AN
ORDER ACCEPTING THE PROVISIONS OF G.L. c.40, §22F ALLOWING CITY
BOARDS OR OFFICERS TO FIX REASONABLE FEES
WHEREAS, the City regularly issues licenses, permits, and certificates pursuant to the
General Laws and the City Code; and
WHEREAS, the City assesses fees for such actions; and
WHEREAS, such fees must be reasonable and proportional; and
WHEREAS, the City wishes to establish a mechanism for the proper establishment of
fees and charges; and
WHEREAS, the provisions of G.L. c.40, §22F allow "[a]ny municipal board or officer
empowered to issue a license, pet mit, certificate, or to render a service or perfol m work"
to set fees for such actions; and
WHEREAS, the provisions of G.L. c.40, §22F require that any such fees set by a board or
officer appointed by an elected board must be reviewed and approved by such elected
board; and
WHEREAS, the provisions of G.L. c.40, §22F provide that the City's current fees "will be
utilized until a new fee or charge is fixed" as provided thereunder; and
WHEREAS, the provisions of G.L. c.40, §22F are subject to local acceptance by vote of
the City Council.
NOW THEREFORE BE IT ORDERED: That the provisions of G.L. c.40, §22F are hereby
accepted, providing for a process for City boards and officers to set fees as provided
therein.
