HomeMy Public PortalAbout00588 O R D I N A N C E NO. 588 AN ORDINANCE authorizing and directing the Executive Director to grant to the State of Missouri, for the use of the State Highway Commission of Missouri, the right to cross the River des Peres Drainage Works in the City of St. Louis with a highway, and to execute an instrument giving effect thereto upon the conditions hereinafter set out. WHEREAS, pursuant to the Plan of The Metropolitan St. Louis Sewer District and by Resolution No. 6 of the District, adopted July 1, 1954 and recorded in Book 7407, page 596 of the City of St. Louis Records, the District took title for its use and possession to all public easements for sewer and drainage purposes within its area, including those of the City of St. Louis; and WHEREAS, the State Highway Commission of the State of Missouri wishes to cross the River des Peres Drainage Works of this District with a highway; and WHEREAS, the State Highway Commission of the State of Missouri has requested the District grant the right to so use such Drainage Works, and the District is willing so to do; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Metropolitan St. Louis Sewer District does hereby grant to the State of Missouri, for the use of the State Highway Commission, the right to construct, reconstruct, repair and maintain a highway across the River des Peres Drainage Works in the City of St. Louis, Missouri, according to plans 2 approved by District's Engineering Department and as hereinafter set forth, subject, however, to the following terms and reservations: The Metropolitan St. Louis Sewer District reserves the right to the full access to and use of such Drainage Works for sewer and drainage purposes, including the right to construct new sewers and appurtenances therein and to use, maintain and reconstruct the new and existing sewers and appurtenances therein. The State Highway Commission will, if considered reasonably necessary by District's engineers, protect the existing Drainage Works, sewers and appurtenances at its cost, or, if necessary to reconstruct, relocate or repair because of such highway use, such work will be done at the cost of the State Highway Commission. That portion of the River des Peres Drainage Works which is involved in this grant is described as follows: A parcel of land in the River des Peres Drainage Works as established by Ordinance 32986 and in City Blocks 3292 and 3293 and Out Lot 3 of the City of St. Louis, Missouri and described as beginning at a point on the western right-of-way line of said River des Peres Drainage Works, said point being North 8 degrees, 34 minutes, 31 seconds East along said right-of-way line a dis- tance of 118.72 feet from the northern line of Primm Street; thence North 81 degrees, 02 minutes, 14 seconds East across said right-of-way a distance of 294 feet more or less to a point on the 3 eastern right-of-way a distance of 294 feet more or less to a point on the eastern right-of-way line of said River des Peres Drainage works; thence North8 degrees, 34 minutes, 31 seconds East along said eastern right-of-way line a distance of 11 feet more or less to a pont of curve; thence continuing along said eastern right-of-way line on the arc of a curve to the left having a radius of 1306.28 feet a distnace of 480 feet to a point;t hence westwardly a distance of 287 feet to a point on said western right-of-way line of the River des Peres Drainage Works; thence southwardly along said western right-of-way line on the arc of a cruve to the right having a radius of 1026.28 feet a distance of 424 feet to a ponit of curve; thence South 8 degrees, 34 minutes, 31 seconds West along said western right-of-way line a distance of 96.54 feet to the point of beginning and contianing 141,615 square feet (3.25 acres) more or less. Section Two. The Executive Director is hereby authorized and directed to execute in behalf of the District an instrument giving effect to Section One hereof. 4 The foregoing Ordinance was adopted June 29, 1961.
