Present: Mayor, Thomas Anderson; Councilmembers, William Reiser, Robert Mitchell, Anne Heideman, Wilfred Scherer; Clerk -Treasurer, Donna Roehl; Planning and Zoning Administrator, JoEllen Hurr; Police Chief, Michael Sankey; Public Works Dir- ector, James Dillman; ATtorney, Richard Schieffer 1. ADDITIONAL AGENDA ITEMS Moved by Heideman, seconded by Scherer to discuss the following additional agenda items: Plans and Specifications for Medina Manor streets Use of alcohol on private streets Motion declared carried 2. MINUTES OF JULY 2, 1985 Anne Heideman asked that Item 5, Page 278, indicate that Marge Buschbom and that Woodlake Landfill Item, Page 281, include the authorization to that had been completed, as specified on the plan. Moved by Heideman, seconded by Scherer to accept the minutes of July 2, Motion declared carried is an Orono resident, add fill to the areas 1985, as amended. 3. PUBLIC WORKS DEPARTMENT Minnegasco Moved by Scherer, seconded by Mitchell to adopt REsolution 85-60, allowing bury gas lines in the North Ridge Farms development, provided that work is shoulder of the road. Motion declared carried Minnegasco to done off the Water and Sewer Rates Moved by Scherer, seconded by Heideman to adopt Resolution 85-61, establishing water rates at $1.95 per 1000 gallons and sewer rates at $3.35 per 1000 gallons. Motion declared carried 4. POLICE DEPARTMENT Alcohol use on private roads Michael Sankey asked that an ordinance amendment be adopted on private roads that serve more than two properties. Moved by Mitchell, seconded by Scherer to adopt ordinance # garding use or possession of alcoholic beverages on private Motion declared carried prohibiting the use of alcohol 221, amending Sec. 301.01, re - streets. 5. INDEPENDENCE BEACH NEIGHBORHOOD PICNIC Council discussed the request of Connie Dahl to close Lakeshore Ave. in the vicinity of the Independence Beach park and also the boat ramp, so that a neighborhood picnic could be held on August 18th. Michael Sankey stated that the boat ramp should not be closed and that sufficient streets would need to be open so as to provide access for emergency vehicles. Moved by Reiser, seconded by Mitchell to allow Lakeshore Ave. to be closed on August 18th from the boat landing to Walnut Street, but that the boat ramp must remain open. Motion declared carried 6. EHLERS AND ASSOCIATES CONTRACT Moved by Heideman, seconded by Scherer to enter into contract with Ehlers and Associates for payment of $4000. for services in connection with the cities tax increment planning. Motion declared carried 7. ANNE AND PADDY THEIS Council discussed request of Anne and paddy Theis for refund of sewer and water assessment in the amount of $4851.88, due to the existance of a severe drainage problem on Lot 5 and the West 30 ft. of Lot 6, Block 9, Independence Beach. Mrs. Theis stated that they would then .sign an agreement combining the parcel with their abutting property. 284 Jim Dillman explained that the tile line through the property had been cleaned and was connected to the existing tile. Thomas Anderson asked if they would like to delay the request until a substantial rain- fall so as to be able to determine if the area would drain properly. Robert Mitchell asked if there was a legal way by which the city could refund and assess- ment. Richard Schieffer stated that he would research the Statutes, again, for an answer. Thomas Anderson asked if the parcel could be filled and be a buildable lot. Paddy Theis stated that someone had said that water would not drain away in a few days they could be subject to a lawsuit if the property were sold as a buildable lot. He stated that the amount being requested would be less than any expense that it would cost the city if a house were built, such as, schooling, policing, fire protection, etc. Moved by Heideman, seconded by Scherer to table action on the request of Paddy and Anne theis for refund of Special Assessments paid on Lot 5 and the west 30 feet of Lot 6, Block 9, Independence Beach, until the August 20th meeting. Motion declared carried 8. HOLY NAME CHURCH Moved by Reiser, seconded by Heideman to grant an On -Sale, Non -Intoxicating Malt Liquor license to Holy Name Church for Sunday July 21, 1985, at a fee of $10.00. Motion declared carried 9. ST. ANNE'S CHURCH Moved by Reiser, seconded by Scherer to grant an On -Sale Non -Intoxicating Malt Liquor License to St. Anne's Church for Sunday, August 25, 1985, at a fee of $10.00. Motion declared carried 10. LIBRARY CARPET Council discussed the request from Hennepin County Property Management to install new carpeting in the Medina Library. Anne Heideman stated that she was reluctant to