Leven: Comprehensive Water Planning Committee is looking to do a build out of the town. It is worth everyone being involved in it. A build out is if every lot is built to maximum permitted by zoning. How many people do you have, open space, etc. Taylor: Accessory By-law 2"d house on property. This is part of the build out. Leven: Based on size and pre-existing conditions, etc. There has been discussion about doing it for the whole town or just the DCPC areas. Chris Miller and Leven are going to follow up. There is also a draft covenant in the packet. Has everyone had a chance to review? The two are organized differently. Leaning: Ex. 2 -- There may not be enough room on bottom of the page for additional conditions. Leven: There will be enough room. Review the draft of the Board's meeting schedule for 2011. The deadlines have been moved back a few days because the deadline now is Monday and the ad is due on Tuesday morning. Taylor: Comments or preferences on the covenant? Leaning: Can we get it on one page? Leven: We can't get it on one page. We did consolidate it. We might be able to amend it after we use it a couple of times... McMullen: Will an attorney follow his own guidance with his own covenant? Leven: No, not if the Board has a covenant that they use. The bulk of the information is exactly the same. Taylor: Comments? Leven: From talking to counsel, it can be grown on site and brought in from other areas of the state. Bugle: Other things could be going on instead of agriculture? If they produce a product, cut trees make reindeer. Would that qualify? Leven: Not necessarily. For example, a Garden Center. Products grown on site and bring in other plants. Agricultural Products vs. products made from agricultural products. Plant materials and agriculture products vs. made from agricultural things. Taylor: Did you notice the change you can apply with 2 acres. Different requirements like $1,000 an acre per year. Aviary? Horses? Comments rules. #2010-23 Applicant: Cape and Vineyard Electric Cooperative (CVEC) Owner: Town of Brewster Property is located on Commerce Park Road and shown on Assessors' Map 46; Parcel 41 in the Industrial (I) zoning district and the Wind Energy Turbine (WET) overlay district. The applicant is seeking a special permit to install two (2) large scale (utility scale) wind energy turbines pursuant to Section 179-40.2 G (Large-Scale Wind Energy Turbine (LWET) of the zoning by-laws and MA General Laws Chapter 40A Section 9. The applicant is also seeking a Corridor Overlay Protection District special permit pursuant to Section 179-66 B (Use Regulations, Special permit uses). The proposed turbines will each be three-bladed, rotor mounted atop a monopole tower with a maximum height of 410 feet to the tip of the blade. CVEC Ron Collins -Engineer Barry Worth -Harwich Rep, CVEC Steve Wood, Expert in Sound, ESS Planning Board Meeting Page 3 of 13 PB Minutes 11-10-10 Chris Bydek, ESS Group Steve Weihe -Presentation This is pursuant to Chapter 179 of zoning code. It is a Special Permit by CVEC and Town of Brewster. Both are public entities. Meant to insulate electricity rates. Not driven by profits. Each resident will benefit from this project and this is a responsibly sited wind project. It will reduce air pollution and carbon footprint. We are here to review the application. It was filed 10/18/10. The presentation is a review of the application for permit. This project is located on 106 acres, in the Industrial Park, on Commerce Park Rd. within the Wind Energy Overlay District. The district was adopted by the town in 2007 for the placement of large-scale wind turbines. This is an appropriate and compatible use for this area. We are aware that not all people agree that wind turbines should be installed on the Cape. This application is compliant with all the requirements that the Town of Brewster laid out. We are addressing the bylaw specifically. At the end, we will request the board consider a motion to draft a favorable decision. We understand other processes/agencies are looking at information concurrently. It may be condition on these reviews. Overall height of 410 feet. Wind turbines make noise. We appreciate all opinions. Everyone is entitled to have an opinion. We know this is personal to many people. We appreciate the feedback. We take it into consideration when working on these projects. Important part of the democratic process. We hope to present a project that is economically and technically viable that will benefit the community. Slide Notes Summarv.