HomeMy Public PortalAbout00075 O R D I N A N C E NO. 75 AN ORDINANCE declaring the necessity for the acquisition of an easement for flow of sewage within certain existing private sewers within The Metropolitan St. Louis Sewer District and authorizing the institution of condemnation proceedings in connection therewith, with an emergency clause: WHEREAS, there exists within the boundaries of The Metropolitan St. Louis Sewer District an area known and described as Richford Gardens, a Subdivision of St. Louis County, Missouri, and WHEREAS, the sewage gathered from such area has no satisfactory means of disposition, and constitutes a menace to the health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health by relieving and alleviating these conditions; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. That in order to protect the public health and relieve the aforesaid insanitary and dangerous conditions, or to carry out and effectuate any one of the above mentioned operations, it is necessary to appropriate and acquire by the exercise of eminent domain or otherwise, an easement for the flow of sewage, including a connection therewith, within the following described sewer system of Town Service, Inc., a Missouri Corporation: Beginning at or near the northern line of Laclede Meadows, a subdivision of St. Louis County, Missouri; thence across property now or formerly of Frank Sander and wife, to Valcour Hills, a subdivision of St. Louis County, Missouri, and beginning at General Sherman Court in said Valcour Hills, and thence, joining aforedescribed sewer line, across the Kenneth MacKenzie Subdivision, a Subdivision of St. Louis County, Missouri, to Heege Road; thence along Heege Road and proceeding northeastwardly across property now or formerly of Hydraulic Press Brick Co.; thence across said property and across Resurrection Cemetery to MacKenzie Road; thence across MacKenzie Road and proceeding eastwardly to a connection with the River Des Peres foul water system in the City of St. Louis. Section Two. That Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to institute and prosecute an action in condemnation pursuant to the provisions of the Plan of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri for the appropriation of private property as hereinbefore set out. Section Three. By reason of the existing insanitary condition which is a menace to the health of the residents of the District, an emergency exists within the meaning of the Plan of The Metropolitan St. Louis Sewer District and this Ordinance shall take effect immediately upon its enactment. The foregoing Ordinance was adopted May 21, 1956.
