A SPECIAL ORDINANCE VACATING A PUBLIC PLACE
WHEREAS, Wayne County, Indiana has petitioned Common Council of Richmond, Indiana, requesting the vacation of a public places adjoining; and
WHEREAS, petitioner is the only adjoining property owner, and
WHEREAS, the public place proposed to be vacated is needed by the petitioner for construction of a new jail; and
WHEREAS, said Council, pursuant to Indiana Code 36-7-3-12, conducted a public hearing on said petition March 28, 2002, after publishing legal notice thereof at least ten (10) days in
advance of said hearing as required by statute; and
WHEREAS, the Richmond Advisory Plan Commission, pursuant to Richmond Code 155.04(b), conducted a public hearing on said petition March 28, 2002 after publishing legal notice thereof
at least ten (10) days in advance of said hearing as required by ordinance; and
WHEREAS, it is desirable to vacate said public places.
NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that the portion of public places described below is hereby vacated and Wayne County, Indiana shall
acquire ownership of such land heretofore dedicated as a public place as indicated below, to wit:

Passed and adopted this 15th day of April, 2002, by the Common Council of the City of Richmond, Indiana.
