HomeMy Public PortalAbout00016 O R D I N A N C E NO. 16 AN ORDINANCE declaring the policy and purpose of the Metropolitan St. Louis Sewer District to extend to all eligible employees and officials of said District who are not excluded by law, whether employed in connection with a governmental or pro- prietary function of said District, the benefits of the system of Federal Old Age and Survivors Insurance as authorized by the Social Security Act Amendments of 1950 and by Laws 1951, pp. 796, ff. as amended by Laws 1953, pp. 659, ff.; V.A.M.S. 105.300 - - 105.460 of the State of Missouri and amendments thereof, together with all applicable rules and regulations relative thereto, authorizing the Executive Director and the Secretary-Treasurer to prepare, execute and submit to the Division of Budget and Comptroller of the State of Missouri, as State Agency, a plan and agreement for extending said benefits to said employees and officials and authorizing and directing the Executive Director and the Secretary-Treasurer to execute agreements and modifications and amendments thereof with said State Agency, providing for the extension of said benefits to said employees and officials as set forth in said plan; providing for deductions from the wages of the employees and officials of said District to whom said benefits are extended, to be made and paid over as provided by the applicable State and Federal laws and regulations; providing for the appropriation and payment by said District of employers' contributions as provided by the applicable State and Federal laws 2 and regulations; providing that said District shall keep such records and make such reports as may be required by applicable State and Federal laws and regulations, designating the Secretary- Treasurer of the Metropolitan St. Louis Sewer District as the official required to make reports, and keep records on behalf of the District, and containing an emergency clause. BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: 3 Section One. It is hereby declared to be the policy and purpose of the Metropolitan St. Louis Sewer District to extend, at the earliest date, to all eligible employees and officials of said District who are not excluded by law, and whether employed in connection with a governmental or proprietary function of said District, the benefits of the system of Federal Old-Age and Survivors Insurance, as authorized by the Social Security Act Amendments of 1950, and Laws 1951, pp. 796, ff. as amended by Laws 1953, pp. 659, ff.; V.A.M.S. 105.300-105.460 of the State of Missouri and amendments thereto, as the same may be now and hereafter in effect. Section Two. The Executive Director and Secretary- Treasurer of the Metropolitan St. Louis Sewer District are hereby authorized and directed, on behalf of the Metropolitan St. Louis Sewer District, to prepare, execute and submit to the Division of Budget and Comptroller of the State of Missouri, as State Agency of the State of Missouri, a plan and agreement for extending said benefits to said eligible employees and officials of the Metropolitan St. Louis Sewer District, in the form prepared by the State Agency and hereby approved and adopted by the Board of Trustees of the Metropolitan St. Louis Sewer District, which plan and agreement are to become effective upon approval thereof by the State Agency, and the said Executive Director and Secretary- Treasurer are further authorized and directed to execute agreements and modifications and amendments thereof with said 4 State Agency, providing for the extension of said benefits to said employees and officials as set forth in said plan and agreement, as provided for in Section One hereof, said plan and agreement to provide that said extension of benefits is to be effective on July 1, 1954. Section Three. Commencing on the first day of the month following the date of the approval of the plan and agreement of this District by the State Agency, there shall be deducted from the wages of all employees and officials of the Metropolitan St. Louis Sewer District, to whom the benefits of said system of Federal Old-Age and Survivors Insurance are extended, by virtue of the plan and agreement hereinbefore provided for, the amount of each employees' and officials' contributions, as determined by the applicable State and Federal laws and by said plan and agreement, the aggregate amount of said deductions to be paid into the Contributions Fund created by Laws 1951, pp. 796, ff. as amended by Laws 1953, pp.659, ff.; V.A.M.S. 105.300 - 105.460 of the State of Missouri; provided, however, that from the wages paid to each of said employees and officials during the months from and after July 1, 1954, until the first day of the month following the date of the approval of the plan; and after the benefits of said system have been extended to such employees and officials, there shall be deducted a sum equal to the amount which would have been due and payable from such of said employees and officials had said extension of benefits been provided and effective on July 1, 1954. 5 Section Four. Commencing on the first day of the month following the date of the approval of the plan and agreement of this District by the State Agency, there is hereby authorized to be appropriated from the funds of the Metropolitan St. Louis Sewer District, and there is and shall be, appropriated the sum or sums of money necessary to pay the contributions of the Metropolitan St. Louis Sewer District, which shall be due and payable by virtue of the extension of the benefits of the Federal Old-Age and Survivors Insurance System to the eligible employees and officials of said District, said sum or sums of money to be paid into the Contributions Fund created by Laws 1951, pp. 796, ff. as amended by Laws 1953, pp. 659, ff.; V.A.M.S. 105.300 - 105.460 of the State of Missouri; provided, however, that in making the first payment to said Contributions Fund after the benefits of said system have been extended to such employees and officials, said first payment shall include a sum equal to the amount which would have been due and payable had said extension of benefits been provided and effective on July 1, 1954. The fund from which said appropriation is made will, at all times, be sufficient to pay the contributions of the Metropolitan St. Louis Sewer District by this Section directed to be paid to said Contributions Fund. Section Five. The Metropolitan St. Louis Sewer District, from and after the approval of the plan and agreement of this District by the State Agency, shall fully comply with, and shall keep such records, make such reports and provide such 6 methods of administration of said plan and agreement as may be required by all applicable State and Federal laws, rules and regulations, now and hereafter in effect with respect to the extension of the benefits of the Federal Old-Age and Survivors Insurance System to the employees and officials of this District. For the purpose of administering said plan and agreement, the Secretary-Treasurer of this District shall be the official who shall make all required reports, keep all records, and be responsible for the administration of said plan and agreement on behalf of the District, and any and all notices and communications from the State Agency to the District with respect to said plan and agreement shall be addressed to "Secretary-Treasurer, Metropolitan St. Louis Sewer District, Room 201 Mississippi Valley Building, St. Louis 1, Missouri." Section Six. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section Seven. The passage of this ordinance being deemed necessary for the immediate preservation of the peace and welfare of the employees and officials of the Metropolitan St. Louis Sewer District, it is hereby declared to be an emergency measure and shall become effective immediately upon its adoption. 7 The foregoing Ordinance was adopted November 15, 1954.