~ Feasibility Study -June 2009, other locations were reviewed (6) 1 turbine per 50 acres, general rule. Turbine Siting - 106 acres town land, industrial park, industrial tenants. Nearest resident 1,800 ft. away, To the north of Turbine A. East, 2,300 ft. (all farther than 1,800 feet away) Not a densely populated area, sufficient buffer. Setbacks and Constraints - 410 ft. structure height: By-law requirements have been met. Turbines are compliant with the town's by-law. Wetlands - We met with Conservation Commission last week. We are currently working on a Request for Determination of Applicability. We are evaluating to make sure we stay 100 ft. from wetland. Basics of Sounds -Overview. Sound is measured in decibels. Town bylaws and State have sound standards. A change of 3 decibel is the minimum perceptible of the human ear. Wind Turbine Sound -Between 40 - 50 DbA range. MA DEP and Brewster bylaw: Stipulate no more than 10 decibel increase at property boundary or residence. These are the standards for compliance. Turbine Sound Modelin4 -Range of frequencies. There are no peer reviewed studies that suggest sounds from wind turbines are harmful to humans. There are a lot of stories out there on the Web. All simulations were modeled on Vestas V90. This is the model we consider suitable for this project. CVEC Approach to Compliance: Background Sound Study, Turbine Sound Modeling (done by ESS), Prediction at Site Boundaries Background Sound Monitorincl 4 days, covered weekday weekends day and night time. Background noise levels change with wind speed. Turbine Sound Modelino: Planning Board Meeting Page 4 of 13 PB Minutes 11-10-10 Discussed expected increase in ambient sound levels. At the quietest 10% of the day, predict increases are 1 to 5. These results demonstrate full compliance with a lot of room to spare. Presented graph showing wind speed and predictable decreases in sound levels of turbine as distance from the turbine increases. Shadow Flicker: This is shadows cast from sunlight passing through rotating turbine blades. It is analogous to driving through tree lined street early in morning or late in the evening with sun moving. As engineers we model the worst case scenario. Showed a Flicker Map. Avian Studies: Phase I for bird and bat risk. This is an industry standard to identify potential risks. This involves agency consultation with regional experts. There is minimal risk to birds. There are no federally or state listed bat species near the site. It represents a minimal risk. We feel that the necessary studies have been done. Photo Simulations: We tried to characterize from vantage points taking into account distance and location. We modeled what it might look like. Shared photo simulations of the Water dept., Woodlands Assisted Living Facility, Commerce Park Rd. At Freeman's Way Fields the turbines would exist below the tree line. Included the driving range and the radio towers. taken from different vantage points. All photo simulations are setup in the hall. To the board - We are asking for your consideration for approval of this application. Planning Board: Questions for CVEC Leaning: In packet section #2, it references an environmental report for NEPA re: avian and bats collision. What is the status? Bernstein: It is addressing a series of environmental issues. It is required for a loan that is being sought. A notice of publication is due to come out. Wood: The environmental report is in draft format and will be submitted. Yes, it will be available for public review. Leaning: Please let us know when available. Wood: Yes, not sure of the date. Eminent. Bernstein: Before the loan is approved there has to be no impact. Leaning: Section #12 Re: aeronautics review -last page, air space analysis, #24 is that the number of the runway in Chatham? Distance 3.1 miles from runway 24 in Chatham. Bernstein: Correct Kuzman: Crane to build. What are your Plans? Removal of anything? Weihe: It is the responsibility of the design/build entity who is awarded the contract. It is a study that has not been completed. There are ways of getting it there. Minimum turning radius required will be examined). Not necessary yet. There are on-site requirements. It will be part of the contract. This application is conceptual site plan for approval. There are on-site considerations. Kuzman: Not planned for yet. Ouimet: We have done sufficient planning for the permit process. The design/build contractor is responsible for getting the crane there and the working area. They are responsible for the engineering at the site. Kuzman: The cost to do this is part of the $lOm. Cost to the land? What has to be cut down, etc? Planning Board Meeting Page 5 of 13 PB Minutes 11-10-10 Ouimet: Some clearing will be required. It will be consistent with what we have shown. They will invite the market to give best ideas. Limit extent of clearing and timing. Within the constraints of this permit. Barnard: What steps or instruments are in place to