AN ORDINANCE declaring the necessity for the
acquisition of easements within certain existing property within
The Metropolitan St. Louis Sewer District, for the purpose of
permitting construction of sewers therein to serve the needs of
residents on adjacent lands and authorizing the institution of
condemnation proceedings in connection therewith, with an
emergency clause;
WHEREAS, there exists within The Metropolitan St. Louis
Sewer District an area to be gown as WEBSTER MEADOWS SUBDIVISION
upon which dwelling houses are being constructed; and
WHEREAS, storm water gathered from such area will have
no alternative means of disposition to crossing said property and
will constitute a menace to public health and welfare of the
general public and the residents of The Metropolitan St. Louis
Sewer District; and
WHEREAS, it is the purpose and design of The
Metropolitan St. Louis Sower District to protect the public health
by relieving and alleviating these conditions;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One In order to protect the public health and
relieve she aforesaid unsafe and dangerous conditions, it is
necessary to appropriate and acquire by the exercise of eminent
domain or otherwise, two easements for the use of sewers as
hereinafter set forth:
An easement ten (10') feet wide, the center line of
which is described as follows:
Beginning at a point on the North line of Lot 10, Block
10 of Webster Gardens Plat 7, a Subdivision, according
to the Plat thereof recorded in the Office of the
Recorder of Deeds, St. Louis County, Missouri, said
point being distant S. 82o 18' W. 70.71 feet alongsaid
North line from the Northeast corner of said Lot 10;
thence along the center line of said easement, S. 78o
04' E. 70 feet, more or less, to the West line of Holly
Drive and the end of said easement.
An easement ten (10') feet wide, the center line of
which is described as follows:
Beginning at a point on the North line of Lot 10 in
Block 10 of Webster Gardens, Plat 7, a Subdivision of
St. Louis County, Missouri, according to the Plat
thereof recorded in the St. Louis County Records, said
point being distant, S. 82o 18' W 70.71 feet along said
North line from the Northeast corner of said Lot 10;
thence N 78o 04' W. 89.97 feet to a point on the East
line of Lot 1 of the Wells Tractaccording to the
Records in the Office of the Recorder of Deeds, St.
Louis County, Missouri, said point being the end of
said easement and distant N. 1o 04' E. 30.25 feet along
the East line of said Lot 1 from the Northwest corner
of Lot 10 in Block 10 of Webster Gardens, Plat 7.
Section Two. Counsel for Metropolitan St. Louis Sewer
District be and is hereby authorized to institute and prosecute an
action in condemnation pursuant to the provisions of the Plan of
The Metropolitan St. Louis Sewer District and the laws of the
State of Missouri, for the appropriation of private property as
hereinbefore set out.
Section Three The immediate construction of sewers
being necessary in order to protect the public health within the
District constitutes an emergency within the meaning of the Plan
of The Metropolitan St. Louis Sewer District and this Ordinance
shall take effect immediately upon its adoption.
The foregoing Ordinance was adopted April 30, 1956.
