AN ORDINANCE vacating an existing sewer and easement in
the City of St. Louis, Missouri, with suitable provisions for
maintenance and connection rights.
WHEREAS, the owner of the property in which subject
easement and sewer lie has requested the District to vacate said
easement and sewer and has offered to maintain said sewer as a
private sewer, and
WHEREAS, the District finds that said owner owns all
the property abutting said sewer and that no other property could
readily be served by such sewer, and therefore the public has no
need of such sewer or easement,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
1. The hereinafter described sewer easement and 15 inch
diameter pipe sewer lying therein are hereby vacated and
abandoned to the owner of the surrounding property subject,
however, to the condition that the owner agrees to maintain such
sewer in proper fashion, and to allow the free connection thereto
by any permittee of this District or its successorsand assigns:
That easement reserved by the City of St. Louis for The
Metropolitan St. Louis Sewer District for sewer
purposes by Ordinance No. 48,142 approved December 26,
1956, vacating the north-south alley in City Block
1899, which alley extended from the southern line of
the northern east and west alley to the northern line
of the southern east and west alley in said City Block.
The foregoing Ordinance was adopted December 17, 1959
