CONSTRUCTION EASEMENT
THIS INDENTURE, made and entered into this day of
May, 1987, between Lake Reservoir Company, an Idaho corporation,
Gary R. Hawkins and R. Gail Hawkins, husband and wife, Jeffrey
James Clemmer, a single man, Robert V. Williamson and Janet
Williamson, husband and wife, Melvin D. Wilson and Wanda Faye
Wilson, husband and wife, Wm. Peutz and River's Bend Condominium
Association, Inc., an Idaho corporation, herein called Grantors
and the City of McCall, a Municipal Corporation of the State of
Idaho, P. 0. Box 1065, McCall, Idaho 83638, herein called Grantee,
W I T N E S S E T H:
WHEREAS, Boise Payette Lumber Company, a Delaware Corpor-
ation, the predecessor in interest of the Grantors herein,
made, executed and delivered to the Grantee an easement dated
August 18, 1937, and recorded September 2, 1937, in the office
of the Recorder of Valley County, Idaho, as Instrument No. 22852
in Book 5 of Miscellaneous Records, at page 423, wherein Boise
Payette Lumber Company granted and conveyed to Grantee a 10 foot
wide permanent easement and right of way .for the purpose of
constructing and maintaining a main sewer pipe line in and across
the lands and premises situated in McCall, Idaho, more particu-
larly described in said easement, which said easement is by this
reference incorporated herein and made a part hereof as if fully
set forth at length herein;
WHEREAS, said main sewer line was constructed by the Grantee
and said main sewer line now requires replacement and recon-
struction pursuant to the plans and specifications therefor
prepared by Toothman-Orton Engineering Company, for the City
of McCall;
WHEREAS, the Grantee now requires a thirty .f_oCt (30')
wide easement for the reconstruction and replacement of said
main sewer line, being an additional 10 feet on each side of
the existing easement.
NOW, THEREFORE, in consideration of the sum of One Dollar
($1.00) in hand paid.to each of said Grantors, the said Grantors
do hereby give, grant and convey to the Grantee a temporary
construction easement for the purpose of reconstruction and
replacement of said main sewer pipe line, in, over and across
a tract of land in the City of McCall, Idaho, described as follows:
A strip of land thirty feet (30') wide, being fif-
teen feet (15') on each side of the centerline of
said main sewer pipe line as the same is now situ-
ated across Lot Four (4), Section Eight (8), Town-
ship Eighteen (18) North of Range Three (3) East,
B.M., for a distance of approximately sixteen hun-
dred feet (1600') South from the main highway (State
Highway No. 55) along the meander line of the North
Fork of the Payette River in McCall, Valley County,
Idaho.
PROVIDED, HOWEVER, that upon completion of reconstruction
and replacement of said main sewer line, written notification of
such completion shall be given by Grantee and recorded in the
office of the Recorder of Valley County, Idaho, after which
such recordation, the easement hereby given and granted shall
revert to the original ten foot (10') wide permanent easement
for the repair, operation and maintenance of said main sewer line,
being five feet (5') on each side of the centerline of said main
sewer pipe line as constructed and installed.
Grantors further grant and confirm to the Grantee the
permanent right and privilege of ingress and egress to and from
said above described premises for the purposes above described.
Grantee agrees to replace and restore said premises to the
condition thereof as may be reasonably done after completion
of the reconstruction and replacement of said main sewer line,
doing as little damage as possible.
IN WITNESS WHEREOF, the Grantors have hereunto subscribed
their names the day and year first above written.
