HomeMy Public PortalAbout00520 O R D I N A N C E NO. 520 AN ORDINANCE vacating the interests of The Metropolitan St. Louis Sewer District in an easement in the City of Kirkwood, Missouri; WHEREAS, by instrument recorded in Book 2447, page 126, wherein John C. Cox and Jane Fisher Cox were grantors and Cox-Ware Corporation was grantee, a 10 foot wide easement for sewer purposes was reserved by grantors, and WHEREAS, the District is successor in title to a part of the property formerly owned by said John C. Cox and Jane Fisher Cox, and thus of certain interests in said easement, and acquired such title by instrument recorded in Book 4440, page 411 of the St. Louis County Records, and WHEREAS, the Owner of the property burdened by said easement has requested this District to vacate such easement, and this District has no use or need for such easement, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The interests of The Metropolitan St. Louis Sewer District in the following described sewer easement are hereby vacated, to wit: That easement ten (10) feet wide for sewer purposes across property conveyed by John C. Cox and Jane Fisher Cox to Cox-Ware Corporation by instrument recorded in Book 2447, page 126 of the St. Louis County Records, the center line of which sewer easement is further described as intersecting the center of a manhole then located in the sewer of the City of Kirkwood, according to an easement recorded in Book 1532, page 341 of the St. Louis County Records, said center line of aforesaid sewer easement being 202 feet, more or less, east of and parallel with Clark Avenue. The foregoing Ordinance was adopted March 23, 1961. -2-
