AN Ordinance declaring the necessity for the acquisi-
tion of easements within certain existing property within The
Metropolitan St. Louis Sewer District, for the purpose of
permitting construction of sewers therein to serve the needs of
residents on lands within Subdistrict Number One of the River des
Peres Watershed of The Metropolitan St. Louis Sewer District
(Creve Coeur-Frontenac area), and authorizing the institution of
condemnation proceedings in connection therewith, with an
emergency clause;
WHEREAS, there exists within The Metropolitan St. Louis
Sewer District an area known as Subdistrict Number One of the
River des Peres Watershed of The Metropolitan St. Louis Sewer
District (Creve Coeur-Frontenac area), lying within St. Louis
County, Missouri, and in which there work and live numerous
people; and
WHEREAS, sewage gathered from such area has no
alternative means of disposition to crossing said property and
constitutes a menace to public health and welfare of the general
public and the residents of The Metropolitan St. Louis Sewer
District; and
WHEREAS, it is the purpose and design of The Metro-
politan St. Louis Sewer District to protect the public health by
relieving and alleviating these conditions;

NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. In order to protect the public health and
relieve the aforesaid insanitary and dangerous conditions, it is
necessary to appropriate and acquire by the exercise of eminent
domain or otherwise, easements for the use of sewers as hereinafter
set forth, together with such working space adjacent to the right-
of-way as obtained as may be required for working room during the
construction period, and the right of ingress and egress over the
premises sought to be condemned for the access to such easements:
An easement ten feet in width across property now or
formerly of Mary Dielmann, a widow of Louis Phillipp Dielmann, a
tract of land in southeast quarter of the southwest quarter of
Section 1, Township 45 North, Range 5 East, City of Creve Coeur,
St. Louis County, Missouri, described as follows: Beginning at a
point on the West line of Lindbergh Boulevard, 100 feet wide, said
point being the Northeast corner of Quailways Subdivision, thence
West along said Quailways Subdivision North line 1396.76 feet to a
concrete monument on the East line Spoede Meadows Subdivision,
thence North along the east line of Spoede Meadows Subdivision, a
distance of 696.3 feet to an old stone on the South line of
Sunswept Subdivision No. 1, thence eastwardly along the south line
of Sunswept Subdivision No. 1 a distance of 1404.94 feet, thence
southwardly along the east line of Lindbergh Boulevard 689 feet

more or less to a point of beginning. The center line of said ten
foot easement is described as follows:
Beginning at a point on the South line of Dielmann
property 148.58 feet east of the southwest corner, thence North at
an angle 94o20' a distance of 345.23 felt, thence to the right at
an angle 4o38' a distance of 355 feet more or less to a point in
the North line of said Dielmann property said point being 222.58
feet from the northwest corner thereof.
An easement ten feet in width across property now or
formerly of Richard S. Deglman and Martha Deglman, his wife, in Lot
3, Ingleside No. 2 Subdivision as recorded in Plat Book 74, Page 5
of the St. Louis County Records, the center line of which is
described as follows:
Beginning at a point on the South line of Lot 3 of
Ingleside No. 2 Subdivision, 36.20 feet from the southwest corner,
thence northwesterly at an angle of 60o30' a distance of 92 feet
more or less to a point on the West line of said lot, said point
being 81.25 feet from the southwest corner thereof.
An easement ten feet in width across property now or
formerly of Gus Bienvenu and Amy de Fuentes Bienvenu, his wife, in
Lot 2, Ingleside No. 2 Subdivision as recorded in Plat Book 74,
Page 5 of the St. Louis County Records, the center line of which is
described as follows:
Beginning at a point on the South line of Lot 2,
Ingleside No. 2 Subdivision, 274.21 feet from the southeast corner

of said lot, thence northwesterly at an angle of 60o30' a distance
of 122 feet more or less to a point on the North line of said lot,
said point being 36.20 feet from the northwest corner thereof.
Section Two. Counsel for The Metropolitan St. Louis
Sewer District-be and is hereby authorized to institute and
prosecute an action in condemnation pursuant to the provisions of
the Plan of The Metropolitan St. Louis Sewer District and the laws
of the State of Missouri, for the appropriation of private property
as hereinbefore set out.
Section Three. The immediate construction of sewers
being necessary in order to protect the public health within the
District constitutes an emergency within the meaning of the Plan of
The Metropolitan St. Louis Sewer District and this Ordinance shall
take effect immediately upon its adoption.
The foregoing Ordinance was adopted October 22, 1958
