Brewster Town Office Building Chairman Taylor convened the Planning Board meeting at 6:30 pm in the Brewster Town Office Building with members McMullen, Barnard, Collum and Leaning. Absent: Kuzman, Bugle Also Present: Sue Leven ANR 2010-17: Applicant: Sea Pines Condominium III -Property is located off Dune Road and shown on Assessors Map 6; Parcel 106-2. The purpose of this plan is to carry out a judgment of the court by dividing off a portion of the lot to convey to the adjacent parcel. Present: Peter Farber Farber: provided an overview of the application. This plan brings an end to an 11 year legal dispute between Sea Pines and Mr. Corcoran. Farber presented a court document highlighting the resolution. Leaning: Had a few questions on the plan. Farber addressed his questions. Taylor: Any further questions from the Board Barnard: What was the settlement? Farber: They got their lawn. Leven: Noted that she had requested a plan that showed the entire lot. However, Mr. Farber explained that the judgment was made this way and therefore the ANR had to be endorsed as presented. Taylor: Any public comments? None Planning Board Meeting Page 1 of 5 08-11-10 Leven: That is what we are trying to do with this modification. They should be able to address all concerns in the DPRC. McMullen: Is he correct that this is going to take away DPRC and this PRC will replace. Leaning: Yes, cutting the verbiage down to 3 pages and making it easier for the applicant. Leven: COPD is also being modified and will be a site plan review only Barnard: All department heads are on this committee... is there ever a conflict of interest. Leven: This PRC does not give a person a permit. The current DPRC just signs off. Barnard: The PRC does not give that committee the authority to have an applicant not go to Planning Board or to a regulatory board? Leven: No, if the bylaw says you need to go to a certain board then the applicant will still need to go there. McMullen: The building commissioner leans more to sending the applicant to the boards Taylor: Questioned the abutter notice, in other Towns there is a waiver and they just place an advertisement so someone can attend the meeting. Leven: A final document for the applicant will be provided that details what they need to do. Collum: This is a tool for the applicant - it is not binding -The applicant will know what is needed and the process. Thinks this is a great concept. McMullen: Would like to see the agricultural article to see what it really says. That is what the COPD was set up for. Leven: The COPD will also be cleared up because it says it is for the whole town -the site plan review will take care of this. Barnard: Screening and planting can be controlled. Leven: From a common sense standpoint if you are running a garden center then they would be inclined to show the planting. Collum: Let's ask counsel what we can do about the agricultural exemption. Leven: The agricultural exemption falls under Chapter 40A, Section 3. She felt that before they run up our legal bill she suggested that she has another person she contact who is an expert on agricultural and see what the Town can do. Taylor: Leven will make the changes to the articles and bring it back to the Board. Planning Board Meeting Page 3 of 5 08-11-10 Leven: Please read through the documents again and provide comments back to her. She will work on making the changes and get that back to the Board -needs to look through the bylaw and see other references to the DPRC (wind turbine section). 3. Local Comprehensive Plan Outline: Leven: presented a document that highlighted the status of the Local Comprehensive Plan. Leven requested the board to review and see if anything was missing -provide comments back. Leaning: left at 8pm 4. Parking at the Fish House -parking in town driveway -Taylor requested a letter to be sent or addressed with the Building Commissioner. Leven agreed. 5. Ladder signs: any follow-up: Leven has a list of businesses by address for Terry. Leven will provide the list to Terry for her to contact them to see if anyone would like to be included on the sign.
