HomeMy Public PortalAbout00408 O R D I N A N C E NO. 408 AN ORDINANCE confirming a contract with The Davey Tree Expert Company, a corporation, for the chemical treatment of weeds and brush in and along the River des Peres right-of-way, with an emergency clause. BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The contract heretofore let by District Purchase Order No. 4630, dated May 31, 1960, to The Davey Tree Expert Company, a corporation, as the lowest responsible bidder, for the chemical treatment of weeds and brush in and along the River des Peres right-of-way, pursuant to bids received and opened on the 27th day of May, 1960, in the following form (SEE NEXT PAGE) Ord. 408 NOTICE TO PROSPECTIVE BIDDERS Bids for chemical treatment of Weeds and Brush on and along the right-of-way of the River Des Peres sewer will be received until May 1960 at the office of the METROPOLITAN ST. LOUIS SEWER DISTRICT, 901 Washington Avenue, St. Louis, Missouri. Bids shall be submitted in a sealed envelope addressed to the attention of Gerald W. Dwyer, Purchasing Agent, and plainly marked "Bid # for Weed and Brush Control Spray". All bids shall be based upon the Specifications hereto attached, which specifications describe the areas to be treated, materials to be used, equipment needed, liability and insurance protection required, bid deposit required, and the periods during which the work is to be performed. Bidders will submit lump sum bids to include all labor, equipment, materials and supervision for the completion of the work specified, and are expected to familiarize themselves with the physical conditions of the area to be treated. Bids will not be considered unless filled out in Ink or Typewriter and signed in Ink. The METROPOLITAN ST. LOUIS SEWER DISTRICT reserves the right to reject any or all bids. SPECIFICATIONS AND BID FORM A. LOCATION AND DESCRIPTION OF PROJECT. The area to be treated for weed and brush control is the River Des Peres Sewer Right-of-Way from point of emergence of Tubes to The Mississippi River, plus approximately 2600 ft. along both sides and bottom of the Rock Creek tributary, plus 700 ft. along both sides and bottom of Webster Groves Creek tributary, plus approximately 700 ft. along both sides and bottom of Deer Creek tributary. All of All of the area (both sides) between the channel, Toes of slopes and the right-of-way limits is to be treated. Width of top area to be treated on each side of the channel may vary from 40 ft. to 300 feet. The following areas are to be treated during the period June 1 - and Sept. 30, 1960, as indicated in Requisition #198, to- wit: a) All of the area along River Des Peres Row from Tubes to Mississippi. b) All of the 2600 ft. along Rock Creek branch. c) All of the 700 ft. along Webster Creek branch. d) All of the 700 ft. along Deer Creek branch. B. MATERIALS TO BE USED. Same as indicated on Requisition #198. All materials are to be supplied by the Contractor in new and unused drums with manufacturer's seals unbroken when delivered to the job. Samples of the materials shall be submitted for testing purposes on request by the METROPOLITAN ST. LOUIS SEWER DISTRICT. C. RATE OF APPLICATION. Sufficient solution to be applied to thoroughly wet all plant surfaces, including leaves and stems, to point of run-off. D. EQUIPMENT REQUIRED FOR APPLICATION. Power sprayers, truck or trailer-mounted, with tank capacity of at least 500 gallons; positive agitation, jet or mechanical, to insure uniformity of solution; with pressure regulators to provide range of 20 lbs. P.S.l to 150 lbs. P.S.l at nozzles. Part of the right-of-way to be treated is rough or soft and cannot be covered with standard two-wheel-drive equipment. Four-wheel-drive trucks, Dodge Power Wagon or equal, will be required for the treatment of those areas not accessible to standard truck equipment. E. PROTECTION OF ORNAMENTAL TREES, SHRUBS, ETC. Caution to be exercised to prevent spray drift from falling on any plantings of trees, plants or shrubs on property off the right-of-way, and also to protect any desirable ornamental plantings along or on the Sewer Right-of-Way. F. WEATHER CONDITIONS. No spraying to be done during rain or while moisture is dripping from foliage. Any area sprayed less than thirty (30) minutes prior to rain shall be resprayed, but not until thirty (30) minutes after moisture run-off has stopped. G. LIABILITY. Contractor shall be liable for any and all claims arising from injuries to employees of Contractor or injuries to any sub- contractor or employees of sub-contractor. Contractor shall also be liable for any injuries to employees of METROPOLITAN ST. LOUIS SEWER DISTRICT, or to third persons or to the public, or to property, caused by any act or omission of Contractor, its servants and agents or employees. Contractor shall indemnify and save harmless the METROPOLITAN ST. LOUIS SEWER DISTRICT from all loss, claims, damages or causes of action which may arise in connection with the performance of the work, or which may result from the work. Contractor's liability shall not terminate upon the completion and acceptance of the work, but, on the contrary, shall continue until such time thereafter as applicable limitation statutes shall have barred such causes of action. H. INSURANCE REQUIREMENTS. Contractor shall carry and maintain throughout the performance of the work, in a company or companies acceptable to the METROPOLITAN ST. LOUIS SEWER DISTRICT the following insurance: 1)Workmen's Compensation Insurance as required by the laws of the State of Missouri. 2)Contractor's Bodily Injury Liability with minimum limits of $100,000/300,000. 3)Owner's Protective Liability, Bodily Injury and Property Damage,with minimum: limits of $100,000/300,000, and $50,000. 4)Automotive Bodily Injury Liability with minimum limits of $100,000/300,000, and Automotive Property Damage Liability with minimum limits of $50,000 for each accident. Certificates indicating such insurance coverage shall be furnished to the METROPOLITAN ST. LOUIS SEWER DISTRICT upon request. I. INSPECTION. Work done by the Contractor shall be at all times subject to the inspection and approval of a designated representative of the METROPOLITAN ST. LOUIS SEWER DISTRICT. J. BID BOND ON DEPOSIT. A deposit in the form of a Bank Draft, Certified Check or an acceptable bond in the amount of ten percent (10%) of the total bid shall be made with the METROPOLITAN ST. LOUIS SEWER DISTRICT at the time the bid is submitted. Bid deposits of unsuccessful bidders will be returned as soon as the contract has been awarded to and accepted by the successful bidder. K. PERFORMANCE PERIOD. Work shall be carried out and completed as described in Section A. L. PAYMENT. Payments by the METROPOLITAN ST. LOUIS SEWER DISTRICT to the Contractor will be made as follows: 95% of total contract price within 30 days after completion of initial application, and 5% of total contract price within 30 days after completion of final application. B I D F O R M The Davey Tree Expert Company , a corporation xx; Name of Bidder Partnership___; individual___; (Check one) submit firm bid of Three thousand six hundred eighty and 00/100/100($ 3,680) for the performance of the work herein described. This bid includes all labor, equipment, material, supervision, and all applicable fees, taxes and permit costs. The need for killing weeds prior to their full growth and maturity of seeds constitutes an emergency within the meaning of the Plan, and this ordinance accordingly shall take effect immediately upon its enactment.
