AN ORDINANCE vacating a road easement in St.
Louis County, Missouri;
WHEREAS, by Instrument dated May 19, 1939, and recorded
in Book 1622, page 386 of the St. Louis County Records, the then
owners of the subject real property granted the Affton Sanitary
Sewer District, its successors and assigns, an easement for
roadway purposes to the said Sewer District's sewer treatment
plant; and
WHEREAS, by terms of the aforesaid instrument, if other
means of access are provided to said plant by the establishment of
an improved public road, then the easement as granted was to
become null and void; and
WHEREAS, the present owners of the aforesaid land have
constructed a concrete street or roadway, known as Tiber Drive,
which provides access to aforesaid treatment plant, and which
Tiber Drive has been dedicated to St. Louis County as a public
road; and
WHEREAS, the present owners of subject property have
requested this District, as successor and assign of the Affton
Sanitary Sewer District to vacate the roadway easement as granted
by aforesaid Instrument;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The following described portion of roadway
easement is hereby vacated:
That easement for roadway purposes granted to the Affton Sanitary
Sewer District by Instrument dated the 19th day of May,
1939, and recorded in Book 1622, page 386 of the St.
Louis County Records.
The foregoing Ordinance was adopted on August 27, 1959.
