AN ORDINANCE, transferring the sum of Eighty-five
Thousand Dollars ($85,000.00) from the Improvement Fund to the
General Fund and appropriating the same sum from the General Fund
as an advancement for the completion of the sixty-inch trunk sewer
of the Maline Creek Trunk Subdistrict.
WHEREAS, the sum of Sixty Thousand Dollars ($60,000.00)
set apart out of the General Fund by Ordinance No. 122 as a
guarantee fund has been released by final disposition of the
injunction suit referred to in such ordinance and said sum is held
in the Improvement Fund and is repayable to the General Fund, and
WHEREAS, by adoption of Resolution No. 33 the Board of
Trustees declared the necessity of constructing a sanitary trunk
sewer in the Maline Creek Trunk Subdistrict, the cost to be paid
from the proceeds of general obligation bond, and
WHEREAS, the cost of completing such trunk sewer will
exceed the proceeds of said bonds in an amount estimated not to
exceed Eighty-five Thousand Dollars ($85,000.00), and it is
necessary in the interest of the public health that such trunk
sewer be completed and that the District advance funds for that
purpose, and
WHEREAS, the sum of Twenty-five Thousand Dollars
($25,000.00) is available for improvements as a part of the
unappropriated and unencumbered balance in the Improvement Fund,
in addition to the aforesaid guarantee fund now released,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Eighty-five Thousand Dollars
($85,000.00) is hereby set apart from the unappropriated and
unencumbered balance in the Improvement Fund and is hereby
transferred from the Improvement Fund to the General Fund;
provided, first, that of this sum Sixty-Thousand Dollars
($60,000.00) shall be in repayment to the General Fund of the
appropriation made in Ordinance No. 122 and, second, that the
remaining twenty-five Thousand Dollars ($25,000.00) shall
constitute a loan from the Improvement Fund.
Section Two. The sum of Eighty-five Thousand Dollars
($85,000.00) is hereby set apart out of the unappropriated surplus
in the General Fund established by Section One of this ordinance
and is hereby appropriated to the expenditure account in the
General Fund styled "Maline Creek Trunk Completion" (Account 1-
1099) as an advancement to be used for the completion of the
sixty-inch trunk sewer of the Maline Creek Trunk Subdistrict.
Section Three. Upon completion of said trunk sewer, any
remaining unencumbered balance of the appropriation made above in
Section Two shall revert automatically to the unappropriated
surplus of the General Fund and the same shall constitute a fund
for repayment of the Improvement Fund loan made in Section One of
this ordinance.
Section Four. This, being an appropriation ordinance,
shall take effect immediately upon its enactment.
