AN ORDINANCE declaring the necessity for the acquisition
of easements within certain existing property within The
Metropolitan St. Louis Sewer District, for the purpose of
permitting construction of sewers therein to serve the needs of
residents on adjacent lands and authorizing the institution of
condemnation proceedings in connection therewith, with an emergency
clause.
WHEREAS, there exists within The Metropolitan St. Louis
Sewer District an area in the Gravois Creek Trunk Subdistrict of
The Metropolitan St. Louis Sewer District in which there work and
live numerous people; and
WHEREAS, sanitary sewage gathered from such area will
have no alternative means of disposition to crossing said property
and will constitute a menace to public health and welfare of the
general public and the residents of The Metropolitan St. Louis
Sewer District; and
WHEREAS, it is the purpose and design of The Metropolitan
St. Louis Sewer District to protect the public health by relieving
and alleviating these conditions;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. In order to protect the public health and
relieve the aforesaid insanitary and dangerous conditions, it is
necessary to appropriate and acquire by the exercise of eminent

domain or otherwise, easements for the use of sewers as hereinafter
set forth, together with such working space adjacent to the right-
of-way as obtained as may be required for working room during the
construction period, and the right of ingress and egress over the
premises sought to be condemned for the access to such easements:
An easement twenty feet wide across Lot No. 87 of Part of
Block No. 87, Carondelet Commons, a subdivision of St. Louis
County, Missouri, which property is now or formerly of Anna Becker.
The centerline of the aforesaid easement is described as
follows:
Beginning at a point in the southeast line of Grand
Avenue (50 feet wide) 162.98 feet from the southwest corner of
aforesaid Lot No. 87; thence eastwardly at an angle of 127 degrees
1 minute a distance of 76.25 feet to a point of tangency with a
curve; thence on a curve to the right with a radius of 100 feet an
arc distance of 74.96 feet to a point of tangency with a straight
line; thence on a straight line a distance of 488.9 feet to the
point of intersection of the centerline of Old Gravois Creek and
the southeastwardly line of alley (15 feet wide) in Block 3, Rose
Cottage Heights subdivision.
An easement twenty (20) feet wide across Lot 12, Block 1,
Pardella Place, a subdivision of St. Louis County, Missouri.
The centerline of aforesaid easement is described as follows:
Beginning at a point in the easterly line of Pardella

Avenue (60 feet wide), 42.69 feet northwardly from the southwest
corner of said Lot 12; thence eastwardly to a point on the
northerly line of said Lot 12, which point is 148.15 feet east-
wardly from Pardella Avenue measured along the north line of said
Lot 12.
An easement twenty (20) feet wide across Lot 12, Weil's
Subdivision, a subdivision of St. Louis County, Missouri.
The centerline of said easement is described as follows:
Beginning at a point on the southwesterly boundary of Little
Broadway (50 feet wide) 94.88 feet northwesterly from the most
easterly corner of said Lot 12; thence on a curve to the left with
a radius of 300 feet an arc distance of 118.97 feet to a point of
tangency with a straight line southwestwardly to a distance of
124.51 feet to a point thence along such curve to the right of
tangency with a curve to the right the right/with a radius of 300
an arc distance of 52.27 feet to a point of tangency with a
straight line; thence on a straight line a distance of 3.74 feet to
the point of intersection with the southwesterly line of said Lot
12, said point being 206.36 feet northwestwardly measured along
the southwestwardly line from the most southerly corner of said
Lot 12. An easement twenty (20) feet wide across Lot 5, Block 3,
Pardella Place, a subdivision of St. Louis County, Missouri. The
centerline of said easement is described as follows: Beginning at
a point in the southwesterly line of said Lot 5, being also the

northeasterly line of Little Broadway (50 feet wide) 49.68 feet
northwesterly from the southerly corner of said Lot 5; thence
eastwardly a distance of 73.64 feet to a point on the southeasterly
line of said Lot 5 being 54.32 feet northeasterly from the
aforesaid southerly corner of said Lot 5. An easement twenty (20)
feet wide across Lots 2, 3 and 4 of Block 3, Pardella Place, a
subdivision of St. Louis County, Missouri. The centerline of said
easement is described as follows:
Beginning at a point on the northwesterly line of said
Lot 2, 70.72 feet from the northeasterly line of Little Broadway
(50 feet wide); thence eastwardly a distance of 192.70 feet to a
point on the southeasterly line of said Lot 4, and being 212.87
feet from the intersection of northeast line of Little Broadway
and the northwest line of Baumann Avenue (40 feet wide).
An easement twenty (20) feet wide, an easement ten (10)
feet wide, and an easement ninety (90) feet wide, all in and across
Lot 35, Sigerson Nursery Tract, a subdivision of St. Louis County,
Missouri. The centerline of said twenty (20) foot wide easement is
described as follows:
Beginning at a point on the southeastern line of said
Lot 35, which point is 53.50 feet northeastwardly, measured along
said lot line, from the eastern corner of Lot 29, Dallas Court
Continuation Subdivision, a subdivision of St. Louis County,
Missouri; thence westwardly along a line a distance of 281.64

