Board of Health Meeting

Present: Dan Brightman, Chairman, Keith Johnson, Vice Chairman, Joanne Hughes, James Reynolds, Lem
Skidmore, Nancy Ellis Ice, Health Director and Tammi Mason, Senior Department Assistant.
Hollister Siegmund-discuss non-compliance with DEP Regulations for 160 Old Red Top Road
Mr. Siegmund was unable to attend the meeting and sent Winston Steadman as the representative. This is
before the Board because the operator is not doing the required testing and inspections for this alternative
system. The operator thought they had received reduction in testing approval from DEP; however there is no
evidence of that. Sue Rask, County Carmody program administrator was present to go over the properties
testing records. She stated that DEP did not grant a reduction in testing and she gave some statistics with
regards to the history of the property. NI did tell the Board that an email from Mr. Siegmund stated that he
did not have a current contract with the homeowner. The homeowner did tell that Board that he signed a
contract that was good until September of 2010.
Motion: JH-send a letter to Hollister Siegmund stating that the required sampling and inspection must
be done within one month (with results submitted to Carmody and BOH) or fines will be
assessed. KJ seconded. 4 yes.
2. Desmond Well Drilling-well variance request for 73 Hamilton Cartway
Tom Desmond explained to the Board that he had replaced a screen on the well at this property last month.
The homeowners were without water so it was considered an emergency. He did fill out an application which
was not approved by the Health Director due to the well only being 66 feet from the existing cesspool. NI did
tell that Board that the septic system needed upgrading.
Motion: JH-postpone the approval for variance and order an upgrade of the septic system. LS
seconded. 4 yes.
3. Joseph Mashnick-1425 Main Street-failure to replace oil tank
NI let the Board know that this tank was being replaced on 8/17/2010.
4. Residential Funding-148 Old Chatham Road-failure to replace oil tank
NI let the Board know that this tank will be replaced.
5. Francis & Jean Leidenfrost-111 South Orleans Road-failure to replace oil tank
The Board agreed that the Leidenfrost's could have until the end of September to replace the tank.

6. Frederick & Vicki Daniels-67 Swamp Road-failure to replace oil tank
NI let the Board know that the tank will be replaced on August 5, 2010.
7. Discuss Paul Daniels site assignment on Freeman's Way
Mr. Daniels told the Board that he signed an ACO agreement with DEP regarding this site almost 5 months
ago. DEP is saying that they do not have a signed agreement. There was discussion on what was going on at
the site.
Motion: JH-give Mr. Daniels one month to get a copy of the ACO to the Board or suspension
proceedings will be started. ]R Seconded. 4 yes.
8. Peter & Esther Own-130 Bayview Drive-oil storage tank variance request
The tank is just under 10 years of age and would need to be replaced within a month if a variance was
granted.
Motion: JH-deny the variance. LS seconded. 4 yes.
9. Approval of July 6, 2010 minutes
Motion: JH-approve minutes as written. KJ seconded. 4 yes.
10. Approval of July 20, 2010 minutes
Motion: JH-approve minutes as written. w seconded. 4 yes.
