HomeMy Public PortalAbout00429 O R D I N A N C E NO. 429 AN ORDINANCE, establishing a benefit subdistrict for the purpose of acquiring, extending, and improving a privately owned sanitary sewer system at the expense of such subdistrict situated in and adjacent to the City of Dellwood in St. Louis County, Missouri, to be known as Benefit Subdistrict No. 109 (Oakborough). WHEREAS, the District is empowered by Paragraphs (4), (5), (6), (15), and 21 of Section 3.020 of its Plan to acquire property by purchase, to extend its public sewer and drainage systems, and to meet the cost of acquiring, improving, and extending sewer or drainage facilities from the proceeds of special benefit assessments or bills evidencing such assessments, and WHEREAS, it is proposed that said powers be exercised to purchase, extend, and improve a sanitary sewer system owned by Town Service, Inc., a Missouri corporation, serving or capable of serving an area in and adjacent to the City of Dellwood in St. Louis County, Missouri, and WHEREAS, it is necessary to form a benefit subdistrict before the purchase price can be fixed and the Board of Trustees can declare the necessity of such purchase, and WHEREAS, the Board of Trustees wishes to hold a public hearing on the question whether this ordinance shall be adopted, in order to determine whether or not those interested desire that the District proceed with negotiations for such purchase, and 2 WHEREAS, if this ordinance is adopted, another public hearing will be held thereafter to advise the Board of Trustees on whether such purchase extension, and improvement are in the public interest, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. There is hereby established a benefit subdistrict of The Metropolitan St. Louis Sewer District within which private sewer or drainage facilities may be acquired, reconstructed, extended or improved at the expense of the benefit subdistrict. Such benefit subdistrict shall be known as Benefit Subdistrict No. 109 (Oakborough). Section Two. The boundaries of Benefit Subdistrict No. 109 (Oakborough) shall be as follows: (SEE NEXT PAGE) 3 Ord. No. 429 Beginning at a point, said point being the southeast corner of Lot 170 in Oakwood Park Subdivision No. 4 as recorded in Plat Book 57 on Page 38 of the St. Louis County Records; thence northwardly along the east line of said Oakwood Park Subdivision No. 4 and along the east line of Lots 53 through 56 in Oakwood Subdivision as recorded in Plat Book 52 on Page 27 of the St. Louis County Records to the northeast corner of said Lot 56; thence northwardly along the northern prolongation of the east line of said Lot 56 to the southeast corner of Lot 17 of Emerson Park No. 3 Subdivision as recorded in Plat Book 49 on Page 18 of the St. Louis County Records; thence northwardly along the east line of Lots 17, 15, 13, 11 and 9 of said Emerson Park No. 3 Subdivision to the northeast corner of said Lot 9; thence westwardly along the north line of said Lot 9 and along the western prolongation of said north line to the centerline of Scottdale Drive; thence northwardly along the centerline of said Scottdale Drive to the centerline of Chambers Road; thence eastwardly along the centerline of Said Chambers Road to its intersection with the southern prolongation of the west line of Block 5 of Chambers Park Subdivision as recorded in Plat Book 24 on Page 29 of the St. Louis County Records; thence northwardly along said prolongation and a along the west line of said Block 5 to its intersection with the eastern prolongation of the north line of property now or 4 formerly owned by Harry E. Faupel, as recorded in Deed Book 3628 on Page 550 of the St. Louis County Records; thence westwardly along said prolongation and along the north line of said Faupel property to the east line of Knollcrest Subdivision, as recorded in Plat Book 43 on Page 69 of the St. Louis County Records; thence northwardly along the east line of said Knollcrest Subdivision to the northeast corner of Lot 6 of said subdivision; thence westwardly along the north line of said Lot 6 to the northwest corner of said Lot 6; thence westwardly in a straight line across Knollcrest Court to the northeast corner of Lot 24 in said Knollcrest Subdivision; thence westwardly along the north line of said Lot 24 and along the western prolongation of said north line to the east line of Dellwood Hills Subdivision, as recorded in Plat Book 60 on Page 14 of the St. Louis County Records; thence northwardly along the east line of Lots 32 and 31 of said Dellwood Hills Subdivision to the northeast corner of said Lot 31; thence westwardly along the north line of Lots 31, 30, 