AN ORDINANCE authorizing and directing the Executive
Director to Quit-Claim certain real estate in St. Louis County,
Missouri, formerly containing a sewage disposal plant known as the
"Sugar Creek Plant", formerly of the City of Kirkwood, and to
execute a quit-claim deed upon the conditions herein set out.
WHEREAS, pursuant to the Plan of The Metropolitan St.
Louis Sewer District and by Resolution No. 6 of the District,
adopted July 1, 1954 and recorded in Book 3286, Page 90 of The St.
Louis County Records, the District took title for its use and
possession to a sewage treatment plant tract formerly of the City
of Kirkwood, situated in St. Louis County, and known as the "Sugar
Creek Treatment Plant"; and
WHEREAS, the tract of land theretofore reserved by the
City of Kirkwood for said plant was not then used, and had not for
years been used, in connection with the operation of said plant;
and
WHEREAS, the City of Kirkwood has requested the
District to quit-claim said tract, and has offered to quitclaim to
the District two other tracts of land, and the District is
desirous of accepting such quit-claim deeds from the City and is
willing to quit-claim the aforesaid Sugar Creek Treatment Plant
tract to the City;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The District does hereby Remise, Release
and forever Quit-Claim any right, title or interest in or to the
following described real estate, situated in the County of St.
Louis and State of Missouri, to wit:
A tract of land in the Southeast 1/4 of the Northwest
1/4 of Section 2 Township 44 North Range 5 East in St. Louis
County, Missouri, described as:
Beginning at a point in the South line of Sugar Creek
Road, as the same was relocated and widened by deed recorded in
Book 1212 Page 81 at its intersection with the West line of a
tract of land conveyed to Martin E. Sauer and Augusta Sauer, his
wife, by deed recorded in Book 262, Page 505 of the St. Louis
County Records, thence along the West line of tract so conveyed by
deed recorded in Book 262, Page 505, South 1 degree 05 minutes
East 134.5 feet to a point, thence East at right angles to said
West line 150 feet to a point, thence North 1 degree 05 minutes
West 131.1 feet to a point in the South line of said Sugar Creek
Road and thence West along said South line of Sugar Creek Road to
the beginning, containing 0.44 acres.
Section Two. The Executive Director is hereby
authorized and directed to execute in behalf of the District a
Deed giving effect to Section One hereof.