ensure control of the fall zone properties? Bernstein: The Town will enter into legal agreements with CVEC to provide a lease site and the town with the exception to the bunker (golf facility). The town has leases with other parties. Steve? Barnard: Any of the lease properties within the fall zone? Weihe: Yes. The town owns the property. Setbacks and Constraints -referenced driving range shed. 11k square feet. The structure might need to be relocated. Two to three acres necessary to do the construction. It will be a fenced in area. The actual area is less than an acre per footprint. Subject of a lease agreement with CVEC and the Town. Bugle: Follow up on Barnard's comments. The Planning Board has always looked at all wind turbines. It is necessary to secure all easements and agreements. There are two properties to the east and two to the west. The Town owns these properties. These businesses need to sign something that they understand that they accept all risks with being in the fall zone. Legal documentation is necessary. Bernstein: CVEC has insurance for the site where the turbines are being constructed. Anyone who has property with Town has to waive any interest. CVEC will take the risk. Insurance is in place. At the very edge of the fall zone commercial property. We have had discussions with town counsel. Bugle: You may be willing to take that risk but our by-law does not allow this. We do need something in writing from property owners. Bernstein: I believe that there are certain areas in the by-law that are not applicable to LWET. I don't know if that is applicable. Small risk as this project is configured. Anyone better to address this? We had discussions with town counsel. No need for any lease amendments or legal documents. Bugle: Risk. Should something happen. Small Or large scale turbine. Town needs to address this. Taylor: If there were habitable dwellings we would need that. I don't know if the lease lines quality? If 410 ft. had enveloped the buildings of the lessees. I think we are clear. We will get any waivers if needed. Bugle: I would like to see these kind of agreements in writing for the board. Bernstein: We believe we are in compliance with all setback requirements. There may be commercial tenants at a farther distance. The risk here is CVEC's. CVEC is well insured risk during construction and operation stage. Barnard: Read by-law. It is pretty clear. Fall zone. Applicant needs to show proof or control of the setback. (fall zone) Weihe: The Town owns the land. You have control over that. Whatever instrument needs to include the town needs to make sure it is included. Fall zone is cleared for all structures with the exception of the non habitable shed in the driving range. Bugle: How much research have you done on sub sonic sounds? Weihe: Not required to be examined as part of the by-law. DbA is required. We looked at low frequency sounds down to 16 hertz. Planning Board Meeting Page 6 of 13 PB Minutes 11-10-10 Bugle: Most discussions currently out there don't involve audible sounds. Some pretty reputable sources. Sub sonic sounds are used by Navy. These things are generating similar sounds. Some speculation causing problems in human bodies? Any thoughts? Weihe: We have not researched it and it is not part of this application. Taylor: It is not part of our bylaw. We would have to go back to town meeting. Chris Bydek: ESS Group. We did take a look at noise down to 16 hertz. It is below any audible limits. No evidence to the literature. With all due respect, I do take some concern or judgment on the level of the studies out there, the scientific basis, quality out there discussing sub sonic sounds. American Wind Energy Association and the Canadian Wind Energy Association did reports. They looked at this issue. There is no evidence out there that sub sonic sounds from the turbines at the levels we are talking about would cause adverse health effects. These turbines are below the audible limits. We see no adverse health effects from these levels. Kuzman: When you connect to the grid have you considered how? What route. Underground, overhead? Bernstein: NStar Interconnect. Study is underway. It has not been finalized. NStar will require an easement for the route. Weihe: From locations underground line to Turbine A, Turbine B underground. Leaning: In the event one of the turbines collapsed? I assume you are properly bonded? Bernstein: Any contractor or CVEC -several levels of protection. There is a requirement at the end of the lease to decommission and restore site. Leaning: FAA -certain aerial lights on the top. Shielding lights so not visible from land. Weihe: There is a lighting requirement. Similar to lights on top of radio towers in town, shielding might not be allowed. It is not a requirement. It has not been proposed. It may not be allowed by the FAA. Taylor: When are you going in front of the Conservation Commission? Bernstein: They closed their hearing. Meeting next Wednesday 11/17. Downey: Public hearing was last Wednesday. They closed the hearing. It will be continued. A member asked for additional information and analysis of one of the wetlands. Weihe: Inland land subject to flooding. A submittal due to them at next meeting. Turbine A, subject to flooding. We would have to identify aBoundary - 100 ft. buffer. The information will be filed with Conservation Commission before next Wednesday. 