HomeMy Public PortalAbout1988-098CITY OF MEDINA 4 0 ' RESOLUTION NO.0 RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO DAVID KEARIN WHEREAS, David Kearin (Applicant) has applied for a conditional use permit for a heating and air conditioning installation business at 1242 Townline Road; and WHEREAS, the city's zoning ordinance requires a conditional use permit under such circumstances; and WHEREAS, this matter has been reviewed by the planning commission on October 11 and November 9, 1988, and by the City Council on December 6, 1988; and WHEREAS, it has been determined that the existence of the Applicant's business will not impede the orderly development of adjacent properties. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that a conditional use permit be granted to the Applicant for the stated purpose, subject to the following terms and conditions: 1. The 18-wheel trailer now on the site and used for storage shall be removed within one year of the adoption of this resolution and the new exterior storage area to be located to the east of the business building shall not extend farther out than 15 feet from the building; 2. The three accessory structures on the property (not including the business) shall be removed within 90 days of completion of the new garage, or six months from the issuance of the building permit whichever occurs first and the new building shall not exceed 2,000 square feet; 3. The two above -ground red gas tanks shall be removed from the site within 90 days of the adoption of this resolution; 4. Because of the transitional nature of the property, the exterior of the existing business building may remain as is at the present time if maintained in good repair; 5. There shall be no business signs on the property; 6. The parking and driveway gravel surface may remain as is at the present time; 7. No additional screening shall be required on the site; 8. There shall be no exterior storage of trash containers on site; 9. The current landscaping, parking, loading areas and hard surface coverage are adequate to meet city code requirements at the present time; 10. Hours of operation shall be limited to 7:00 a.m. to 10:00 p.m., Monday through Saturday; 11. There shall be no more than one employee on the site in addition to the Applicant; 12. Exterior lighting shall be designed and installed so as not to cast light on adjacent properties and roadways and shall be approved by the city staff; 13. The Applicant shall dedicate to the city the right-of-way for Townline Road required by city staff; 14. The city staff shall clarify the status of the adjourning land locked parcel; 15. The Applicant shall combine the parcels for tax purposes as soon as the outstanding mortgages are satisfied; 16. The city shall review the status of the parking and driveway areas and of the metal building three years from the adoption of this resolution and reserve the right to require that the Applicant comply fully with city requirements regarding such matters if deemed in the public interest; and 17. The Applicant shall pay to the city a fee in the amount determined by the staff to represent the actual cost to the city of reviewing this conditional use permit application.
