AN ORDINANCE declaring the necessity for the
acquisition of an easement property within certain existing
property within The Metropolitan St. Louis Sewer District, for the
purpose of permitting construction of sewers therein to serve the
needs of residents on adjacent lands and authorizing the
institution of condemnation proceedings in connection therewith,
with an emergency clause;
WHEREAS, there exists within The Metropolitan St. Louis
Sewer District an area to be known as Subdistrict No. 2 of the
River des Peres Watershed of The Metropolitan St. Louis Sewer
District (Vinita Park Area) upon which commercial and residential
buildings are constructed or being constructed; and
WHEREAS, sewage gathered from such area will have no
alternative means of disposition to crossing said property and
will constitute a menace to public health and, welfare of the
general public and the residents of The Metropolitan St. Louis
Sewer District; and
WHEREAS, it is the purpose and design of The
Metropolitan St. Louis Sewer District to protect the public health
by relieving and alleviating these conditions;
NO, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. In order to protect the public health and
relieve the aforesaid insanitary and dangerous conditions, it is
necessary to appropriate and acquire by the exercise of eminent
domain or otherwise, an easement for the use of sewers as
hereinafter set forth:
An easement fifteen feet wide over the western
fifteen feet of the property conveyed to
Helen L. Hutcherson by an Instrument recorded
in Book 1878 page 25 of the St. Louis County
Records, said property being further
described as follows:
Beginning at a point 191.94 feet N. 67o 28' from
the intersection of the west line of Wolter
Avenue 25' wide and the north line of Page
Avenue 80 feet wide; thence N. 67o 28' W
129.00 feet; thence N. 22o 32' E. 311.92 feet;
thence S 89o 14' E. 138.91 feet; thence S. 22o
32' W. 363.43 feet to point of beginning and
being 1 acre more or less.
Section Two. Counsel for The Metropolitan St. Louis
Sewer District be and is hereby authorized to institute and
prosecute an action in condemnation pursuant to the provisions of
the Plan of The Metropolitan St. Louis Sewer District and the laws
of the State of Missouri for the appropriation of private property
as hereinbefore set out.
Section Three. The immediate construction of sewers
being necessary in order to protect the public health within the
District constitutes an emergency within the meaning of the Plan
of The Metropolitan St. Louis Sewer District and this Ordinance
shall take effect immediately upon its adoption.
The foregoing Ordinance was adopted July 7, 1956.