11/17. Taylor: It may require moving Turbine A? Bernstein: If the Planning Board chooses to act favorably, give CVEC the ability to move it up to 100 ft. NE if Conservation Commission determines that it is necessary to meet buffer requirements of the Brewster Wetlands by- law. Every analysis presented tonight would be the same even with that minor change. Taylor: Wetlands subject to flooding? Are they actual wetlands? Weihe: A model must be run. Take into consideration existing contours. We have had not had an opportunity to commit it to paper. Taylor: Question about talking with Division of Fisheries and Wildlife Planning Board Meeting Page 7 of 13 PB Minutes 11-10-10 Weihe: It should be in the application. It is the last page. Response letter from Division of Fisheries and Wildlife. Taylor: They are cleared on this. Taylor: Letter read into record from Chuck Madansky, 196 Nan KeRafe Path: In favor of the project. Public Comment: Abutters: Gregory Bome, Skip Comeau -Radio Station, WFCC Classical 107.5 Cape Cod Broadcasting spoke in opposition to project. He is concerned about tower location. Turbine "A" is located 400 ft. from the radio tower. He says the rotating blades could have reverse flicker which could scatter their radio signal. They are Communications tower 1 close to Turbine "B". Bernstein: This issue is not within the planning board's determination on this particular special permit. The findings CVEC is required to make (section J) will not have adverse effect. There may be legal issues that go to the lease with the Town. It is not a relevant issue here. It is not within the zoning by law for special permits for large scale wind energy turbines. She is concerned about visuals, sounds, decrease in property values, and the residents at the Woodlands. Selectman -Greg Lavasseur: To Mr. Barnard and Mr. Bugle -Fall zone. The town is required with CVEC to provide quiet involvement. Two lease owners: Colson Landscaping and radio tower. Town is under negotiations with Colson's and have tried to contact the radio tower owner. Lease back to the Town. We hope to be able to provide at some point in near future these two portions of the control to the Town of Brewster. Go visit turbines and talk to people. There should be a continuance. Brian Elder: Falmouth. He lives 1,330 feet from Wind Turbine #1. He spoke in opposition to the project. He is concerned about the noise. Katherine Elder: Falmouth. Blacksmiths Shop Rd. She spoke in opposition to the project. She is concerned about the noise, decreases in property values, sleep problems. Barry Worth: Harwich. He is the Chair of the Utility and Energy Commission. He spoke in favor of the project. Alice Kuntz: Harwich. She spoke in opposition to the project. She is concerned about health issues and financial gains from people involved in the project. Planning Board Meeting Page 9 of 13 PB Minutes 11-10-10 Lilli Green: Wellfleet. She is a founder of Windwise, Cape Cod. This group sponsored the seminar at Cape Cod Community College. She spoke in opposition to the project. She is concerned about health risks, siting, tourism, golfers. She left her card and two large notebooks. Ed Lewis: Brewster Selectman 1) Town meeting approved large wind energy turbine by-law 2) It passed and we had a BOS public meeting 3) We need to determine whether it fits into the by-law Energy committee and CVEC and their consultants have done a great job answering the questions. Greg Lavasseur and I have been working on this for 18 months. We have seen a lot of the studies. Closest people are 1,800 feet away and they have written a letter in favor of the project. Meetinghouse Village is 3,300 feet away. Thousand Oaks is over 6,000 feet away. Most of these people will not see it. This is the right thing to do. Joyce McConnell: Brewster. 