HomeMy Public PortalAbout00569REPEALED BY ORDINANCE NO. 8879 - 2/10/93 O R D I N A N C E NO. 569 AN ORDINANCE amending Ordinance No. 164, as adopted November 4, 1957 and as amended May 26, 1958 by Ordinance No. 199 providing for the letting of contracts for improvements, by adding thereto two new sections to be known as Section Eighteen and Section Nineteen of Ordinance No. 164, said new sections prescribing certain forms to be used in ascertaining the responsibility of contractors who submit bids for the performance of such work and authorizing the establishment of rules and regulations for the submission of such forms, with an emergency clause. BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. Ordinance No. 164 as adopted November 4, 1957 and amended May 26, 1958 by Ordinance No.199, is hereby amended by adding thereto two new sections, hereby designated Section Eighteen and Section Nineteen of Ordinance No. 164, reading as follows, to-wit: Section Eighteen. Whenever the aggregate costs of any improvement will be Five Thousand Dollars ($5,000.00) or more, for the purpose of enabling the Executive Director to prequalify as responsible bidders the bidders submitting bids for the construction of such improvements and so that the Executive Director can exercise intelligently the discretion hereby conferred 2 on him to determine whether prospective bidders are responsible, each prospective bidder shall be required to submit under oath in advance of the submission of his bid a statement of his experience in such work and of the equipment which he has available for the performance of such work, and a financial statement certified by a certified public accountant. The statements hereby required shall be submitted on forms which shall be prescribed by the Executive Director. The forms so prescribed shall be designated, respectively, as the experience questionnaire, the plan and equipment questionnaire, and the contractor's financial statement, and shall be based, so far as applicable on the standard questionnaires and financial statement for bidders as approved for use in investigating the qualifications of bidders on public construction work of the State of Missouri, and the forms so approved are hereby prescribed as the forms which shall hereafter be used in obtaining the information which is required in the administration of this ordinance. If the information submitted by any bidder on the forms herein prescribed is found, on examination, to be unsatisfactory, the bid submitted by such bidder shall not be considered." "Section Nineteen. The Executive Director is hereby authorized to establish rules and regulations not inconsistent herewith for the submission of the forms herein-above prescribed as a condition for consideration of bids for the improvements 3 comprehended by this ordinance." Section Two. An emergency is hereby declared to exist within the meaning of the Plan by reason of the necessity to invite bids from responsible bidders for the construction of a major trunk sewer for the protection of the public health. Accordingly, this ordinance shall take effect immediately upon its enactment. The foregoing Ordinance was adopted June 3, 1961.