feet to the intersection of such line with the/western line of
said Lot 35, such point of intersection being 263.04 feet south-
westwardly from the northerly corner of said Lot 35, measured
along said northwest line thereof. The centerline of aforesaid
easement ten (10) feet wide across aforesaid Lot 35 is described as
follows:
Beginning at a point on the centerline of the previously
described 20 foot wide easement across said Lot 35, said point
being 62.71 feet from the point of beginning of such centerline;
thence on an angle to the left of 58 degrees, 43 minutes, 36
seconds along a line a distance of 42.92 feet to its intersection
with the northeasterly line of aforesaid Dallas Court Continuation
Subdivision.
The boundary of aforesaid easement ninety (90) feet
wide in aforesaid Lot 35 is described as follows:
Beginning at the point of beginning of aforesaid
20 foot wide easement across aforesaid Lot 35, which point
is further described as being on the southeast line of said
Lot 35 a distance of 53.50 feet northeastwardly from the east
corner of aforesaid Lot 29, Dallas Court Continuation Subdivision;
thence westwardly, along the centerline of aforesaid 20 foot wide
easement a distance of 25 feet to a point; thence northwardly, at
an angle to the right of 65 degrees a distance of 130 feet to a
point; thence on an angle to the right of 90 degrees a distance of

90 feet to a point; thence southwardly a distance of 45 feet more
or less to a point on the southeast line of aforesaid Lot 35, which
point is 100 feet southwestwardly from the easterly corner thereof;
thence southwestwardly along said southeasterly line of Lot 35 to
the point of beginning. An easement twenty (20) feet wide, and an
easement of irregular width adjacent thereto, both across Lot 45,
Sigerson Nursery Tract, a subdivision of St. Louis County,
Missouri, which is property now or formerly of Frank Roshel. The
centerline of said twenty (20) foot wide easement is described as
follows:
Beginning at a point on the northwesterly line of said
property, 248.66 feet southwestwardly from the northerly corner of
said property, measured along the said northwesterly line thereof;
thence southeastwardly, at an angle of 70 degrees 36 minutes to
aforesaid northwest line of said property, a distance of 49.82 feet
to a point of tangency with a curve; thence along a curve to the
left with a radius of 300 feet, an arc distance of 148.61 feet, to
a point of tangency with a straight line; thence along a straight
line a distance of 110.67 feet to its point of intersection with
the southeast line of said property, said point being 263.04 feet
southwestwardly from the eastern corner of said property, measured
along the southeast line thereof. The boundary of said easement of
irregular width in aforesaid property of Roshel is described as
follows:

Beginning at a point on the southeast line of said
property, said point being southwestwardly a distance of 147 feet
from the most easterly corner thereof; thence northwestwardly at an
angle of 71 degrees a distance of 50 feet to a point; thence at an
angle to the left of 43 degrees a distance of 107 feet to a point,
thence at an angle to the right of 36 degrees a distance of 161
feet more or less to the northwest line of said property, which
point is 141.8 feet southwestwardly from the north corner of said
property; thence southwestwardly along said property line 100 feet
more or less to the northerly boundary line of aforesaid 20 foot
easement; thence along said boundary line of said twenty foot
easement to the southeasterly line of said property; thence along
said southeasterly line northeastwardly a distance of 100 feet more
or less to the point of beginning. An easement twenty (20) feet
wide across Lot A, Cardinal Hills Subdivision, a subdivision of St.
Louis County, Missouri. The centerline of said twenty (20) foot
wide easement is described as follows:
Beginning at a point on the northerly line of Bayless Road
(60 feet wide), said point being 85.21 feet westerly from the
southeast corner of said Lot A; thence northwardly 166.20 feet to a
point on the north line of said Lot A, which point is 88.57 feet
west of the northeast corner of said Lot A. An easement twenty
(20) feet wide across property now or formerly of Walter
Rothenhoeffer and Martha Rothenhoeffer, his wife, in Lot 59 of the

Sigerson Nursery Tract, a subdivision of St. Louis County,
Missouri, which property is shown as being conveyed by instrument
recorded in Deed Book 376 page 293 in the survey of Part of Lots
71, 72 and 73 of the Subdivision of Sigerson Nursery Tract, which
survey is recorded in Plat Book 41, page 37 of the St. Louis County
Records.
The centerline of said twenty (20) foot wide easement is
described as follows:
Beginning at a point on the northeast line of said
property, said point being 178.73 feet northwesterly from the east
corner thereof; thence on a curve to the left with a radius of 175
feet an arc distance of 47.63 feet to a point on the southwesterly
line of said property, said point being 161.16 feet from the south
corner of said property, measured along the southwest line thereof.
An easement twenty (20) feet wide across property now or formerly
of Walter Rothenhoeffer and Martha Rothenhoeffer, his wife, in Lot
59 of the Sigerson Nursery Tract, a subdivision of St. Louis
County, Missouri, which property is further described as follows:
Beginning at the northern corner of Lot 8, Bella Villa
Second Addition, a subdivision of St. Louis County, Missouri,
according to the plat thereof recorded in Plat Book 55 page 71 of
the St. Louis County Records; thence northwesterly, at right angles
to the northwest line of said lot, a distance of 483.6 feet to a
point in the centerline of Gravois Creek, which point is also on

