HomeMy Public PortalAbout00091 O R D I N A N C E NO. 91 AN ORDINANCE declaring the necessity for the acquisition of easements within certain existing property within The Metropolitan St. Louis Sewer District, for the purpose of permitting construction of sewers therein to serve the needs of residents on lands within the Maline Creek Trunk Subdistrict of The Metropolitan St. Louis Sewer District and authorizing the institution of condemnation proceedings in connection therewith, with an emergency clause; WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area known as The Maline Creek Trunk Subdistrict of The Metropolitan St. Louis Sewer District, lying within St. Louis County, Missouri, and in which there work and live numerous people; and WHEREAS, sewage gathered from such area has no alternative means of disposition to crossing said property and constitutes a menace to public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health by relieving and alleviating these conditions; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. ln order to protect the public health and relieve the aforesaid insanitary and dangerous conditions, it is 2 necessary to appropriate and acquire by the exercise of eminent domain or otherwise, easements for the use of sewers as herein- after set forth, together with such working space adjacent to the right-of-way as obtained as may be required for working room during the construction period: An easement fifteen feet in width across property now or formerly of Chevron Sportswear Co. in U. S. Survey 111, Town- ship 46 North, Range 7 East, St. Louis County, Missouri, the south line of which easement is described as follows: Beginning at a point on the west line of said Chevron Sportswear Co. property, being also the east line of Twill Court No. 2, a Subdivision of St. Louis County, Missouri, as recorded in Plat Book 52 Page 22 of the St. Louis County Records, which point is 183.83 feet south of the northeast corner of said Twill Court No. 2; thence northeastwardly to a point on the southwardly extension of the west line of Bissell Hills No. 8 First Addition, a Subdivision of St. Louis County, Missouri, as recorded in Plat Book 60, Page 39 of the St. Louis County Records, which point is 200 feet south of the south line of the St. Louis Belt and Terminal Railroad Right-of-Way 100 feet wide, which is also the north line of said Chevron Sportswear Co. property; thence eastwardly along a line parallel with and 200 feet south from the aforesaid north line of Chevron Sportswear Co. property which is also the south line of the said St. Louis Belt and 3 Terminal Railroad Right-of-Way a distance of 881.91 feet to a point on curve; thence on curve to the right with a radius of 300 feet to its intersection with the west line of a ten foot easement which west line is described as follows: Beginning at a point on the south line of said Chevron Sportswear Co. property, which is the south line of U. S. Survey 111 and also the north line of St. Cyr Hills No. 2, a subdivision of St. Louis County, Missouri, as recorded in Plat Book 66, Page 9 of the St. Louis County Records, which point is fifty feet west of the northeast corner of said subdivision; thence north along a line parallel with the east line of said U. S. Survey 111,a distance of approximately 610 feet to its intersection with the south line of the aforesaid 15 foot easement. An easement ten feet in width across property now or formerly of Chevron Sportswear Co. in U. S. Survey 111, Town- ship 46 North Range 7 East, which easement closes with and is a continuation of the previously described fifteen foot wide easement in the aforesaid Chevron Sportswear Co. Property, the west line of which ten foot easement is described as follows: Beginning at a point on the south line of said Chevron Sportswear Co. property, which is the South line of U. S. Survey 111 and also the north line of St. Cyr Hills No. 2, a subdivision of St. Louis County, Missouri, as recorded in 4 Plat Book 66, Page 9 of the St. Louis County Records, which point is fifty feet west of the northeast corner of said subdivision; thence north along a line parallel with the east line of said U. S. Survey 111, a distance of approximately 610 feet to its intersection with the south line of the aforesaid 15 foot easement. The above described easements comprise approximately 5/8 of an acre. An easement fifteen feet in width across the property now or formerly of Chevron Sportswear Co., in U. S. Survey 3 and Fractional Section 9, Township 46 North, Range 7 East, the south line of which easement is described as follows: Beginning at the southwesterly corner of said property, which corner is also the northeast corner of the intersection of Bellefontaine Road 60 feet wide and St. Cyr Road, 60 feet wide; thence eastwardly to a point which is 245 feet easterly from said southwest corner of such property, measured along the north line of St. Cyr Road and 