AN ORDINANCE, repealing Ordinance No. 290 as adopted
June 11, 1959, Resolution No. 247 as adopted July 22, 1959, and
Resolution No. 259 as adopted August 27, 1959, and enacting a new
ordinance in lieu of Ordinance No. 290 on the same subject, re-
establishing Special Benefit Subdistrict No. 74 (Wheaton Lateral)
and prescribing new boundaries for such subdistrict.
WHEREAS, Special Benefit Subdistrict No. 74 (Wheaton
Lateral) was established by Ordinance No. 290 and the Board of
Trustees is now informed that part of the area within the
boundaries of such subdistrict can not be efficiently served by
sanitary sewers proposed to be constructed in such subdistrict
because such part is already served by lateral sanitary sewers
having a separate outlet,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. Ordinance No. 290 as adopted June 11,
1959, Resolution No. 247 as adopted July 22, 1959, and Resolution
No. 259 as adopted August 27, 1959, are hereby

repealed and this ordinance is adopted in lieu of said Ordinance
No. 290.
Section Two. Pursuant to a petition of residents of the
District, there is hereby established a subdistrict of The
Metropolitan St. Louis Sewer District within which sewer or
drainage facilities may be constructed, reconstructed, or improved
at the expense of the subdistrict. Such subdistrict shall be
known as Special Benefit Subdistrict No. 74 (Wheaton Lateral).
Section Three. The boundaries of Special Benefit
Subdistrict No. 74 (Wheaton Lateral) shall be as follows:

WHEATON SUBDISTRICT
Beginning at a point, said point being the intersection of
the centerline of Carson Road (50 feet wide) with the easterly
prolongation of the south line of Lot 20 in Block 1 of Lyndhurst,
a subdivision recorded in the St. Louis County Recorder's Office
in Book 9, Page 4; thence westwardly along said produced line and
along the south line of said Lot 20 of said Block 1 to the
west line of said Lot 20; thence southwardly along the west line
of Lot 20 of said Block 1 to the southeast corner of Lot 16 of
said Block 1; thence westwardly along the south line of said Lot
16 and along said line produced westwardly across Lyndhurst Avenue
(50 feet wide) and along the south line of Lot 18 of Block 2 of
said Lyndhurst Subdivision to the southwest corner of said Lot 18;
thence southwardly along the east line of Lots 12 to 10 inclusive
of Block 2 of said Lyndhurst Subdivision to the southeast corner
of said Lot 10; thence westwardly along the south line of said Lot
10 and along its prolongation westwardly across Hanley Road (50
feet wide) and along the south line of Lots 18 and 7 of Block 3 of
said Lyndhurst Subdivision and along the westwardly prolongation
of said south line of said Lot 7 across Wheaton Avenue (50 feet
wide) and along the south line of Lot 3 of Block 4 of said
Lyndhurst Subdivision to the southwest corner of said Lot 3;

thence southwardly along the west line of Lots 2 and 1 of said
Block 4 and along said west line projected southwardly across St.
Charles Rock Road to its intersection with the southwestern line
of said St. Charles Rock Road; thence northwestwardly along said
southwestern line of said St. Charles Rock Road to its
intersection with a line two hundred (200) feet northwest of and
parallel to the northwest line of North and South Road (50 feet
w|de) formerly Spring Avenue running southwestwardly from St.
Charles Rock Road; thence southwestwardly along said last
mentioned parallel line to the north line of East Midland
Subdivision, as recorded in Plat Book 14 on Page 25 of the St.
Louis County Records; thence westwardly along the north line of
said East Midland Subdivision to the east line of Lot 11 in Block
7 of Midland Heights, a subdivision recorded in Plat Book 3 on
Page 57 of the St. Louis County Recorder's Office; thence
southwardly along the east line of said Lot 11 in said Block 7 to
the southeastern corner of said Lot 11; thence westwardly along
the southern line of said Lot 11 to its intersection with the
eastern line of Bristow Avenue (formerly Baldwin Avenue), (40 feet
wide); thence westwardly across said Bristol Avenue in a direct
line to the southeast corner of a lot now or formerly of Ralph M.
and Evelyn G. McCormick, as recorded in Deed Book 3411 on Page 613
of the St. Louis County Records; thence westwardly along the south
line of said McCormick property to its intersection with the east
line of a lot now or formerly of V. W. and L. Haeffner, as

recorded in Deed Book 2162 on Page 536 of the St. Louis County
Records; thence southwardly along said east line of said Haeffner
property to the southeast corner of said Haeffner property; thence
westwardly along the south line of said Haeffner property and said
line produced westwardly to its intersection with the eastern line
of Lot 4 in Block 8 of said Midland Heights Subdivision; thence
southwardly along the eastern line of said Lot 4 to its
intersection with the northeastern line of Lot 15 of Central
Addition to Midland Heights according to the plat thereof recorded
in Plat Book 5 on Page 79 in the St. Louis County Records; thence
northwestwardly along said northeastern line of said Lot 15 to the
northwestern corner of said Lot 15; thence southwardly along the
western line of said Lot 15 and along the southward prolongation
thereof to it intersection with the northeastern line of the
right-of-way of the St. Louis Public Service Company on Midland
Boulevard;thence south- eastwardly and southwardly along the
northeastern and eastern lines of the right-of-way of the St.
Louis Public Service Company on Midland Boulevard to its
intersection with the southern line of Wheaton, according to the
Plat thereof recorded in Plat Book 6 on Page 20 of the St. Louis
County Records; thence eastwardly along said southern line of said
Wheaton and along its direct eastwardly prolongation to its
intersection with the centerline of Hanley Road; thence
northwardly along said centerline to its intersection with the
westward projection of the south line of property now or formerly

of Roy Crosby Company, as recorded in Deed Book 2798 on page 536
of the St. Louis County Records; thence eastwardly along said
westward projection and along said property line and along the
eastward projection of said property line to its intersection with
the centerline of St. Charles Rock Road; thence southeastwardly
along said centerline of St. Charles Rock Road to its intersection
with the southward projection of the centerline of Carson Road;
thence northwardly along said projection and along said centerline
to its intersection with the eastern prolongation of the south
line of property now or formerly owned by Nellie Tybura, as
recorded in Deed Book 3921 on Page 611 of the St. Louis County
Records; thence westwardly along
said prolongation and along the south line of said Tybura property
and along the western prolongation of said south line to the
centerline of a 20 foot wide alley in Block 1 of said Lyndhurst
Subdivision; thence northwestwardly along the centerline of said
alley to its intersection with the southern prolongation of the
westernmost line of Lot 33 in Block 1 of said Lyndhurst
Subdivision; thence northwardly along said prolongation and along
the west lines of Lots 33, 32, 31, 30, 29, 28, 27, 26, 25 and 24
in said Block 1 to the southwest corner of property now or
formerly owned by Clara P. Mittendorf, as recorded in Deed Book
3885 on Page 337 of the St. Louis County Records; thence
eastwardly along the south line of said Mittendorf property and
along the eastern prolongation of said south line to the

centerline of Carson Road; thence northwardly along the centerline
of said Carson Road to the point of beginning.
