HomeMy Public PortalAbout00088 O R D I N A N C E NO. 88 AN ORDINANCE providing for the assumption of title to sewers, easements and appurtenances in those instances where it is deemed appropriate, with an emergency clause. WHEREAS, there exist within the boundaries of The Metropolitan St. Louis Sewer District sewers which are deemed acceptable to the District, but which cannot be dedicated because no living titleholder can be found; and WHEREAS, in order to protect the public health and properly to carry out the purposes of the District, it is necessary to acquire, operate and maintain such sewers; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Metropolitan St. Louis Sewer District shall hereafter have the power to assume title to any or all sewers, easements and appurtenances by a Resolution of its Board of Trustees whenever, in the opinion of Counsel, no person competent to convey title can be found, and upon the recommendation of the Executive Director that the District should assume title and thereafter operate and maintain such sewers and appurtenances for the necessary and proper carrying out of the purpose of the District. Section Two. By reason of the immediate necessity of bringing such sewers under the maintenance and control of the District in order to protect the public health, an emergency exists within the meaning of the Plan of The Metropolitan St. Louis Sewer District and this Ordinance shall take effect immediately upon its enactment.
