AN ORDINANCE authorizing and directing the Executive
Director to Quit-Claim certain real property in St. Louis County,
Missouri, to the State of Missouri, and to execute a quit-claim
deed upon the conditions herein set out.
WHEREAS, by instruments dated the 29th day of September,
1956, and the 23rd day of April, 1958, the Trustees of Edmundson
Terrace conveyed and quit-claimed a certain tract of land of such
Edmundson Terrace Subdivision, which contained sewage treatment
facilities therefor, to The Metropolitan St. Louis Sewer District,
and
WHEREAS, the said State of Missouri will build a sanitary
sewer line connecting the sewers of said subdivision to a public
sewer in the Airport property, by-passing and rendering unnecessary
the aforesaid sewage treatment facilities, and
WHEREAS, The Metropolitan St. Louis Sewer District has no
further use for said property and the said State of Missouri wishes
to use said property as part of its right-of-way for the widening
of Natural Bridge Road, and has requested this District to grant it
the aforesaid property,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The District, upon the condition that it
reserves an easement for sewer purposes over the said property,
does hereby Remise, Release and forever Quit-Claim to the State of
Missouri any right, title or interest in or to the following
described real property, situated in the County of St. Louis and
State of Missouri, to wit:
A parcel of land in U. S. Survey 168, Township 46 North,
Range 6 East, in St. Louis County, Missouri as conveyed to The
Metropolitan St. Louis Sewer District by instruments dated the
29th day of September, 1956 and the 23rd day of April, 1958,
and recorded on May 6th, 1958 as Daily No. 23 and Daily No.
24, respectively, of the St. Louis County Records, reserving,
however, an easement for sewer purposes over said parcel of
land.
Section Two. The Executive Director is hereby authorized
and directed to execute in behalf of the District a Deed
giving effect to Section One hereof.
The foregoing Ordinance was adopted June 25, 1958.
