A SPECIAL ORDINANCE VACATING A PUBLIC WAY
WHEREAS, The Richmond Baking Company has petitioned Common Council of Richmond, Indiana, requesting the vacation of a North 6th Street from Bridge Avenue to the north right-of-way line
of the Norfolk & Western Railroad; and
WHEREAS, the petitioner is the only adjoining property owner, and
WHEREAS, the roadway proposed to be vacated is needed by the Richmond Baking Company for construction of a new facility; and
WHEREAS, said Council, pursuant to Indiana Code 36-7-3-12, conducted a public hearing on said petition March 28, 2002, after publishing legal notice thereof at least ten (10) days in
advance of said hearing as required by statute; and
WHEREAS, the Richmond Advisory Plan Commission, pursuant to Richmond Code 155.04(b), conducted a public hearing on said petition March 28, 2002 after publishing legal notice thereof
at least ten (10) days in advance of said hearing as required by ordinance; and
WHEREAS, it is desirable to vacate said public way.
NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that, subject to the removal of existing utilities, the portion of public way described below is
hereby vacated and the Richmond Baking company shall acquire ownership of such land heretofore dedicated as a public place as indicated below, to wit:

Passed and adopted this 15th day of April, 2002, by the Common Council of the City of Richmond, Indiana.
