HomeMy Public PortalAbout00276 O R D I N A N C E NO. 276 AN ORDINANCE authorizing and directing the Executive Director to grant an easement in St. Louis County, Missouri, over a parcel of land known as the "Coldwater Creek Right of Way", formerly of Drainage District No. 2-A, and to execute an easement upon the conditions herein set out. WHEREAS, pursuant to the Plan of The Metropolitan St. Louis Sewer District and by Resolution No. 6 of the District, adopted July 1, 1954 and recorded in Book 3286, Page 90 of the St. Louis County Records, the District took title for its use and possession to the Coldwater Creek Right of Way formerly of Drainage District No. 2-A, situated in St. Louis County; and WHEREAS, the State of Missouri wishes to cross said Right of Way with a highway; and WHEREAS, the State of Missouri has requested the District grant an easement across said tract, and the District is willing so to do; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Ord. No. 276 Section One. The District does hereby grant an easement for highway purposes across the following described real estate, situated in the County of St. Louis and State of Missouri, to wit: A parcel of land in Surveys 146 and 147 of the Common Fields of St. Ferdinand in Township 47 North, Range 6 East, St. Louis County, Missouri, being all that part of a parcel of land 100 feet wide, heretofore conveyed to Drainage District No. 2-A of St. Louis County (also known as Cold Water Creek Drainage District); the centerline of which is described as beginning at a point on the South line of existing State Highway 66, distant 365.19 feet South 81 degrees 00 minutes East from the point of intersection of said Highway line with the line between Surveys 146 and 147; thence South 31 degrees 55 minutes West, 89.03 feet to the intersection with the centerline of Interstate Highway 270 at its Station 290/80; thence continuing South 31 degrees 55 minutes West, 204.11 feet to a point 270 feet perpendicular distance South of the South line of said Highway 66. Said parcel being bounded on the North by the South line of said Highway 66 (100 feet wide), and bounded on the South by a line 270 feet from and parallel with said South Highway line, containing 0.67 of an acre, more or less. Section Two. The Executive Director is hereby authorized and directed to execute in behalf of the District an easement giving effect to Section One hereof. The foregoing Ordinance was adopted on April 9, 1959.
