HomeMy Public PortalAboutOrdinance 3610 ORDINANCE NO. 3610 AN ORDINANCE GRANTING APPROVAL OF A VARIANCE TO PERMIT THE PROPOSED SUBDIVISION OF THE PROPERTY COMMONLY KNOWN AS 14929 S. DES PLAINES ST, INCLUDING GRANTING RELIEF FROM SECTION 9-54 OF THE ZONIGN CODE RELATIVE TO MINIMUM LOT SIZE, LOT WIDTH AND LOT AREA PER DWELLING UNIT, ALL IN THE VILLAGE OF PLAINFIELD, WILL COUNTY, ILLINOIS WHEREAS, the Village of Plainfield has considered an application for a variance from Sec. 9-54. — General Standards for the R districts, to permit a minimum lot size of 5,391 square feet, minimum lot width of 66 feet, and minimum lot area per dwelling unit of 5,391 square feet, for the property located at 14929 S. Des Plaines St.; WHEREAS, the Board of Trustees has made the following findings based upon the evidence presented to it: a. The variance is in harmony with the general purpose and intent of this Zoning Ordinance; b. The plight of the owner is due to unique circumstances and thus strict enforcement of the Zoning Ordinance would result in practical difficulties or impose exceptional hardships due to the special and unusual conditions that are not generally found on other properties in the same zoning district; c. The property cannot yield a reasonable use if permitted only under the conditions allowed by the Zoning Ordinance; and d. The variance, if granted, will not alter the essential character of the locality and will not be a substantial detriment to adjacent property. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF PLAINFIELD, WILL AND KENDALL COUNTIES, ILLINOIS, AS FOLLOWS: Section 1: Recitals - The President and Board of Trustees of the Village of Plainfield hereby adopt and incorporate as their own, the above findings recited. Section 2: Approval — The application requesting a variance to permit a third detached accessory structure that will exceed the allowable total square footage of detached structures for the real estate hereinafter described is hereby granted: Parcel I: That Part Of Block 3 Of Arnold's Addition To Plainfield, Being A Subdivision Of Part Of The Southeast Quarter Of Section 9, Township 36 North, Range 9 East Of The Third Principal Meridian, In Will County, Illinois, And Of Lots 2 And 3, Of The Subdivision Part Of Block 3 Of Said Arnold's Addition, As Made By Edgar L. Doud, Described As Follows: Beginnings A Point 4 1/2 Rods South From The Northwest Corner, Of Block 3 Of Said Arnold's Addition, And Running Thence South On The Line Of Chicago Street (Now Des Plaines Street) 8 Rods, Thence East 5 Rods And 1 1/2 Feet, Thence North 6 Rods And 6.77 Feet, Thence East 1 1/2 Feet, Thence North 1 Rod And 9.73 Feet, And Thence West 5 Rods And 3 Feet To The Point Of Beginning (Except Therefrom The South 66 Feet Thereof);In Will County, Illinois. Parcel II: That Part Of Lots 1 And 2 Of Edgar L. Doud's Subdivision Of Block 3, In Arnold's Addition To Plainfield, Described As Follows: Beginning At The Northwesterly Corner Of Lot 1, And Running Thence Southerly Along The Westerly Line Of Said Lot, 74.25 Feet, Thence Southeasterly Along The Southwesterly Line Of Said Lot 1, And Along The Said Southwesterly Line, Extended, 85.50 Feet, Thence North 11 Degrees 51 Minutes West, 37.9 Feet, Thence North 36 Degrees 26 Minutes West 21 Feet To The Southwest Corner Of Property In Deed Document Number 463819, Thence Along The Westerly Line Of Said Doc. 463819 To The Northerly Line Of Said Lot 1, And Thence South 53 Degrees 34 Minutes West Along The Northerly Line Of Said Lot, 40.5 Feet To The Point Of Beginning, In Will County, Illinois.