the common lot lines of Lot 71 and Lot 59 of aforesaid Sigerson
Nursery Tract; thence southwardly along said common lot line to its
intersection with the northwestwardly production of the southwest
line of Lot 6 of aforesaid Bella Villa Second Addition Subdivision;
thence southeastwardly along said production a distance of 330 feet
to the western corner of said Lot 6; thence northeastwardly along
the northwest boundary of said Bella Villa Second Addition
Subdivision a distance of 357.85 feet (361.37 feet, record), to the
point of beginning.
The centerline of said twenty (20) foot wide easement is
described as follows:
Beginning at a point on the northeast boundary of
aforesaid property now or formerly of Rothenhoeffer immediately
preceding, which point is 249.47 feet northwestwardly from the
easterly corner of such property, which corner is also the
northerly corner of Lot 8 of aforesaid Bella Villa Second Addition
Subdivision; thence southwestwardly, at an angle to the left of 88
degrees, 14 minutes a distance of 306.18 feet to a point of
tangency with a curve; thence on a curve to the left with a radius
of 175 feet an arc distance of 50.40 feet to a point on the
southwest line of said property, which point is 251.05 feet from
the south corner of said property.
An easement twenty (20) feet wide, across Lot 11, Block
3, Nol Heights, a subdivision of St. Louis County, Missouri.

The centerline of said twenty (20) foot wide easement is
described as follows:
Beginning at a point in the northeast line of said Lot
11, which is also a point on the southwestern line of Orient Avenue
(20 feet wide), said point being 71.29 feet northwest of the most
eastwardly corner of Lot 10 of said Nol Heights Subdivision; thence
westwardly a distance of 127.27 feet to a point on the
southwesterly line of said Lot 11, said point being 78.59 feet
northwardly from the most southerly corner of said Lot 11.
An easement twenty (20) feet wide across property now or
formerly of Jacuzzi Bros. Inc., a corporation, which property lies
in Lot 73, Sigerson Nursery Tract, a subdivision of St. Louis
County, Missouri. The centerline of the aforesaid easement is
described as follows:
Beginning at a point on the southwest line of said Lot 73,
256.99 feet southeastwardly from the most westerly corner thereof,
measured along said southwest line; thence eastwardly 415.39 feet
to a point on the westward projection of the southwest line of Lot
11, Block A-2 of Nol-Heights, a subdivision of St. Louis County,
Missouri, said point being 145.9 feet westwardly, measured along
said projected lot line, from the south corner of said Lot 11. An
easement twenty (20) feet wide and an easement ten (10) feet wide
across property now or formerly of Elevena Hoerner, which property
lies in Lot 56, Sigerson Nursery Tract, a subdivision of St. Louis

County, Missouri. The aforesaid twenty (20) foot easement is
described as follows:
Beginning at the point of intersection of the northerly
line of Flori Acres, a Subdivision of St. Louis County, Missouri,
with the westerly line of Avenue H, which point is 110.87 feet
northwardly from the southerly line of Lot 56 of aforesaid Sigerson
Nursery Tract, measured along said westerly line of Avenue H;
thence westwardly along the said northerly line of Flori Acres and
its westwardly extension, a distance of 1214 feet more or less to
the centerline of Gravois Creek, such line and its extension being
110.87 feet northwardly from and parallel with the southerly line
of said Lot 56; thence northwardly along the centerline of Gravois
Creek, which centerline is also the common property line of Santa
Maria Country Club and property of Hoerner, a distance of 139 feet
to a point; thence on an angle to the left 30 degrees, 41 minutes a
distance of 23 feet to the point of beginning of the centerline of
aforesaid twenty (20) foot easement; thence on an angle to the
right 71 degrees 51 minutes 30 seconds a distance of 250 feet more
or less to the centerline of Gravois Creek, which centerline is
also a northeasterly line of said Hoerner property. The centerline
of aforesaid ten (10) foot easement is described as follows:
Beginning at a point on the centerline of aforesaid twenty
foot easement, which point is easterly 115.16 feet from the point

of beginning of such twenty foot easement; thence south at an angle
of 64 degrees a distance of 280.69 feet to a point on the north
line of Parcel A of aforesaid Flori Acres Subdivision, which point
is 22.7 feet easterly from the most northerly corner of said Parcel
A, and being also 336 feet more or less easterly from the
centerline of Gravois Creek measured along the westerly extension
of the northerly boundary of Flori Acres as aforesaid.
Section Two. Counsel for The Metropolitan St. Louis
Sewer District be and is hereby authorized to institute and
prosecute an action in condemnation pursuant to the provisions of
the Plan of The Metropolitan St. Louis Sewer District and the laws
of the State of Missouri, for the appropriation of private property
as hereinbefore set out.
Section Three. The immediate construction of sewers
being necessary in order to protect the public health within the
District constitutes an emergency within the meaning of the Plan of
The Metropolitan St. Louis Sewer District and this Ordinance shall
take effect immediately upon its adoption.
The foregoing Ordinance was adopted April 6, 1961.
