tom Joyce of the State Highway Patrol presented the Mayor with a Certificate of Honor to the Village of Bal Harbour, for a record of no traffic fatalities during the past year. Mayor Brown made the statement that there had never been any traffic fatalities in Bal Harbour, since the inception of the Village. Mr. Webb announced that a copy of the Annual Audit for Fiscal Year ending September 30, 1957 had been distributed to each Council— man and the Mayor. After consideration, Mr. Faulkner made a motion that the audit be accepted — seconded by Mr. Hart. The motion was passed unanimously. Applications for licenses were presented by the Clerk for Auto— ville, Inc. for 5 U—Drive—It cars at the Seaview Hotel, and Morse Motors for 5 U—Drive—It cars at the Bal Harbour Hotel. These two items were discussed and motion was made by Mr. Broeman that these applications be granted. Mr. Hart seconded the motion and it was passed unanimously. AANUAR 25s_1958 238 Ordinance No. 61 — "Firemen's Relief Fund (1939 Acts for Return— ing 1% of Insurance Premiums)", and Ordinance No. 62 — "Policemen's Relief Fund," as prepared, were given to Mr. Anderson for his recom— mendations at our next meeting. Mr. Webb read a resolution sent out by Coral Gables regarding the Metro Amendment. It was decided that Bal Harbour Village send a similar resolution to each of the taxpayers in Bal Harbour. Motion was made by Mr. Hart, seconded by Mr. Broeman and passed unanimously. Mr. Webb read a request for decorations on Collins Avenue in Bal Harbour for Governor's Conference to be held at the Americana Hotel in May 1958, the 18th to 22nd. Mr. Brown asked that Mr. Webb find out cost for such decorating and report at next meeting. He appointed a committee of Mr. Webb and Mr. Broeman. Mr. Webb read a letter from Judge Tom Lummus, requesting that his salary be raised from $50.00 per month to $100.00 per month, due to the heavy case load in our Municipal Court. Mr. Hart made a motion that this raise be put into effect for the balance of this fiscal year, motion seconded by Mr. Faulkner, and unanimously passed. Mr. Broeman made a motion that the meeting be adjourned. Mr. Hart seconded this motion and the meeting was adjourned. There were presents Messrs Broeman, Brown, Hart, Beatty and Faulkner. Also present were W. H. Webb, Village Manager, Mary Wetterer, Village Clerk and Thomas H. Anderson, Village Attorney. The minutes of the previous meeting of January 25, 1958 were accepted as submitted on motion of Mr. Hart and seconded by Mr. Faulkner. Resolution No. 55 commending David B. Graham for his services as Councilman was read by the Village Clerk and unanimously passed on motion of Mr. Beatty and seconded by Mr. Hart. FEBRUAR1L22i 1958
