BOARD OF HEALTH MEETING
TUESDAY, APRIL 6, 2010 AT 7:OOPM

Present: Dan Brightman, Vice Chairman, James Reynolds, Keith Johnson, Nancy Ellis Ice, Health Director
and Tammi Mason, Senior Dept. Assistant.
Tom McLellan-variance request for 100 Buggy Whip Road
This system is in failure. It is and will remain a 3 bedroom home. The homeowners are requesting a variance
to be only 147 feet away from the pond.
Motion: JR-approve variance request. KJ seconded. 3 yes.
2. J.C. Ellis-variance request for 880 Satucket Road
Merton Bernstein, homeowner explained to the Board that he is looking to finish part of his basement but his
septic system is not large enough. He would like to enlarge his tank to a 1500 gallon one and add a chamber
to the leaching area. The system would be within 300' of a pond and they would need a variance to allow
that.
Motion: JR-approve variance request. KJ seconded. 3 yes.
Luke's of Brewster-tobacco violation
Arthur Luke apologized to the Board and explained that they do a lot of training and that the individual that
sold the pack of cigarettes has been dismissed.
The Board issued a warning and stated that there must be no violations for a least a year or a fine will be
issued.
4. Winslow Spirits-tobacco violation
The Board issued a warning and stated that there must be no violations for a least a year or a fine will be
issued.
5. Discuss septic issue at 98 Ebenezer Road
The Board asked that someone go by to see if anyone was still living there.
6. Dan Brightman-food permit application
There was not a quorum available for this hearing. Continued until April 20, 2010 meeting.
7. Mike Antinerelli-discuss Sand & Gravel permit
MA stated that he is still in the process of cleaning out but wants to end that part of his business. David
Bennett will be at the site tomorrow to do a well test. The Board agreed that if MA is not hauling sand out
then he doesn't need a permit.

8. Discuss fee for beach permit
NI recommended not having a fee and having the County do the permitting. The Board agreed to make our
own signs and to not have a fee.
