Ryder &Wilcox-variance request for 514 Run Hill Road-less than 300' from pond Judy Bersin was present. This is an existing septic system for a house that is being built. It is less than 300'to the pond. Motion: JR-grant variance request. KJ seconded. 5 yes. 2. J.M. O'Reilly-variance request for 100 Seaway Road John O'Reilly was present. The following variances are requested: _ _ -c/~? T 1. 4'variance from SAS to property line 2. 5.5' variance from septic tank to property line 3. 4' variance from septic tank to cellar wall JO stated that these variances were previously granted in 1999 and that the system is already there. The owner is proposing to tear down the existing home and rebuild on the same footprint. Motion: ]R-grant variance requests. KJ seconded. 5 yes. 3. ).M. O'Reilly-proposed shared septic system-White Rock Commons John O'Reilly was present. This is going to be a 12 home subdivision. There will be pressure dozing a large leach area and 3 sewer manholes. The system would be using a Septitech treatment process and will be kept to the 19ppm discharge. JH questioned JO about the 0&M contract that would have to go with this. Motion: JH-approve the plan. KJ seconded. 5 yes. 4. VNA-approval of contract Nancy Ice spoke to the Board about the two bid proposals that were received for nursing services. One was from the VNA and one was from Continental Nursing. Motion: JH-accept the VNA proposal and award them the contract. JR seconded. 5 yes. 5. Laura Gill-20 Turning Mill Road-requesting that the Board approve the septic system for 4 bedrooms Marie Hartley was present to represent Laura Gill. The septic system was installed in 2004. On the septic permit application is states 330 GPD. The design plan is for 440 GPD and is what was installed. Motion: JR-amend the permit to say 440GPD. KJ seconded. 5 yes. 6. Charles Safran-95 Middlecott Lane-appeal of Health Director's room count decision Mr. Safran explained to the Board that he has an existing loft in his condo and wants to put up a privacy wall. Nancy Ice, Health Director did a room count and stated that adding this wall would constitute another room which would put it over the allotted rooms for the septic system. Poremba-requesting an extension of variances granted at 250 Sheep Pond Drive The existing variances expired on November 3, 2010. The owner is requesting that he get an extension. Motion: JR-grant a six month extension to owner. KJ seconded. 5 yes. 8. Theresa LaBreque-131 Frank D. Lawrence Road-requesting a 3000 SF exemption to have her home be a 3 BR This property is in a restricted zone and is close to 27,OOOSF, which restricts it to a 2 bedroom home. Ms. LaBreque is asking that she be allowed a 3000 sf exemption so that she may sell this as a 3 bedroom home. Nancy Ice, Health Director did a room count and even if they went by today's bedroom definition she would already be over the allowed number of rooms. The Board was not willing to grant an exemption or make any changes to the permit. 9. Minutes from 10/5/10 meeting Motion: JH-accept minutes as written. JR seconded. 5 yes. 10. Planning Board application for Commerce Park Road Motion: JH-Board of Health supports the erection of two wind turbines at Commerce Park. KJ seconded. 5 yes. Bills to be paid:JH-pay bills. Monthly report for Ocean Edge Add on's NI asked the Board to lift the condemnation order for 3844 Main Street. Motion: JR-remove condemnation order. KJ seconded. 5 yes. NI asked the Board to appoint Colette Williams, Town Clerk as a Burial Agent. Motion: JR-appoint Colette Williams as a Burial Agent. K] seconded. 5 yes.
