AN ORDINANCE authorizing and directing the Executive
Director to Quit Claim a portion of certain real estate in St.
Louis County, Missouri, formerly containing a sewage disposal
plant know as the "Ferguson Treatment Plant", formerly of
the Ferguson Sewer District, and to execute a quit-claim deed
upon the conditions herein set out.
WHEREAS, pursuant to the Plan of The Metropolitan St.
Louis Sewer District and by Resolution No. 6 of the District,
adopted July 1, 1954 and recorded in Book 3286, Page 90 of
the St. Louis County Records, the District took title for its use
and possession to a sewage treatment plant tract formerly of the
Ferguson Sewer District, situated in St. Louis County, and known
as the "Ferguson Treatment Plant"; and
WHEREAS, in order to perfect the title thereto, the
Ferguson Sewer District granted this District a quit-claim deed
for said tract recorded as Daily No. 219, June 27, 1960 in the St.
Louis County Records; and
WHEREAS, the said Ferguson Sewer District was dissolved
by Decree of the Circuit Court of St. Louis County on June 1,
1960, and
WHEREAS, the City of Ferguson has requested this
District grant to it approximately one-half the aforementioned
tract, and has agreed to give this District a quit-claim deed for
the balance of the tract, and the District has no further need for
such portion of said tract,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The District does hereby Remise, Release
and forever Quit-Claim any right, title or interest in or to the
following described real estate, situated in the County of St.
Louis and State of Missouri, to wit:
Beginning at a point which is South 63 degrees 30
minutes East 717.2 feet and North 51 degrees 10 minutes East
166.75 feet from the intersection of the northeast line of
Ferguson Avenue (50 feet wide) and the common boundary between
United States Surveys 2689 and 393, which is also the West line of
Lot 8 of the Owen Chambers Estate, said point being the
westernmost corner of the following described tract; thence North
51 degrees 10 minutes East along the northwestern line of property
now or formerly of the Ferguson Sewer District a distance of
166.75 feet to the northernmost corner of said property; thence
South 63 degrees 30 minutes East along the northwestern line of
said property now or formerly of the Ferguson Sewer District a
distance of 500 feet to the easternmost corner of said property;
thence South 51 degrees 10 minutes West along the southeastern
line of said property now or formerly of the Ferguson Sewer
District a distance of 166.75 feet to a point; thence North 63
degrees 30 minutes West a distance of 500.0 feet to the point of
beginning, which described area is approximately 2 acres.
Section Two. The Executive Director is hereby
authorized and directed to execute in behalf of the District a
Deed giving effect to Section One hereof.
The foregoing Ordinance was adopted on July 7, 1960.
