AN ORDINANCE authorizing and directing the Executive
Director to grant an easement in the City of St. Louis, Missouri,
over a parcel of land known as the "River des Peres Right of Way",
formerly of the City of St. Louis, and to execute an easement upon
the conditions herein set out.
WHEREAS, pursuant to the Plan of The Metropolitan St.
Louis Sewer District and by Resolution No. 6 of the District,
adopted July 1, 1954 and recorded in Book 7407, Page 596 of the
City of St. Louis Records, the District took title for its use and
possession to the River des Peres Right of Way formerly of the
City of St. Louis and situated in the City of St. Louis, and
WHEREAS, the Laclede Gas Company wishes to build and
maintain a pipeline along the south side thereof; and
WHEREAS, the Laclede Gas Company has requested the
District grant an easement along said tract, and the District is
willing so to do;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The District does hereby grant an easement
for pipeline purposes over the south ten (10) feet of the River
des Peres Right of Way in the City of St. Louis, Missouri,
beginning at the east line of Broadway, a city street, and ex-
tending eastwardly a distance of 1770 feet, together with such
additional space adjacent to such easement as may be required for
working room during the construction period and full ingress and
egress, subject, however, to the following terms and reservations:
The Metropolitan St. Louis Sewer District reserves the
right to use such easement for roadway and sewer and drainage
purposes, including the right to construct sewers and
appurtenances therein, or for access to its Right-of-Way.
The Laclede Gas Company will make the initial installa-
tion and any subsequent repair with the minimum disturbance to the
drainage works, and will restore the site to its original
condition, all at its sole cost.
The Laclede Gas Company will indemnify, hold harmless
and defend The Metropolitan St. Louis Sewer District against all
liability, expense, loss or damages arising out of the
construction, maintenance or use of such pipeline or pipelines and
easement.
At such time as the Laclede Gas Company ceases to use
such easement, all rights as granted therein shall cease and
determine automatically.
Section Two. The Executive Director is hereby
authorized and directed to execute in behalf of the District an
easement giving effect to Section One hereof. The foregoing Ordinance was adopted September 28, 1959.
