HomeMy Public PortalAbout00234 O R D I N A N C E NO. 234 AN ORDINANCE declaring the necessity for the ac- quisition of easements within certain existing property within The Metropolitan St. Louis Sewer District, for the purpose of permitting construction of sewers therein to serve the needs of residents on lands within Special Benefit Subdistrict No. 26 (Charjean Drive) of The Metropolitan St. Louis Sewer District and authorizing the institution of condemnation proceedings in connection therewith, with an emergency clause; WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area known as Special Benefit Subdistrict No. 26 (CharJean Drive) of The Metropolitan St. Louis Sewer District, lying within St. Louis County, Missouri, and in which there work and live numerous people; and WHEREAS, sewage gathered from such area has no alternative means of disposition to crossing said property and constitutes a menace to public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health by relieving and alleviating these conditions; 2 Ord. No. 234 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. In order to protect the public health and relieve the aforesaid insanitary and dangerous conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or otherwise, easements for the use of sewers as hereinafter set forth, together with such working space adjacent to the right-of-way as obtained as may be required for working room during the construction period, and the right of ingress and egress over the premises sought to be condemned for the access to such easements: An easement five (5) feet in width across property now or formerly of CLESTON O. GRIFFITH and CATHERINE GRIFFITH, his wife, in Lot 42 of East Ashby No. 2, a Subdivision of St. Louis County, Missouri, according to the plat thereof recorded in Plat Book 13, page 70 of the St. Louis County Records, described as follows: The north five (5) feet of Lot 42 of aforesaid subdivision. An easement five (5) feet in width across property now or formerly of ROBERT D. CURRIE and AMANDA CURRIE, his wife, in part of Lot 5 of East Ashby No. 2, a Subdivision of St. Louis County, Missouri, according to the plat thereof recorded in Plat Book 13, page 70 of the St. Louis County Records, described as 3 follows: The south 98.43 feet of the west five (5) feet of Lot 5 of aforesaid subdivision. An easement five (5) feet in width across property now or formerly of OWEN B. McBEE and ANGELINE E. McBEE, his wife, in Lot 10 of Marion, a Subdivision of St. Louis County, Missouri, according to the plat thereof recorded in Plat Book 15, page 33 of the St. Louis County Records, described as follows: The south five (5) feet of Lot 10 of aforesaid subdivision. An easement five (5) feet in width across property now or formerly of CLYDE KEATON and MARGARET C. KEATON, his wife, in part of Lot 13 of North Ashby, a Subdivision of St. Louis County, Missouri, according to the plat thereof recorded in Plat Book 9, page 54 of the St. Louis County Records, described as follows: Beginning at a point 200 feet north of the southwest corner of said Lot 13, which point is on the west line of said Lot 13; thence eastwardly at right angles a distance of 84 feet to a point; thence southwardly at right angles a distance of 5 feet to a point; thence westwardly at right angles a distance of 84 feet to the aforesaid west line of Lot 13; thence north 5 feet to the point of beginning. An easement five (5) feet in width across property now or formerly of CLYDE KEATON and MARGARET C. KEATON, his wife, in part of Lot 13 of North Ashby, a Subdivision of St. Louis County, 4 Missouri, according to the plat thereof recorded in Plat Book 9, page 54 of the St. Louis County Records, described as follows: Beginning at a point 200 feet north of the south line of aforesaid Lot 13, measured at right angles thereto, and 84 feet east of the west line of aforesaid Lot 13, measured at right angles thereto; thence westwardly,along a line parallel with the said south line of Lot 13, a distance of 42 feet to a point; thence northwardly, at right angles, a distance of 5 feet to a point; thence eastwardly, along a line parallel with aforesaid south line of Lot 13, a distance of 42 feet to a point; thence southwardly a distance of 5 feet to the point of beginning. Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to institute and prosecute an action in condemnation pursuant to the provisions of the Plan of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri, for the appropriation of private property as hereinbefore set out. Section Three. The immediate construction of sewers being necessary in order to protect the public health within the District constitutes an emergency within the meaning of the Plan of the Metropolitan St. Louis Sewer District and this Ordinance shall take effect immediately upon its adoption. 5 The foregoing Ordinance was adopted September 18, 1958.