65 Thousand Oaks. She spoke in opposition to the project. She is concerned about not being at the last town meeting for health reasons. She is concerned about this project's impact on the community. Leven: On December 6 Harwich will vote to regionalize school district for Chatham and Harwich. We will be out of town and will miss it and not get to vote. It is important to understand that people who live in any town have a responsibility to be informed and watch local cable, read newspapers, and attend town meeting. It is one of the purest forms of democracy. It is a real shame that only 300 people come to town meeting. This project has been going on for well over a year. This stresses the importance of residents taking responsibility for their own lives and staying informed on what is going on in their town. Charles Sumner: Town Administrator for Brewster. Ed Lewis made some good points. We have visited turbines in Hull, Falmouth, and Portsmouth, RI. We stood underneath the turbines. Then we went into neighborhoods and talked to people. Our nearest resident who lives 1,800 feet away from the location supports this project. The vast majority of the people who spoke against the project live on Thousand Oaks, William Maker and live 6,200 feet away which is 1.2 miles away. It is a stretch of the imagination to believe that there are impacts that you can sense from these vast distances. I think it is environmentally the right thing to do. I would not do this if it we would have a negative impact on the citizens. We have done a lot of due diligence for this project and I support it. Bugle: Reiterate what I brought up earlier tonight. Release from people leasing these properties. This was brought up last spring. It is a procedural thing. We need these releases; it is in our by-law. We need to see something. Collum: Fire issue. Can one of you address this? Weihe: Yes, there is a potential for fire. There is gear oil, and lubricants. Let it burn out. No reason for a fireman to put out this. It should be allowed to burn. It is insured. It can be dismantled and fixed. It does not affect town insurance. It has a fall zone. No different than a house. The top of the blade is 410. The cell is 260 feet. McMullen: There are a lot of questions. I cannot vote on this tonight. I suggest we postpone to next meeting. Leven: Is the board going to ask for additional information from the applicant? Bugle: Releases. McMullen: I would like to have them address the radio station issue. I think I would like to hear more about the health issues. Also, the property values. Kuzman: Impact getting the crane, etc. to the site. I looked at article 15 approval from last meeting. Article 15 was approved. I was shocked to see unanimously accepted. No opposition at all. Boards like ours are ruled by bylaws, and zoning regulations. If applicant meets requirements our hands are tied. Voters opposed to project can get organized and create another article in the spring. I have not heard much about property values. Environmental impacts about sound are not resolved fully to me. Planning Board Meeting Page 10 of 13 PB Minutes 11-10-10 Leaning: I spent a lot of my time as a professional journalist covering the wind farm in Nantucket Sound. There were never any issues or concerns about sound. I went to Falmouth and could not hear a thing. I could see it. I know the town has spent a lot of time, effort and money. I am supporter of wind energy. I want to see more information on the sound, both ambient and what you cannot hear. I don't know if that is in our purview. Section 179-41? I am a little concerned about the health issues. Barnard: Page 3 of Section 2 of application, fall zone. CVEC working with the town to address issue with driving range fall zone. Potentially re-design and put netting? Downey: We are working with Town, netting will be installed. Part of the turbine construction. Included in cost of bids, proposals, RFP. Barnard: Designation of that part of the range as part of the fall zone. The by-law states that the applicant needs to take control of the area of the fall zone. Stipulate part of the fall zone. I am not an expert on wind turbines. You are the experts. I could continue the meeting to next week but I am not sure if I would be in a different place next week. I would like to hear from you if can comment. There is some consensus if you live within 2kilometers or 1.25 miles whether there is any credibility to those studies? Taylor: We will be continuing this meeting. The turbine sitting in Texas now in Falmouth is not CVEC. Downey: That is correct. The technology now is very different. If you want to give us questions we will respond to you in writing. Taylor: Reviewed questions from board members. Leven: General comment -Sound issues other than sub sonic. A question about the difference in technology in the turbine in Falmouth and what would be addressed here. Downey: Continue public hearing? The Board would like to have things a week ahead. Bugle: Ask Mr. Lavasseur when he will receive releases? Lavasseur: 15th of December.
