HomeMy Public PortalAbout00143 O R D I N A N C E NO. 143 AN ORDINANCE authorizing and directing the Executive Director to Quit-Claim certain real estate in St. Louis County, Missouri, contiguous to the sewage disposal plant formerly of the City of Oakland, and to execute a quit-claim deed upon the conditions herein set out. WHEREAS, pursuant to the Plan of The Metropolitan St. Louis Sewer District and by Resolution No. 6 of the District, adopted July 1, 1954 and recorded in Book 3286, Page 90 of the St. Louis County Records, the District took title for its use and possession to a sewage treatment plant formerly of the City of Oakland, situated in St. Louis County, and known as the "City of Oakland Treatment Plant"; and WHEREAS, part of the tract of land theretofore reserved by the City of Oakland for said plant was not then used, and had not for years been used, in connection with the operation of said plant, and such part of said tract was improved prior to said transfer of title as residential property and had been used ever since for residential purposes; and WHEREAS, the City of Oakland has requested the District to quit-claim said part of such tract and certain easements for ingress and egress appurtenant to said part of such tract; and the District is willing so to do upon the condition herein set out. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The District, upon condition that the 2 District shall not be held liable to the City of Oakland for any conditions arising out of the operation of the treatment plant on the contiguous property, and provided that the District reserves an easement for the maintenance of the present water line serving said plant and the house water line on the property conveyed be disconnected from the existing water line, does hereby Remise, Release and forever Quit-Claim any right, title or interest in or to the following described real estate, situated in the County of St. Louis and State of Missouri, to wit: Part of Lot 25 of CLOVER HILL, a subdivision in St. Louis County, Missouri, according to the plat thereof recorded in Plat Book 6, page 18 of the St. Louis County Records, and being more particularly described as follows, to wit: Beginning at an old iron rod at the southeast corner of property conveyed to the City of Oakland by deed recorded in Deed Book 1452, page 515 of the St. Louis County Records; thence along the east line of said property so conveyed, N. 37Ε 53' W., 108 feet to a point; thence S.52Ε 07' W., 90.18 feet to a point; thence S. 37Ε 53' E., 108 feet to an old iron rod in the south line of property conveyed to the City of Oakland as aforesaid, being also the northeast corner of Lot 10 in Block 8 of CLOVER HILL SUBDIVISION AMENDED PLAT NO. 2; said lot 10 to be used for street purposes only, as recorded in Deed Book 1449, page 592; thence along said south line, N. 52Ε 07' E., 90.18 feet to the point of beginning. Also, an easement, 40 feet 3 wide, is hereby granted for purposes of ingress and egress, over Lot 10 in Block 8 of CLOVER HILL SUBDIVISION AMENDED PLAT No. 2. Also, an easement, 40 feet wide, is hereby granted for purposes of ingress and egress, over part of Lot 25 of CLOVER HILL SUBDIVISION, the east line of said easement being the west line of the above described property. Section Two. The Executive Director is hereby authorized and directed to execute in behalf of the District a Deed giving effect to Section One hereof. 4 The foregoing Ordinance was adopted July 29, 1957.
