AN ORDINANCE declaring the necessity for the acquisition
of an easement within certain existing property within The
Metropolitan St. Louis Sewer District, for the purpose of
permitting construction of sewers therein to serve the needs of
residents on adjacent lands and authorizing the institution of
condemnation proceedings in connection therewith, with an
emergency clause.
WHEREAS, there exists within The Metropolitan St. Louis
Sewer District an area in the vicinity of Gravois Road and Eddie
and Park Road in St. Louis County, Missouri in which there work
and live numerous people; and
WHEREAS, sanitary sewage gathered from such area will
have no alternative means of disposition to crossing said property
and will constitute a menace to public health and welfare of the
general public and the residents of The Metropolitan St. Louis
Sewer District; and
WHEREAS, it is the purpose and design of The
Metropolitan St. Louis Sewer District to protect the public health
by relieving and alleviating these conditions;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. In order to protect the public health and
relieve the aforesaid insanitary and dangerous conditions, it is
necessary to appropriate and acquire by the exercise of eminent
domain or otherwise, an easement for the use of sewers as
hereinafter set forth, together with such working space adjacent
to the right-of-way as obtained as may be required for working

room during the construction period, and the right of ingress and
egress over the premises sought to be condemned for the access to
such easements:
An easement fifteen (15) feet wide across a tract of
land in the Northeast 1/4 of Section 20 Township 44 North Range 6
East in St. Louis County, Missouri, which tract is more par-
ticularly described as: Beginning at an old stone in the East and
West center Section line of said Section 20, being also the
Southwest corner of a tract of land conveyed to John Dietrich by
deed dated December 21, 1903 recorded in Book 147 page 241; thence
along said East and West center line South 89 degrees 17 minutes
East 14.39 chains to an old stone in the East line of a private
road 20 feet wide; thence along the East line of said road North
18 degrees 11 minutes East 6.729 chains to an old stone; thence
North 0 degrees 9 minutes West 19.254 chains to an old stone in
the South line of Gravois Road; thence along the South line of
said road South 79 degrees 01 minutes West 8.383 chains to a
stone; thence South 30 degrees 24 minutes East 13.653 chains to a
point in a creek, from which a stone bears North 30 degrees 24
minutes West 9.8 links; thence along said creek the following
courses and distances to wit: South 54 degrees 59 minutes West
6.128 chains, North 88 degrees 49 minutes West 4.70 chains, South
48 degrees 05 minutes West 2.50 chains, South 78 degrees 5 minutes
West 4.003 chains to a point in said creek from which a stone
bears South 3 degrees 40 minutes East 46.8 links; thence South 3
degrees 40 minutes East 6.241 chains to the place of beginning
containing 19.85 acres exclusive of said 20 foot private road

along East line of said property according to a survey thereof
made by Richard Elbring, Surveyor on January 30, 1919.
The centerline of said fifteen (15) foot wide easement
is described as follows:
Beginning at the most Easterly corner of property
conveyed to Joseph Heutel and Lillian E. Heutel, his wife, by deed
recorded in Book 814 page 384 of the St. Louis County Records,
which corner is also a corner of property now or formerly of
Valentine, being 13.653 chains Southwardly from the South line of
Gravois Road, measured along the common property line of Heutel
and Valentine; thence Eastwardly along a straight line a distance
of 95 feet more or less to a point on the Eastern line of said
property of Valentine, said point being 870.85 feet Southwardly
from the Northeast corner of said Valentine property, which corner
is also on the South line of Gravois Road.
Section Two. Counsel for The Metropolitan St. Louis
Sewer District be and is hereby authorized to institute and
prosecute an action in condemnation pursuant to the provisions of
the Plan of The Metropolitan St. Louis Sewer District and the laws
of the State of Missouri, for the appropriation of private
property as hereinbefore set out.
Section Three. The immediate construction of sewers
being necessary in order to protect the public health within the
District constitutes an emergency within the meaning of the Plan
of the Metropolitan St. Louis Sewer District and this Ordinance
shall take effect immediately upon its adoption.
