RESOLUTION GRANTING CONDITIONAL USE
PERMIT TO LARRY THOMAS, D/B/A
THE BIG WOODS SALOON
WHEREAS, Larry Thomas, d/b/a The Big Woods Saloon (Applicant) has applied
for permission to operate a bar at 4445 T.H. 55; and
WHEREAS, the Medina Code of Ordinances permits such use only with a
conditional use permit; and
WHEREAS, a conditional use permit has previously been granted to the
Applicant for a volleyball area to be used in connection with the bar; and
WHEREAS, the proposal was reviewed by the Planning Commission on
August 9, 1988, and by City Council on September 6, 1988, for compliance with
ordinance standards; and
WHEREAS, it has been determined that the operation of a bar at the above
address will not adversely affect the development and use of adjacent proper-
ties; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina,
Minnesota that a conditional use permit is hereby granted to the Applicant for
the stated purpose, subject to the following conditions:
1. There shall be no exterior storage on the site;
2. The exterior building materials of the structure shall be in compliance
with city code;
3. All signs on the property shall be in compliance with city codes;
4. The trash receptacle shall be screened from view from adjacent properties
and roadways to the satisfaction of city staff;
5. The roof top screen equipment shall be removed;
6. The Applicant shall install landscaping in compliance with city ordin-
ances, with one-half of the landscaping to be located outside of the
fenced area. Areas of the site which are not blacktopped shall be
seeded. All landscaping shall be maintained and replaced if dead or
diseased;
7. The Applicant shall install blacktopping according to code requirements
within one year of the date of the adoption of this resolution;
8. The Applicant shall construct the loading area to the satisfaction of the
staff within one year of the date of adoption of this resolution;
9. Hard surface coverage shall be in compliance with ordinance requirements;
10. The hours of operation of the bar shall be in accordance with statutory
limitations;
11. The Applicant shall repair the wires to the septic system to the satis-
faction of the building inspector and shall maintain the system in good
working order;
12. There shall be no exterior loudspeakers on the property nor shall any
music or other sound be broadcast outdoors;
13. The Applicant shall comply with all items noted in the letter from the
city engineer dated August 5, 1988, which letter is attached hereto and
adopted by reference;
14. Exterior lighting shall be designed and installed so as not to shine
directly onto adjacent properties or streets;
15. The number of persons who may occupy the bar at any time shall not exceed
the number permitted by the fire code;
16. The area used for volleyball shall be no larger than 9,312 square feet
and shall be surrounded by an opaque fence with permanent footings;
17. The hours the volleyball area may be used shall be limited to 2:00 p.m.
to 11:00 p.m. daily, so long as current surrounding land uses exist. The
Applicant acknowledges that if the use of surrounding properties change,
the city may review and modify this condition;
18. There shall be a minimum of three employees on the site at all times;
19. The sole entrance to the volleyball area shall be through the main
building and there shall be two exterior gates in the volleyball area
fence which shall be exits only;
20. The main building shall meet all requirements of the Medina fire code;
21. There shall be no living quarters in the main building; and
22. The Applicant shall pay to the City a fee in the amount determined by the
staff to represent the cost to the city of reviewing this conditional use
permit applicant.

23. This conditional use permit shall supersede the conditional use permit
previously granted to the Applicant through resolution number 86-
BE IT FURTHER RESOLVED by the City Council of the City of Medina,
Minnesota that a variance of 7 feet be granted for the setback on the east
side of the building for a loading area on the grounds that the location of
the existing building constitutes a hardship.