29, 28 and 27 of said Dellwood Hills Subdivision to the east line of Lot 25 of said subdivision; thence northwardly along the east line of Lots 25, 24, 23, 22, 21 and 20 of said subdivision to the northeast corner of said Lot 20; thence westwardly along the north line of said Lot 20 to the northwest corner of said Lot 20; thence westwardly in a straight line across Dellridge Lane to the northeast corner of Lot 19 of said Dellwood Hills Subdivision; thence westwardly along the north line of said Lot 19 to the northwest corner of said Lot 19; 5 thence southwardly along the west line of said Dellwood Hills Subdivision to the north line of Chambers Road; thence westwardly along the north line of said Chambers Road to the southeast corner of property now or formerly owned by Alexander Pivin, as recorded in Deed Book 2026 on Page 89 of the St. Louis County Records; thence northwardly along the east line of said Pivin property to the northeast corner of said Pivin property; thence westwardly along the north line of said property to the northwest corner of said Pivin property; thence southwestwardly in a straight line across West Florissant Avenue to the northeast corner of Lot 1 in Block 1 of Bendemere Acres Subdivision, as recorded in Plat Book 23 on Page 33 of the St. Louis County Records; thence westwardly along the north line of said Lot 1 to the northwest corner of said Lot 1; thence westwardly across Floridale Avenue (40 feet wide) to the northeast corner of property now or formerly owned by Frances Olain as recorded in Deed Book 3669 on Page 344 and 345 of the St. Louis County Records; thence westwardly along the north line of said Olain property to the northwest corner of said property; thence southwardly along the west line of said Olain property and said west line produced southwardly to the centerline of said Chambers Road; thence eastwardly along said centerline of Chambers Road to its intersection with the northern prolongation of the west line of property now or formerly owned by Raymond O. Kirchmeyer, as recorded in Deed Book 3409 on Page 36 of the St. Louis County 6 Records; thence southwardly along said produced line and along the west line of said Kirchmeyer property to the southwest corner of said property; thence eastwardly along the south line of said Kirchmeyer property and along the eastern prolongation of said south line to the northwest corner of property now or formerly owned by William H. Schlueter Investment Company, as recorded in Deed Book 3099 on Page 379 of the St. Louis County Records; thence southwardly and eastwardly along the western and southern lines of said Schlueter property to the southernmost corner of said Schlueter property; thence eastwardly along the southernmost line of said Schlueter property and said south line produced eastwardly to the west line of West Florissant Avenue; thence eastwardly across said West Florissant Avenue to the southwest corner of property now or formerly owned by Ollie M. Jackson, as recorded in Deed Book 2510 on Page 303 of the St. Louis County Records; thence eastwardly along the south line of said Jackson property and along the eastern prolongation of said south line to the west line of Dellwood Park Subdivision, as recorded in Plat Book 52 on Page 5 of the St. Louis County Records; thence southwardly and southwestwardly along the west line of said Dellwood Park Subdivision to the southwest corner of said Subdivision; thence eastwardly along the south line of said Dellwood Park Subdivision and continuing along the south line of Dellwood Park Subdivision No. 2, as recorded in Plat Book 54 on Page 20 of the St. Louis County Records to the southeast corner of said Dellwood Park 7 Subdivision No. 2; thence southwardly along the west line of Block 8 in Oakborough Subdivision Plat 6, as recorded in Plat Book 57 on Page 20 of the St. Louis County Records to the southernmost corner of said subdivision; thence northeastwardly along the north right-of-way line of the St. Louis Belt and Terminal Railroad, 100 feet wide, to the southwest line of Oakborough Subdivision Plat 5, as recorded in Plat Book 51 on Page 28 of the St. Louis County Records; thence southeastwardly along the southwest line of said subdivision to the southwest corner of said subdivision; thence eastwardly along the south line of said Oakborough Subdivision Plat 5 to the southeast corner of said Subdivision; thence northwardly along the east line of said Subdivision to the north right-of-way line of said St. Louis Belt and Terminal Railroad; thence northeastwardly along said north line to the point of beginning; 8 The foregoing Ordinance was passed on July 28, 1960.