proceed with a project in view of the fact that the Library may not be in the building more than two years and that the city does not know what it will use the space for after the Library moves. Moved by Heideman, seconded by Reiser to seek the advice of a carpet installer as to the possibility of repairing the carpet. Motion declared carried 11. BILLS Moved by Reiser, seconded by Scherer to pay the bills: Order Checks # 3989-3993 in the amount of $5375.67 and Payroll Checks # 8395-8414 in the amount of $13,837.36. Motion declared carried 12. MEDINA MANOR STREET IMPROVEMENT Council discussed the possibility of having the Plans and Specifications drawn for the Medina Manor street improvement project, prior to the Public Hearing scheduled for Aug- ust 6th. Jim Dillman stated that he would like to have the plans drawn prior to the Public Hearing due to the limited amount of time available for street work before winter. JoEllen Hurr stated that the majority of the Medina Manor residents had spoken in favor of the road improvement. Richard Schieffer advised the Council to follow procedures so that when bonding for a project there would be no conflict. Moved by Scherer, seconded by Heideman to authorize Jim Dillman to proceed to secure Plans and Specifications for the Medina Manor street improvement project. Motion declared carried 13. PLANNING AND ZONING DEPARTMENT Reed Bales Sawmill Thomas Anderson stated that he would like to have Mr. Bales provide more fencing than what had been proposed. JoEllen Hurr reported that a survey of the property had not been supplied, as had been requested. Moved by Reiser, seconded by Heideman to table action on the Reed Bales Conditional Use Permit and Development Contract until the required materials have been received. Motion declared carried r) esf Ross Gronfield, Variance Richard Schieffer reported that he had revised the Gronfield variance resolution as the suggestion of Councilmember, Robert Mitchell. Moved by Heideman, seconded by Scherer to adopt REsolution 85-62, approving a setback variance for an addition to the Ross Gronfield residence, 3200 Carriage Dr. Motion declared carried 5 Hwy. 55/Hwy. 101, Development Moratorium Richard Schieffer reported that two resolutions had been prepared to declare a development moratorium on properties located in the vicinity of Hwy. 55 and Hwy. 101. He stated that one resolution directs city staff not to take applications for development in the area after July 16th and the second resolution calls for a Public Hearing to discuss an interim ordinance halting development to allow for a proper study of the area to determine its development potential. Moved by Heideman, seconded by Reiser to adopt Resolution 85-63, imposing a moratorium on development of the properties in the northwest corner of Hwy. 55 and Hwy. 101. Motion declared carried Moved by Heideman, seconded by Scherer to adopt REsolution 85-64, calling a Public Hearing on August 20, 1985 at 8:00 P.M. to consider an interim ordinance amendment to allow for a study of the Hwy. 55 and Hwy. 101 area. Motion declared carried Performance Standards Anne Heideman stated that she believed that there was no protection in the Performance Standards for those Residential properties abutting a Commercial or Industrial property. JoEllen Hurr explained that such protection could be included in a Conditional Use Permit document. Robert Mitchell stated that Item 4, Exterior Storage, allows for storage of materials that are for sale, outside of an establishment, and he asked that the sentence be dropped from the standards. Richard Schieffer explained that Ron BAtty had not recieved any comments from the city on the standards that he had prepared. JoEllen Hurr stated that the standards the Council was discussing would need to be refined and put into ordinance form and were not intended to be a final document. Ron Rogers, Planning Commission member, stated that the material received from the Attorney did not address the issues the city had wanted included, so the standards had been rewritten. Moved by Heideman, seconded by Mitchell to request that the City Attorney translate the Performance Standards, as approved by the Planning Commission, into a suitable ordinance. Motion declared carried Anne Heideman stated that Section 828. Item G, provides for one parking space for four students and an additional space for each classroom. She believed that the standards should be revised to provide for parking space for administrators, custodians and aids. Moved by Heideman, seconded by Scherer to amend the Peformance Standards to provide more realistic requirements for parking spaces on school property.