25 feet northerly there- from measured at right angles thereto; thence eastwardly along a line 25 feet from and parallel with said north line of St. Cyr Road, 200 feet more or less to its point of inter- section with the east line of said Chevron Sportswear Co. property and being approximately 1/8 acre. An easement fifteen feet in width across the property now or formerly of Chevron Sportswear Co. in U. S. Survey 111, 5 Township 46 North, Range 7 East in St. Louis County, Missouri, the eastern and northern lines of which are described as follows: Beginning at a point on the south line of property now or formerly of Chevron Sportswear Co. and on the common line be- tween U. S. Surveys 111 and 1913, said point being 200 feet west of the southeast corner of said U. S. Survey 111; thence north 200 feet westerly from and parallel with the east line of said U. S. Survey 111, a distance of 678.14 feet to a point; thence northwestwardly along a line 28Ε 00' to the left a distance of 300 feet more or less to the north boundary of said Chevron Sportswear Co. property, which is also the south boundary of the St. Louis Belt and Terminal Railroad Company right-of-way 100 feet wide; thence westwardly along the line common to said Chevron Sportswear Co. property and St. Louis Belt and Terminal Railroad right- of-way 100 feet wide, a distance of 1480 feet more or less to the west boundary of said Chevron Sportswear Co. property, being also the east boundary of property now or formerly of the Trustees of the North Side Christian Church, said easement being an area of approximately 7/8 of an acre. An easement 75 feet in width across property now or formerly of Chevron Sportswear Co. in U. S. Survey 111, Township 46 North, Range 7 East in St. Louis County, Missouri, the centerline of which easement is described as follows: 6 Beginning at a point 385 feet west of, measured at right angles to, the east boundary of said U. S. Survey 111 in Township 46 North, Range 7 East and 195 feet south of, measured at right angles to, the north boundary of said Chevron Sportswear Co. property, which is the south boundary of the St. Louis Belt and Terminal Railroad Right-of-Way 100 feet wide; thence northwestwardly 175 feet more or less to a point which is 540 feet west of, measured at right angles to, the east boundary of said U. S Survey 111 and 110 feet south of, measured at right angles to, said south boundary of St. Louis Belt and Terminal Railroad Right-of-Way; thence westwardly a distance of 900 feet more or less to a point 150 feet east of, measured at right angles to, the west line of aforesaid Bissell Hills No. 8 Subdivision extended southwardly, and being 85 feet south of, measured at right angles to, said St. Louis Belt and Terminal Railroad Right- of-Way; said easement being an area of approximately 1-3/4 acres. An easement in property now or formerly of Frederick C. Moore and Catherine Moore, his wife, in U. S. Survey 111, Township 46 North, Range 7 East, in St. Louis County, Missouri, said easement being more particularly described as follows: Beginning at a point on the easterly line of the said property now or formerly of Frederick C. Moore and Catherine Moore, his wife, which is also the west line of U. S. Highway 7 67, 200 feet wide, which point is 77.36 feet measured southwardly along said line from the northeast corner of said property; thence North 66Ε 56-3/4' West 341.5 feet to a point; thence South 72Ε 20' West 66.5 feet more or less to a point in the westerly line of said Moore property, which is also the easterly line of Northfield Gardens No. 2 Subdivision; thence southwardly along the said westerly line of the Moore property and said easterly subdivision line a distance of 44.5 feet to a point; thence North 72Ε 20' East a distance of 108 feet more or less to its intersection with a line parallel with and 15 feet southwardly from the first previously described easement line 341.5 feet long; thence South 66Ε 56-3/4' East along a line parallel with and 15 feet south from the first previously described easement line 341.5 feet long, 303 feet more or less to the east line of said Moore property which is the west line of said U. S. Highway 67; thence northwardly along said east line of said Moore property to the point of beginning; said easement being an area of approximately 1/5 acre. Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to institute and prosecute an action in condemnation pursuant to the provisions of the Plan of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri, for the appropriation of private property as hereinbefore set out. 8 Section Three. The immediate construction of sewers being necessary in order to protect the public health within the District constitutes an emergency within the meaning of the Plan of The Metropolitan St. Louis Sewer District and this Ordinance shall take effect immediately upon its adoption. The foregoing Ordinance was adopted July 23, 1956.
