HomeMy Public PortalAboutResolutions-2013-124RESOLUTION NO. 2013-124 A RESOLUTION SETTING A DATE FOR PUBLIC HEARING FOR REZONING OF HICKORY KNOLL PARCEL FROM PUBLIC TO R -1E AND THEN TO' PLANNED AREA DEVELOPMENT WITH UNDERLYING R -1E ZONING Whereas, The City has,received a request to rezone portions of the Hickory Knoll and; Whereas the City Council of the.City of Tiffin recognizes; per the attached legal description (Exhibit "A"), that the rezoning is necessary to build the desired development posed; Now, therefore be it resolved by the City Council of the City of Tiffin, Iowa to set the public hearing date for July 10, 2013 for the rezoning of,the Hickory Knoll property. On the 26th day of June, 2013, at a regular meeting of the Tiffin City Council, Tiffin, Iowa, Councilperson Ryan introduced Resolution No. 2013-124, A RESOLUTION SETTING A DATE IL FOR PUBLIC HEARING FOR REZONING OF HICKORY KNOLL PARCEL FROM PUBLIC,TO R -1E AND THEN TO PLANNED AREA DEVELOPMENT WITH UNDERLYING R -1E ZONING and made a motion for approval. Motion seconded by Councilperson Kahler. Ayes: Kahler, Ryan, Bartels, Upton Nays: Phillips Absent: None Whereupon Four Council members were present and voted approval and Mayor Berner declared. that the Resolution No. 2013-124, A RESOLUTION SETTING A DATE FOR PUBLIC HEARING FOR REZONING OF HICKORY KNOLL FOR PARCEL FROM PUBLIC TO R -1E AND THEN TO PLANNED AREA DEVELOPMENT WITH UNDERLYING RAE ZONING to be adopted and signified his approval of the same by affixing his signature thereto. f Passed by the City Council on'the 26th day of June, 2013. Ockson, City Administrator/Clerk U I EXHIBIT "A" HICKORY KNOLL All that part of the Southeast Quarter of the Southwest Quarter of Section Twenty -Seven (27) lying South of the right of way of the Chicago, Rock Island and Pacific RailroadCompany; also the Northeast Quarter of the Northwest Quarter of Section .Thirty -Four (34) except the south 24 rods thereof; all in Township Eighty (80) North, Range Seven (7) West of the 5th P.M., subject to the following provision. The Grantee agrees to convey back to the Grantors by Quit Claim Deed two acres more or less of the above 6s described tract lying northerly of the thread of Clear Creek provided the Grantors at their expense provide a legal description for said two -acre tract based on a survey of record, and comply with any applicable platting and zoning procedures on or before January 1, 1985. The Grantees agrees to sign such documents and to perform such acts as may be reasonably requested to assist Grantors in obtaining such description and compliance.
