AN ORDINANCE authorizing the Executive Director to
award a contract for emergency repairs to the Maline Creek
sanitary trunk sewer East of Bellefontaine Road, with an emergency
clause.
WHEREAS, ground slides have caused extensive damage to
the Maline Creek sanitary trunk sewer East of Bellefontaine Road
and immediate steps must be taken to prevent further damage and to
protect the public health, and welfare, and
WHEREAS, it is estimated that the repair of such sewer
if made immediately at an estimated cost not to exceed Sixty
Thousand Dollars ($60,000.00) can arrest the sliding condition and
prevent further damage which would be costly to the District, and
WHEREAS this repair will be designed to arrest and
correct the condition which has recently occurred and would
otherwise continue to grow more serious, and
WHEREAS, Ordinance No. 164, as amended, provides that
emergency work requiring prompt attention may be undertaken by the
Executive Director by contract without the delay occasioned by
advertisement for bids, PROVIDED, however, that the probable cost
thereof, does not exceed Twenty Thousand Dollars ($20,000.00); and
WHEREAS, the Executive Director has determined that
work on the Maline Creek sanitary trunk sewer East of
Bellefontaine Road to correct the effects of such slides should be
undertaken immediately as an emergency measure, and that
sufficient unencumbered funds therefor are available in the
Improvement Fund, Maline Creek Trunk Repair Account (Account No.
2-5015),
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. Repair construction on the Maline Creek
sanitary trunk sewer East of Bellefontaine Road to correct
conditions caused by ground slide is hereby declared to be an
emergency within the meaning of the Plan, and the Executive
Director is hereby authorized and instructed to proceed with such
repairs on an emergency basis.
Section Two. The Executive Director is hereby
authorized and instructed to solicit bids from responsible
contractors and, when not less than three such bids, in writing,
have been received may enter into a contract for such repair work
with the lowest responsible bidder, on the basis of unit price for
materials in place. The Executive Director, at the next meeting
of the Board of Trustees after letting such contract, shall
furnish to the Board a full explanation of the facts and
circumstances of the invitations for bids and the results thereof,
and the Secretary-Treasurer shall record the same in the Journal
of the Board.
Section Three. This Ordinance is an exception to
Ordinance No. 164, as amended, and nothing herein shall be
construed as affecting or changing the provisions thereof, save
and except this single instance.
Section Four. This Ordinance, being for the purpose of
authorizing the Executive Director to make emergency repairs to a
sanitary trunk sewer for the protection of the public health and
welfare, constitutes an emergency within the meaning of the Plan,
and this Ordinance shall be and become effective immediately upon
its adoption.
