AWARD OF PROFESSIONAL SERVICES CONTRACT
FOR LEGAL SERVICES
WHEREAS, there exists a need for professional services to provide legal
representation to James Connolly, Patrolman; and
WHEREAS, pursuant to N.J. SA~ 40A: 1 I-5 (1) (a) professional services are exempt
from the requirements of competitive bidding; and
WHEREAS, the local Finance Officer has certified that funds are available;
NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the
Borough of Carteret does hereby approve the appointment of Bar~ Albin, Esq. at
a maximum cost not to exceed $1,000.00 billable at $125.00 per hour pursuant to
Ordinance #94-59.
BE IT FURTHER RESOLVED that no additional sums exceeding the
aforementioned amount will be paid without submission of a bill for services and prior
approval by the Mayor and Council.
IT IS FURTHER RESOLVED that the contract is awarded without competitive
bids in accordance with NJ.S.A.40A:ll-5 (1) (a) due to the specialized and
professional nature of the service provided.
BE IT FURTHER RESOLVED that the Mayor and Borough Clerk are hereby
authorized to execute said contract upon the negotiation of terms and conditions.
BE IT FURTHER RESOLVED that a notice of this action shall be printed once in
The Home News & Tribune on August 20, 1996.
Adopted this 15th day of August, 1996
and certified as a true copy of the
original on August 16, 1996.
