AN ORDINANCE declaring the necessity for the
acquisition of an easement for flow of sewage within certain
existing private sewers within The Metropolitan St. Louis Sewer
District and authorizing the institution of condemnation
proceedings in connection therewith, with an emergency clauses
WHEREAS, there exists within the boundaries of The
Metropolitan St. Louis Sewer District an area known and described
as Subdistrict Number Three of the River Des Peres Watershed of
The Metropolitan St. Louis Sewer District (South Webster Area), as
established by Ordinance No. 19 of The Metropolitan St. Louis
Sewer District, and
WHEREAS, the sewage gathered from such area has no
satisfactory present means of disposition, and constitutes a
menace to the health and welfare of the general public and the
residents of The Metropolitan St. Louis Sewer District; and
WHEREAS, it is the purpose and design of The
Metropolitan St. Louis Sewer District to protect the public health
by relieving and alleviating these conditions;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. That in order to protect the public health
and relieve the aforesaid insanitary and dangerous conditions, or
to carry out and effectuate any one of the above mentioned
operations, it is necessary to appropriate and acquire by the
exercise of eminent domain or otherwise, an easement for the flow
of sewage, including a connection therewith within the following
described sewer system of Town Service, Inc., a Missouri
corporation;
Beginning at or near the St. Louis-San Francisco Railway -
Heege Road Overpass and proceeding northeastwardly
across property now or formerly of Hydraulic Press
Brick Co.; thence across said property and across
Resurrection Cemetery to Mackenzie Road; thence across
MacKenzie Road and proceeding eastwardly to a
connection with the River Des Peres foul water system
in the City of St. Louis.
Section Two. That Counsel for The Metropolitan St.
Louis Sewer District be and is hereby authorized to Institute and
prosecute an action in condemnation pursuant to the provisions of
the Plan of The Metropolitan St. Louis Sewer District and the laws
of the State of Missouri for the appropriation of private property
as hereinbefore set out.
Section Three. By reason of the existing insanitary
condition which is a menace to the health of the residents of the
District, an emergency exists within the meaning of the Plan of
The Metropolitan St. Louis Sewer District and this Ordinance shall
take effect immediately-upon its enactment.
The foregoing Ordinance was adopted May 21, 1956.
