HomeMy Public PortalAbout00190 O R D I N A N C E NO. 190 AN ORDINANCE extending the boundaries of Subdistrict No. Four of the River des Peres Watershed (North Affton) of The Metropolitan St. Louis Sewer District to include a contiguous area of land in St. Louis County, Missouri, being a portion of a tract of ground conveyed to Lake Park Corporation by Warranty Deed recorded in Book 3588, Page 146 of the St. Louis County Records. WHEREAS, the Board of Trustees has received a petition praying for annexation to Subdistrict No. Four of the River des Peres Watershed (North Affton) of The Metropolitan St. Louis Sewer District of a contiguous area of land bounded as set forth in the petition, and WHEREAS, such petition was signed by all of the owners of land in said area, who are also the holders of legal title to a freehold interest in all of the land therein, and WHEREAS, such area of land is capable of being efficiently served by the sewers of such Subdistrict No. Four, and WHEREAS, since creation of Subdistrict No. Four, land included in such area proposed to be annexed has been reclassified from cemetery use to residential use, has been subdivided accordingly, is being so developed, and the developers propose to provide at their own expense sewerage for such area and an outfall sewer therefrom to connect with and use the Subdistrict No. Four sewers, and WHEREAS, those of the petitioners who are not exempt by 2 law from general taxation have offered as a condition of annexation to pay by taxation from the date of annexation their proportionate shares of the costs of servicing and retiring the presently outstanding Subdistrict No. Four general obligation bonds and to pay individually upon demand such sums as may be required to place them in equality with the other Subdistrict No. Four taxpayers as of the date of annexation, and WHEREAS, the Board of Trustees finds that the granting of the petitioners' prayer would be beneficial to the present taxpayers of Subdistrict No. Four, by reason of the sharing of taxes by the petitioners, and would in no way be injurious to them, since the Subdistrict No. Four sewers were designed with sufficient capacity to serve this additional area, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The corporate boundaries of Subdistrict No. Four of the River des Peres Watershed (North Affton) of The Metropolitan St. Louis Sewer District are hereby declared to be extended to include the area of land described as follows: Beginning at the intersection of the East line of MacKenzie Road with the direct Westward prolongation of the South line of Block 39 of Lakewood, a subdivision, according to the record plat thereof, as recorded in Plat Book 6, pages 24 and 25, of the St. Louis County Records; thence Northwardly along the East line of MacKenzie 3 Road, a distance of 1303.47 feet to a point; thence Eastwardly along a line which is perpendicular to the East line of MacKenzie Road, a distance of 1515 feet to a point; thence Southwardly along a line which is parallel to the East line of MacKenzie Road, a distance of 1310.08 feet, to a point on a line which is the direct Westward prolongation of the South line of said Block 39 of Lakewood; thence Westwardly along said direct Westward prolongation, a distance of 1515 feet to the point of beginning. Section Two. The land area annexed by Section One and the owners therein shall share in all of the rights and privileges enjoyed by all land and the owners thereof within Subdistrict No. Four of tho River des Peres Watershed (North Affton) of The Metropolitan St. Louis Sewer District and shall be subject to all lawful duties and obligations of all land and the owners thereof within such Subdistrict. Section Three. The said petition for annexation together with a certified copy of this ordinance shall be filed of record in the Office of the Recorder of Deeds of St. Louis County, Missouri, and appropriate notice thereof shall be given to the County Clerk, Assessor and Collector. 4 The foregoing Ordinance was adopted April 7, 1958.
